ORDINANCE NO. 2725
AN ORDINAl-WE GRANTING A TRANSITIONAL FRONT YARD
VARIATION FOR PROPERTY LOCATED AT THE SOUTH-
! EAST CORNER OF ELMHURST AVENUE AND CENTRAL ROAD
.' VHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did conduct
public hearing on the 7th day of July, 1977, at the hour of 8: 00 p.m.. at the
ublic Safety Boardroom, and did hear Case No. 27-V -77 , pursuant to proper legal
otice; and
7HEREAS, the Zoning Board of Appeals of the Village of i\lount Prospect did hear thi
equest for a transitional front yard variation to allow the petitioner to construct a
estaurant to within ten feet (10') of the property line adjacent to Central Road en th

NHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did recomme. d

o the Building Committee of the Board of Trustees of the Village of Mount Prospect thr
pproval of this request under Case No. 27-V-77; and
VHEREAS. the Building Committee of the Board of Trustees of the Village of Mount
rospect did meet on July 13, 1977. and did review the recommendations of the Zonin
oard of Appeals in Case No. 27-V-77; and
r'lHEREAS. the Building Committee of the Board of Trustees of the Village of Mount
rospect have recommended that the Board of Trustees of the Village of rvlount Prospe
oncur in the recommendations of the Zoning Board of Appeals under said Case No.
7-V-77; and
IHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
eviewed the matter herein and have determined that the same is in the best interests
f the Village of Mount Prospect;
JOW. THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
F THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
ECTION ONE: That the property being the subject matter of Case No. 27-V-77.
eing legally described as follows:
That part of Lot 1 in Desiderata Subdivision in Section 12, Township 41
North, Range 11 East of the Third Principal Meridian described as follows:
Beginning at the Northwest corner of said lot 1; thence South along the
West line of said Lot 1 a distance of 246.07 feet; thence East along a line
that is perpendicular to the West line of said Lot 1 a distance of 67.34
feet;
Thence Northeasterly along a :i.1:1e that is drawn perpendicular to the South-
westerly line of lot 1 a distance of 65.76 feet; thence East along a line that
is drawn perpendicular to the West line of said lot 1 a distance of 55.38
feet to the most westerly East line of said lot 1; thence North along said
East line to the North line of said lot 1; thence west along said north line
to the point of beginning, in Cook County, Illinois.

B-3 (Business-Retail and Service District). which zoning classification shall remain
in effect subject to the variation granted herein:

I SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
"I Codes shall be applicable except the variation noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in accorda. ce

I SECTION FOUR: That the variation granted by this Ordinance shall be null and VOi~
and of no force and effect whatsoever unless an application for a building permit I
