E. 1 reading of AN ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) (EXHIBIT A)
This ordinance deletes one (1) Class “C-1” liquor license issued to Dominick’s
Finer Foods, 1145 Mt. Prospect Plaza. Dominick’s Finer Foods at this location has
permanently closed.

A. 1 reading of AN ORDINANCE TO GRANT A VARIATION FOR PROPERTY
COMMONLY KNOWN AS 222 SOUTH EDWARD STREET
This ordinance grants a variation to construct an unenclosed porch and entryway
and create a sixteen foot (16’) and fourteen foot (14’) respectively exterior side
yard setback. The Planning and Zoning Commission has recommended approval
(Withdrawn per the Petitioner’s request.)
by a vote of 6-0.
XI. NEW BUSINESS
A. PZ-44-05, PUBLIC HEARING – ANNEXATION AGREEMENT – NORTHEAST
CORNER OF ALGONQUIN AND LINNEMAN ROADS/OPUS BRIARWOOD, LLC.
A public hearing, called pursuant to due and proper legal notice have been published in
the Daily Herald on January 23, 2006, relative to a proposed Annexation Agreement

for the property located at the northeast corner of Algonquin and Linneman Roads
B. PZ-44-05 NORTHEAST CORNER OF ALGONQUIN AND LINNEMAN ROADS/OPUS
BRIARWOOD LLC.
Requests the Village take the following actions on the subject property:
1. RESOLUTION AUTHORIZING THE EXECUTION OF AN ANNEXATION (EXHIBIT E)
AGREEMENT
This agreement, requiring a 2/3 vote of the Corporate Authorities, authorizes
the Village to enter into an Annexation Agreement with Opus Briarwood, LLC
for the property located at the northeast corner of Algonquin and Linneman
Roads.

2. 1 reading of AN ORDINANCE ANNEXING THE NORTHEAST CORNER OF (EXHIBIT F)
ALGONQUIN AND LINNEMAN ROADS INTO THE VILLAGE OF MOUNT
PROSPECT.
This ordinance authorizes the Village of Mount Prospect to annex territory
located at the northeast corner of Algonquin and Linneman Roads, all pursuant
to the provisions of 65 ILCS 5/11-15-1-1.

3. 1 reading of AN ORDINANCE APPROVING A MAP AMENDMENT FROM (EXHIBIT G)
THE RX SINGLE FAMILY RESIDENCE DISTRICT TO THE I-1 LIMITED
INDUSTRIAL DISTRICT FOR THE ANNEXED PROPERTY AT THE
NORTHEAST CORNER OF ALGONQUIN AND LINNEMAN ROADS.
This ordinance amends Chapter 14 of the Village Code, commonly known
as the Village of Mount Prospect Zoning Ordinance, so as to rezone the
annexed property at the Northeast Corner of Algonquin and Linneman Roads.
The Planning and Zoning Commission has recommended approval of
these items by a vote of 6-0.

4. 1 reading of AN ORDINANCE GRANTING APPROVAL OF THE (EXHIBIT H)
FOLLOWING VARIATIONS FOR THE ANNEXED PROPERTY AT THE
NORTHEAST CORNER OF ALGONQUIN AND LINNEMAN ROADS.
a) Height: A variation from Section 14.2104(C) of the Zoning Code, increasing
the maximum height from 30 feet to 39 feet; and b) Transitional Setback:
a variation from Section 14.2104(E) of the Zoning Code to permit a ten foot
(10’) side yard setback for a drive aisle along the east property lot line and to
allow landscaping as shown on the landscape plan. The Planning and Zoning
Commission has recommended approval of these items by a vote of 6-0.
5. A RESOLUTION APPROVING A FINAL PLAT OF SUBDIVISION FOR THE (EXHIBIT I)
ANNEXED PROPERTY AT THE NORTHEAST CORNER OF ALGONQUIN
AND LINNEMAN ROADS
This resolution authorizes the Village of Mount Prospect to approve a
Final Plat of Subdivision for the annexed property at the northeast corner
of Algonquin and Linneman Roads. Pursuant to Section 15-304 of the
Mount Prospect Village Code, and that, pursuant to its home rule powers,
said approval shall also approve the Final Plat as the Preliminary Plat. The
Planning and Zoning Commission has recommended approval of these
items by a vote of 6-0.
6. A RESOLUTION IN SUPPORT OF OPUS BRIARWOOD, LLC MAKING (EXHIBIT J)
APPLICATION FOR COOK COUNTY CLASS 6B TAX ABATEMENT FOR
601 DEMPSTER STREET, MOUNT PROSPECT, ILLINOIS
This resolution authorizes the Mayor and Village Board of Trustees of the
Village of Mount Prospect to support and consent to the application of
Opus Briarwood, LLC, for a Class 6B Property Classification for property
located at 601 Dempster Street.
7. A RESOLUTION IN SUPPORT OF OPUS BRIARWOOD, LLC MAKING (EXHIBIT K)
APPLICATION FOR COOK COUNTY CLASS 6B TAX ABATEMENT FOR
1400 ALGONQUIN ROAD, MOUNT PROSPECT, ILLINOIS
This resolution authorizes the Mayor and Village Board of Trustees of the
Village of Mount Prospect to support and consent to the application of
Opus Briarwood, LLC, for a Class 6B Property Classification for property
located at 1400 Algonquin Road.
C. PUBLIC HEARING TO CONSIDER CERTAIN PROPOSED AMENDMENTS TO
THE DOWNTOWN TAX INCREMENT FINANCING (TIF) DEVELOPMENT PLAN
AND PROJECT AREA
This public hearing, called pursuant to due and proper legal notice having been
Published in the Daily Herald on January 18, and 21, 2006 is to consider the
amendment of the Downtown TIF No. 1 Redevelopment Plan (the “Redevelopment Plan”)
and the amendment of that Redevelopment Project Area known as the Downtown
TIF No. 1 Redevelopment Project Area (the Redevelopment Project Area”).
D. PZ-01-06, Text Amendment, Chapter 14, Village of Mount Prospect (EXHIBIT L)

1 reading of AN ORDINANCE AMENDING CHAPTER 14 OF THE VILLAGE
CODE This ordinance amends Section 14.314 “Outdoor Lighting” to require
the use of flat lens for all lighting fixtures and wall pack lights must be full
cut-off and fully shielded. The Planning and Zoning Commission has
recommended approval by a vote of 6-0.
E. PZ-02-06, Text Amendment, Chapter 14, Village of Mount Prospect (EXHIBIT M)

1 reading of AN ORDINANCE AMENDING CHAPTER 14 OF THE VILLAGE
CODE This ordinance amends Sections 14.803 “Conditional Uses (R-X
Single Family Residence District)”, Section 14.903 “Conditional Uses (R-1
Single Family Residence District)”, Section 14.1003 “Conditional Uses (R-A
Attached-Single Family Residence District), Section 14.1103 “Conditional Uses
(R-2 Attached-Single Family Residence District)” and Section 14.2215 “Driveways.
The Planning and Zoning Commission has recommended approval by a vote
of 6-0.

F. A RESOLUTION AUTHORIZING THE PUBLIC WORKS FORESTRY ASSISTANT (EXHIBIT N)

TO PURCHASE ILLINOIS MUNICIPAL RETIREMENT FUND (IMRF) SERVICE
CREDITS FOR CREDITABLE SERVICE EARNED WHILE ON UNPAID FAMILY
MEDICAL LEAVE IN NOVEMBER 2005
The Village will have to pay IMRF the additional service credit contributions of $493.59
for November; the Village would have been required to make the same contribution
had the employee worked the month of November.
