ORDINANCE NO 2744
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to the authority vested in the Board of Trustees
of the Village of Mount Prospect under Article VII of the 1970 Illinois Constitu-
tion, subsections B and C of Section 23.306 of the Municipal Code of Mount Pros-
pect of 1957, as amended, be and the same are hereby furthe:r amended in their
entireties; so that hereafter the said subsections B and C of Section 23.306
shall be and read as follows:

B. All Village users within the Village t except as set forth in
paragra.phs 1 and 2 below ~ having a direct or indirect con-
nection with Village water mains shall pay the following rates
per quarter:
Per 1,000 gallons . . . . . . . . . . . . $1. 30
1. In addition to the foregoing charges ~ all Village users re-
siding in the Fairview Gardens subdivision ~ being legally
described as:

Begin.ning at a point on the South line of the Southeast Quarter 0.)
of Section 35, -Township 42 North, Range 11, East of the Third
Principal Meridian in the County of Cook in the State of Illinois,
which said point lies 660.30 feet West of the Southeast corner
of said Section 35; running thence West for a distance of 1320.48
feet along the section line; running thence North to the North
line of the Southeast Quarter (;}) of said Section 35, beginning
a distance of 2646.66 feet, more or less; running thence East
for a distance of 1319.23 feet along the said North line of the
Southeast Quarter (i) of said Section 35; running thence South
to the point of beginning; and
That part of Section 35, Township 42 North, Range 11, Ea.st of
the Third Principal Meridian in the County of Cook in the State
of Illinois described as follows: Commencing at the Southeast
corner of said Section 35, running thence West on the South
line of said Section 35 for a distance of 66.30 feet; running
thence North for a distance of 2646.66 feet; running thence
East for a distance of 653.20 feet to a brass monument in Wolf
Road; running thence South to the point of beginning; and
Apartment project located in the C. A. Goelz Prospect Gardens,
being a subdivision of the West Half G) of the West Half G)
of the Southeast Quarter CD, together with the East two/thirds
(2/3) of the North three-quarters (3/4) of the Northeast
Quarter OJ of the Southwest Quarter (1) of Section 34,
Township 42 North) Range 11. East of the Third Prin-
cipal Meridian, in Cook County, Illinois;
shall pay an additional charge of Thirty-two and 5/100 ($32.05)
Dollars per quarter as part of their vv ater bill. Said charge
shaH be terminated upon the payment of the user's share of the
cost of acquisition of the Fairview Utility facilities pursuant to
a certain agreement by and between the Village and Fairview
Utility Company, dated October 28, 1969. Any user within the
above described area may terminate his liability for such addi-
tional payments by payment in full of his share of the acquisi-
tion cost, as determined by the Village Clerk.
C. All Village users outside the corporate limits of the Village having
a direct or indirect connection with Village water mains shall pay
the following rates per quarter:
Per 1,000 gallons . . . . . . . . . . . . $2.60
Minimum Charge: $36.00 per quarter

SECTION TWO: That Article IV of Chapter 23 of the Municipal Code of the
Village of Mount Prospect of 1957, as amended, be and the same is hereby
further amended in its entirety; so that hereafter the said Article IV of
Chapter 23 shall be and read as follows:
II ARTICLE IV. SEWER RATES
SECTION 23.401. Charges for Sewer Users. All sewer users outside
of the corporate limits of the Village of Mount Prospect having a direct
or indirect connection with Village sewer mains shall pay the following
rates per month:
A. Residential Users

$ 2.50 per month.
B. Commercial and Industrial Users. . . . . . . . $ 4.00 per month.
SECTION 23.402. Billing. Bills for the above sewer charges shall be
compiled and processed quarterly as the Director of Finance shall de-
termine. Users of both water and sewer shall receive a combined bill. "
,SECTION THREE: That the billing procedures and rates set forth in SEC-
'TION ONE and SECTION TWO hereinabove shall be applied to any given user
upon the completion of the first three month billing period following the date
of the passage and approval of this Ordinance.
SECTION FOUR: That this Ordinance shall be in full force and effect as
of 12: 01 o'clock a.m., December 1,1977, and after its passage, approval,
and publication in the manner provided by law.
