WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduit
a public hearing under Case No. 43-Z-77, Case No. 44-SU-77, and Case No.
45-V-77, on the 22nd of September, 1977, on a request to vacate Rammer
A venue, a portion of Evanston Avenue, and the public alley between Rammer
and Evanston A venues; and

AN ORDINANCE VACATING RalYIr.IER AVENUE,
A PORTION OF EVANSTON AVENUE, AND THE PUBLIC
ALLEY BETWEEN RAMMER AND EVANSTON
WHEREAS, a notice of the aforesaid public hearing was made and published
in the manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has
recommended to the President and Board of Trustees of the Village of Mount
Prospect that the petitioner's request under said Case No. 43-Z-77, Case No.
44-SU-77, and Case No. 45-V-77 be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect has reviewed the matter herein and has unanimously re-
commended the approval thereof to the President and Board of Trustees
of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have determined that the best interests of the Village of Mount
Prospect will be attained by the adoption of the following Ordinance re-
garding the subject property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to the authority vested in the President and Boar
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois and other authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Section 11-91-1 of the Illinois
Municipal Code, the following described public rights of way: Rammer A venue
between Northwest Highway and Isabella Street; the alley between Rammer
Avenue and Evanston Avenue; and Evanston Avenue between Isabella and
a line 35 feet South of and parallel to Isabella Street be and the same be here-
by vacated, which vacation is legally described as:
All that part of Rammer Avenue which lies northerly of a line
drawn from the southeasterly of the southeasterly corner of
Lot 8 in H. Roy Berry Company's Northwest Heights, herein-
after described to the southwesterly corner of Lot 9 and
which lies south of a line drawn from the northeast corner of
said Lot 8 to the northwest corner of Lot 54; also vacating that
part of Evanston Avenue being the north 35.0 feet of said street
which lies south of and adjoining a line drawn from the north-
west corner of Lot 38 to the northeast corner of Lot 43 also vacat-
ing all that part of the 20.0 foot alley which lies easterly of a line
drawn from the northwesterly corner of said Lot 9 to the south-
westerly corner of said Lot 54 and which lies westerly of a line
drawn from the most northerly northeast corner of Lot 14 to the
southeast corner of Lot 42, all in H. Roy Berry Company's North-
west Heights, being a subdivision of all that land lying north of
the ChicaCYo and Northwestern Railroad in the northwest 1/4 of

the southeast 1/4 of Section 33, Township 42 North, Range 11
East of the Third Principal Meridian, in Cook County, Illinois.

I~ECTION TWO: That the Village shall retain an easement for public utilities,

That part of Evanston Avenue being the north 35.0 feet of said
street which lies south of and adjoining a line drawn from the
northwest corner of Lot 38 to the northeast corner of Lot 43 in
H. Roy Berry Company's Northwest Heights, being a subdivision'
of all that land lying north of the Chicago and Northwestern
Railroad in the northwest 1/4 of the southeast 1/4 of Section 33,
Township 42 North, Range 11 East of the Third Principal Meri-
II dian. in Cook County. I1Iinois.
ECTION THREE: That the Village Clerk of the Village of Mount Prospect is
ereby directed to file in the Office of the Recorder of Deeds and/or the Regis-
rar of Titles of Cook County, Illinois, a certified copy of this Ordinance, to-
ether with an accurate ITlap of the territory vacated, attached hereto and here-
y made a part hereof as Exhibit I.
