AN ORDINANCE GRANTING EXCEPTIONS TO THE DEVELOPMENT CODE
(CHAPTER 15) (SUBDIVISION, DEVELOPMENT AND SITE IMPROVEMENT PROCEDURES)
FOR PROPERTY LOCATED AT 309 WESTGATE ROAD
WHEREAS, Witold and Barbara Skowron ("Petitioners") are the owners of the property located at
309 Westgate Road ("Subject Property") and legally described as follows:
PROPERTY INDEX NUMBER: 03-35-401-061
BEING A RESUBDIVISION IN THE NORTHEAST QUARTER OF THE SOUTHWEST
QUARTER OF SECTION 35, TOWNSHIP 42 NORTH, RANGE 11, EAST OF THE
THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS
and
WHEREAS, the Petitioners have requested exceptions from Section 15.305.B.6 of Chapter 15,
entitled Subdivision, Development and Site Improvement Procedures (the "Development Code"), of
the Village Code of the Village of Mount Prospect to allow lot depths of 253.79 feet for Lot 1 and Lot
2 on the Subject Property, rather than the required 206.7 feet (the "Development Code Exceptions");
and
WHEREAS, the Planning and Zoning Commission of the Village of Mount Prospect conducted a
public hearing on the request for the Development Code Exceptions, being the subject of PZ 37-05,
which hearing was held on the 10th of November, 2005, pursuant to proper legal notice published in
the Mount Prospect Journal & Topics on the 26th of October, 2005; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and positive
recommendations to the President and Board of Trustees of the Village of Mount Prospect, which
hereby adopt those findings and recommendations; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given
consideration to the request for the Development Code Exceptions and have determined that it
meets the standards of the Village and that granting the proposed Development Code Exceptions
would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE
OF THEIR HOME RULE POWERS:
SECTION ONE: That the above recitals are incorporated as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby
grant the Development Code Exceptions from Section 15.305.B.6 of the Village Code to allow
minimum lot depths of 253.79 feet for Lot 1 and Lot 2 of the Subject Property, as shown on the plat
of resubdivision, a copy of which is attached as Exhibit "A," rather than the required 206.7 feet.

SECTION THREE: Except for the modifications granted herein, all other requirements of said
Development Code shall apply to the Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.
