ORDINANCE NO. 2754
AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR
PROPERTY LOCATED AT THE 'SOUTHWEST CORNER
OF RAND ROAD AND HENRY STREET, MOUNT PROSPECT. ILLINOIS
WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect
did meet on the 25th day of August, 1977. and the 27th day of October,
1977, at the hour of 8: 00 p.m., at the Public Safety Building, 112 East
'Northwest Highway, and did hear Case No. 35- V -77, pursuant to
I proper legal notice; and

I WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect
II did hear this request to permit two (2) uses instead of one (1) main
use upon the subject property, to allow a building set back of 20 feet
instead of 30 feet. and to permit parking and a free standing sign with-
in said 20 feet; and
WHEREAS. the Zoning' Board of Appeals of the Village of Mount Prospect
did recommend to the President and Board of Trustees of the Village of
,Mount Prospect the approvalo~_t~~s request under Case No. 35-V-77; and

WHEREAS. the Building Committee of the Board of Trustees of the Village
10f Mount Prospect has reviewed the matter herein and has recommended
approval thereof to the President and Board of Trustees of the Village of
Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have revie-wed the matter herein and. have determined that the
same is in the best interests of the Village of Mount Prospect;

I NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY. ILLINOIS:
SECTION ONE That the property being the subject matter of Case No. 35-V-77,
I being legally described as follows:
I Lot 1 in Block 2 in Frank Serafine's 3rd addition, a subdivision of
I the Southwest Quarter of Section 35, Township 42 North, Rang'e 11,
I East of the Third Principal Meridian, in Cook County, Illinois.
is currently zoned under the Zoning Ordinance of the Village of Mount
I Prosect as B-3 ((Business-Retail and Service) District, which zoning
I classification shall remain in effect subject to the variations grantnd herein:
'I (a) That one (1) main building containing two (2) uses be
I allowed to be constructed upon the subject property;

(b) That the front yard adjacent to Albert Street and Henry

,I SECTION TWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except the variations noted in SECTION ONE
I' heretofore mentioned.

Street of the subject parcel be reduced to twenty feet (20')--
pursuant to that plan Site Plan attached hereto and hereby
made a part hereof as Exhibit I; and
(c)
That the front yard requirements of the Zoning Ordinance
of the Village of Mount Prospect be altered to permit
parking spaces and driveways withil1 same.
SECTION THREE: That the Director of Building and Zoning of the Village of
l\1ount Prospect is hereby authorized to issue a building permit for con-
struction in accordance with the variations hereinbefore mentioned.
, SECTION FOUR: That the variations granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless an application
I for a building permit pursuant to such variations is made and construction
,I, commenced within one (1) year of the date this said Ordinance becomes
effective.
II SECTION FIVE: That this Ordinance shall be in full force and effect from
