II WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did con- i duct a public hearing under Case No. 48-V-77, on the 22nd day of Septembel~, i 1977, on a request to have a drive-in facility variation in a B-3 (Business- i Retail Service District) of certain property hereinafter described; and i i WHEREAS, a notice of the aforesaid public hearing was made and published in the i manner provided by law; and i I i WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has re- I commended to the President and Board of Trustees of the Village of Mount Pros- I II pect that the petitioner's request under said Case No. 48-V-77 be granted; andj , II II WHEREAS, the Building Committee of the Board of Trustees of the Village of I I i Mount Prospect has reviewed the matter herein and has recommended the approval i I t thereof to the President and Board of Trustees of the Village of Mount Prospect; and I!II WHEREAS, the President ancLBoard of Trustees of the Village of Mount Prospect I have determined that the bestinte_~_~ts of the Village of Mount Prospect will be II-attained by the adoption of the following Ordinance regarding the subject i I property; I NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEE~ ' ! II OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:- ~' 1'1 SECTION ONE: That the property being the subject matter of Ca~e No. 48-V-77, :/ being legally described as follows: II Lot 3 in Elmhurst Road Plaza, a subdivision of the East 20 acres of the Ii Northeast 1/4 of the Southeast 1/4 of Section 23, Township 41 north, I Range 11, east of the Third Principal Meridian (except the North Ii 760.96 feet thereof as measured along the west and east lines of il said East 20 acres; also except the East 50 feet thereof used for [I Elmhurst Road) in Cook County, Illinois. :i III is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business-Retail Service District) , which zoning classification shall remain in effect subject to the variation granted herein: I I I I i I I i I i II II Ii II I[ !i !I II ii --.;.1 A. That, pursuant to the plans attached hereto and hereby made a part hereof as Exhibit I, the construction of a Wendy's Hamburger Restaurant on the subject property may proceed to include a cus- tomer pick-up window through which food stuffs may be purveyed. B . That this variation shall not run with the land, but inure to the benefit of the Wendy's International and Interpoint Corporation while the latter is the exclusive franchisee of Wendy's Interna- tional in this area -- thereafter the use variation shall cease to be operative. i I SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variation noted in SECTION ONE heretofore I mentioned. I II Ii I I II I I I I , i SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variations hereinbefore mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be nUlllli1.d void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
