HomeMy WebLinkAboutOrd 5522 12/06/2005 ORDINANCE NO. 5522 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1705 VERDE DRIVE Passed and approved by the President and Board of Trustees the 6th day of December, 2005 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 7th day of December, 2005 jc 11/29/05 mla 11/29/05 ORDINANCE NO. 5522 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1705 VERDE DRIVE WHEREAS, Mark and Marlene Neuhalfen ("Petitioners") have filed a petition for a Variation with respect to property located at 1705 Verde Drive ("Subject Property") and legally described as follows: Lot 3 in Block 5 in Hatlen Heights Unit No. One, a subdivision in the south % of the Northeast ~ of section 10, Township 41 North, Range 11, East of the Third Principal Meridian, according to Plat thereof registered in the office of the Registrar of Title of Cook County, Illinois, on August 17,1955 as Document Number 1614665. Property Index Number: 08-10-212-012-0000; and WHEREAS, the Petitioner seeks a Variation to 1) construct an unenclosed porch and create a twenty-two foot and eight inch (22'8") front setback, and 2) construct a second story addition with a twenty-seven foot and eight inch (27' 8") front setback; as shown on the attached Exhibit "A"; and WHEREAS, a Public Hearing was held on the request for a Variation being the subject of PZ-41-05 before the Planning and Zoning Commission of the Village of Mount Prospect on the 10th day of November, 2005, pursuant to proper legal notice having been published in the Mount Prospect Journal & Topics on the 26th day of October, 2005; and WHEREAS, the Planning and Zoning Commission has submitted its findings and positive recommendation, subject to the porch remaining unenclosed, to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request and have determined that it meets the standards of the Village and that granting the proposed Variation would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BYTHE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: 1705 Verde Drive Page 2/2 SECTION ONE: The above recitals are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Variation, as provided in Section 14.203.C.7 of the Village Code, to 1) allow construction of an unenclosed porch, subject to the porch remaining unenclosed, and create a twenty-two foot and eight inch (22'8") front setback and 2) allow construction of a second story addition with a twenty- seven foot and eight inch (27'8") front setback, as shown on the site plan, which shall be constructed in accordance with Exhibit "A". SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
