The Planning & Zoning Commission transmits their recommendation to approve Case PZ-37-05, a request for 1)
a plat of resubdivision to create 2- lots of record from one lot, and 2) a Development Code exception for the
depth-to-width ratio, as described in detail in the attached staffreport. The Planning & Zoning Commission heard
the request at their November 10, 2005 meeting.
The Subject Property is located on the east side of Westgate Road, between Cardinal and Wildwood Lanes, and
contains a single-family residence with related improvements. The Petitioner would like to demolish the existing
residence and resubdivide the Subject Property to create a two-lot subdivision. The Subject Property is zoned Rl
Single Family Residence and is bordered on all sides by the Rl District. The proposed lots would exceed the R1
minimum lot size requirements, and the homes would meet the applicable zoning regulations. However, due to
the manner in which the surrounding lots were developed, the proposed lots would exceed the depth-to-width
ratio (2 Yz : 1) listed in the Subdivision & Development Code. Therefore, in addition to approval for the proposed
resubdivision, the Petitioner is seeking approval for a Development Code exception.
The Planning & Zoning Commission discussed the request at its November meeting. The Commission stated that
the Petitioner's request was in keeping with the development trend in the area and that the proposed lot sizes
would exceed the minimum size required by the Village Code. The Commission also noted that the neighborhood
would benefit from the storm water detention system the Petitioner is required to install as part of redevelopment
of the site.
The Planning & Zoning Commission voted 5-0 to recommend that the Village Board approve 1) the Plat of
Resubdivision that creates 2-10ts of record, and 2) the Development Code exception to allow a deeper lot depth
than is permitted by the Village Code, for the residence at 309 Westgate Road, Case No. PZ-37-05.
Please forward this memorandum and attachments to the Village Board for their review and consideration at their
December 6, 2005 meeting. Staff will be present to answer any questions related to this matter.

Acting Chairman Richard Rogers called the meeting to order at 7:32 p.m. Keith Youngquist moved to approve
the minutes, of the October 27, 2005 meeting and Joseph Donnelly seconded the motion. The motion was
approved 4-0, with Leo Floros abstaining. At 7:34 pm, Acting Chairman Rogers introduced Case No. PZ-37-05,
a Resubdivision Plat and Development Code. He said that the case is Village Board final and that the
Commission will make a recommending vote tonight.
Judy Connolly, Senior Planner, summarized the case. The Subject Property is located on the east side of
Westgate Road, between Cardinal and Wildwood Lanes, and contains a single-family residence with related
improvements. The Subject Property is zoned Rl Single Family Residence and is bordered on all sides by the RI
District.
Ms. Connolly said the Petitioner would like to demolish the existing residence and resubdivide the Subject
Property to create a two-lot subdivision. The Rl zoning district requires a minimum lot size of 8,125 square feet
and the proposed lots would each measure 10,491.6 square feet, which exceeds the RI minimum lot size
requirements. The proposed homes would meet the applicable zoning regulations. However, due to the manner
in which the surrounding lots were developed, the large lot size, and the Petitioner seeking to meet Village Codes
regulations, the proposed lots would exceed the depth-to-width ratio requirement listed in the Subdivision &
Development Code.
Ms. Connolly stated that the table in the Staff Report lists the bulk regulations for the Rl zoning district and lists
the current setbacks. The Petitioner has not finalized the design of the proposed houses, but understands the new
structures must comply with all Village Code requirements. The Village's Comprehensive Plan and Land Use

Map designate the Subject Property as Single Family Residence. The Petitioner's proposed Resubdivision is in
keeping with the Village's designation.
Ms. Connolly noted the Engineering Division had no objections to the resubdivision or Development Code
exception. They found that the plat was prepared in accordance with Village Codes. The Petitioner is required to
provide storm water detention as the Development Code requires detention when two or more lots are created.
Also, Staff found that the proposed plat is in keeping with current development trends for this neighborhood and
the size of the proposed lots would be consistent with other properties in this area.
Ms. Connolly reiterated that the Petitioner seeks to create two lots of record by subdividing the Subject Property.
The proposed plat is part of PZ-37-05, a Resubdivision request and Development Code Exception request. The
plat was prepared in accordance with the Development Code requirements, but the Petitioner is seeking relief
from the Development Code regulations for the lot depth-to-width ratio. She said the Development Code permits
the Planning & Zoning Commission to recommend approval of exceptions to Development Code regulations in
cases of hardship, "caused by conditions uniquely attributable to the land under consideration, would be imposed
upon an applicant by compliance with these regulations and upon a finding that there are alternate feasible means
of fulfilling the purpose and spirit of the regulations to protect the public health, safety and welfare..."
Ms. Connolly said the request must meet the standards for an exception, which are listed in Sec. 15.109. She
summarized the standards and noted that the Subject Property measures slightly less than one-acre in size and the
proposed lots will exceed the minimum requirements of the Rl zoning district. Due to the manner in which the
adjacent properties were subdivided, as well as the Village's policy of requiring direct access onto each lot of
record, the Petitioner has designed the two-lot subdivision in a manner that exceeds the 2 Yz: 1 depth-to-width
ratio required by the Development Code. The 2 Yz: 1 ratio required by Village Code dictates a lot depth of no
more than 206.7' and the Petitioner proposes a 253.79' lot depth. The increased lot depth for the properties is a
result of the manner in which the properties were originally subdivided. The neighborhood is developed and the
proposed lot depth is consistent with the other properties on the block. In addition, the 'extra' depth will be used
to accommodate the required storm water detention. The proposed lot depths would not have a detrimental
impact on the public health, safety or general welfare. The increased lot depth would not adversely affect the
character of the surrounding neighborhood, or utility provision and it would be in compliance with the Village's
Comprehensive Plan and Zoning Ordinance.
Ms. Connolly said, based on these findings, Staff recommends that the Planning & Zoning Commission approve
the following motion:
"To approve the 309 Westgate Resubdivision and Development Code exception to allow a 2-lot subdivision, with
lots measuring 82.68' x 253.79' each, as shown on the Petitioner's plat ofresubdivision for 309 Westgate Road,
Case No. PZ-37-05."
Acting Chairman Rogers requested clarification on the minimum lot width for an Rl lot. Ms. Connolly replied
that the minimum requirement is 65 feet. There were no further questions from the commission.
Jason Doland of W.C. Doland Engineering, Inc 509 East Dundee Rd, Palatine, IL was sworn in. He thanked staff
for more than adequate presentation. He wanted to emphasize that the subdivision of this lot will actually
improve drainage in the neighborhood and will provide a net benefit to the area. There were no further questions
for Mr. Doland.
Thomas and Witold Skowron, 659 Debra Lane, Des Plaines, IL were sworn in. The Skowrons said they own the
property at 309 Westgate Rd and thanked staff and engineering for the presentation. They said that they intend to
build a single family, bi-level home approximately 3800 sq ft. for their family on one of the lots. There were no
further questions for the Petitioner.

Acting Chairman Rogers called for further questions, hearing none; the public hearing was closed at 7:42 pm.
Keith Youngquist made a motion to approve the proposed resubdivision and Development Code exception
request as submitted by the Petitioner for the property at 309 Westgate, Case No. PZ-37-05. Joseph Donnelly
seconded the motion

BACKGROUND
A public hearing has been scheduled for the November 10, 2005 Planning & Zoning Commission meeting to
review the application by Witold & Barbara Skowron (the "Petitioner") regarding the property located at 309
Westgate Road (the "Subject Property"). The Petitioner is seeking approval of a plat of resubdivision that creates
2-lots of record from one lot. As part of the request, the Petitioner is seeking approval of a Development Code
exception for the lot/depth ratio. As required by the ViII age Code, Staff posted a Public Hearing sign on the
Subject Property.
PROPERTY DESCRIPTION
The Subject Property is located on the east side of Westgate Road, between Cardinal and Wildwood Lanes, and
contains a single-family residence with related improvements. The Subject Property is zoned RI Single Family
Residence and is bordered on all sides by the R 1 District.
SUMMARY OF PROPOSAL
The Petitioner would like to demolish the existing residence and resubdivide the Subject Property to create a two-
lot subdivision. The R 1 zoning district requires a minimum lot size of 8,125 square feet and the proposed lots
would each measure 10,491.6 square feet (82.68' x 253.79' each). The proposed lots would exceed the RI
minimum lot size requirements, and the homes would meet the applicable zoning regulations. However, due to
the manner in which the surrounding lots were developed, the large lot size, and the Petitioner seeking to meet
Village Codes regulations, the proposed lots would exceed the depth-to-width ratio (2 y; : 1) listed in the
Subdivision & Development Code (Sec. 15.305.B.6).
GENERAL ZONING COMPLIANCE
As previously noted, the proposed lots would exceed the minimum RI lot size requirement and the houses would
comply with the RI Bulk Regulations. The table on the following page provides the bulk regulations for the RI
zoning district and lists the current setbacks. The Petitioner has not finalized the design of the proposed houses,
but understands the new structures must comply with all ViIIage Code requirements.

PLAT OF RESUBDIVISION
The Petitioner seeks to create two lots ofrecord by subdividing the Subject Property. The proposed plat is part of
PZ-37-05, a Resubdivision request and Development Code Exception request. The plat was prepared in
accordance with the Development Code requirements, but the Petitioner is seeking relief from the Development
Code regulations for the lot depth-to-width ratio.
DEVELOPMENT CODE EXCEPTION STANDARDS
Sec. 15.109 permits the Planning & Zoning Commission to recommend approval of exceptions to Development
Code regulations in cases of hardship, "caused by conditions uniquely attributable to the land under consideration,
would be imposed upon an applicant by compliance with these regulations and upon a finding that there are
alternate feasible means of fulfilling the purpose and spirit of the regulations to protect the public health, safety
and welfare...". The request must meet the standards for an exception, which are listed in Sec. 15.109 and are
summarized as follows:
. A hardship due to the physical surroundings, shape, or topographical conditions of a specific property not
generally applicable to other properties in the same zoning district and not created by any person
presently having an interest in the property;
. Lack of desire to increase financial gain; and
. Protection of the public welfare, other property, and neighborhood character.
The Subject Property measures slightly less than one-acre in size and the proposed lots will exceed the minimum
requirements of the R 1 zoning district. Due to the manner in which the adjacent properties were subdivided, as
well as the Village's policy of requiring direct access onto each lot of record, the Petitioner has designed the two-

Jot subdivision in a manner that exceeds the 2 112: 1 depth-to-width ratio required by the Development Code. The
following table summarizes the Village's requirements and the Petitioner's proposed lot depths.

Development Code. Based on these findings, Staff recommends that the Planning & Zoning Commission
approve the following motion:
"To approve the 309 Westgate Resubdivision and Development Code exception to allow a 2-10t subdivision, with
lots measuring 82.68' x 253.79' each, as shown on the Petitioner's plat of resubdivision for 309 Westgate Road,
Case No. PZ-37-05."
The Village Board's decision is final for this case.

AN ORDINANCE GRANTING EXCEPTIONS TO THE DEVELOPMENT CODE
(CHAPTER 15) (SUBDIVISION, DEVELOPMENT AND SITE IMPROVEMENT PROCEDURES)
FOR PROPERTY LOCATED AT 309 WESTGATE ROAD
WHEREAS, Witold and Barbara Skowron ("Petitioners") are the owners of the property located at
309 Westgate Road ("Subject Property") and legally described as follows:

BEING A RESUBDIVISION IN THE NORTHEAST QUARTER OF THE SOUTHWEST
QUARTER OF SECTION 35, TOWNSHIP 42 NORTH, RANGE 11, EAST OF THE
THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS
and
WHEREAS, the Petitioners have requested exceptions from Section 15.305. B.6 of Chapter 15,
entitled Subdivision, Development and Site Improvement Procedures (the "Development Code"), of
the Village Code of the Village of Mount Prospect to allow lot depths of 253.79 feet for Lot 1 and Lot
2 on the Subject Property, rather than the required 206.7 feet (the "Development Code Exceptions");
and
WHEREAS, the Planning and Zoning Commission of the Village of Mount Prospect conducted a
public hearing on the request for the Development Code Exceptions, being the subject of PZ 37-05,
which hearing was held on the 10th of November, 2005, pursuant to proper legal notice published in
the Mount Prospect Journal & Topics on the 26th of October, 2005; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and positive
recommendations to the President and Board of Trustees of the Village of Mount Prospect, which
hereby adopt those findings and recommendations; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given
consideration to the request for the Development Code Exceptions and have determined that it
meets the standards of the Village and that granting the proposed Development Code Exceptions
would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE
OF THEIR HOME RULE POWERS:
SECTION ONE: That the above recitals are incorporated as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby
grant the Development Code Exceptions from Section 15.305.B.6 of the Village Code to allow
minimum lot depths of 253.79 feet for Lot 1 and Lot 2 of the Subject Property, as shown on the plat
of resubdivision, a copy of which is attached as Exhibit "A," rather than the required 206.7 feet.

The Planning & Zoning Commission transmits their recommendation to approve Case PZ-4l-05, a request to
construct an unenclosed porch and second story addition in the front yard, as described in detail in the attached
staff report. The Planning & Zoning Commission heard the request at their November 10,2005 meeting.
The Subject Property is located on the east side of Verde Drive, south of Bonita Avenue, and contains a single-
family residence with related improvements. The existing home is currently set back 27'8" from the front lot line,
12'11" and 10'6" from each interior lot line, and approximately 86' from the rear lot line. The Petitioner's
proposed improvements to the existing home include adding a second story addition and an unenclosed porch in
the front yard. The existing house already encroaches into the required 30' front yard, with a setback of 27'8"
feet. Therefore, the Petitioner is seeking Variations to add onto the house and have a 22' 8" setback for the
unenclosed porch and a 27'8" setback for portions of the second story addition.
The Planning & Zoning Commission discussed the request at their November meeting. The Commission stated
that the Petitioner's hardship resulted from the house being built over the lot line. It was noted that most of the
second story addition complied with the required 30-foot setback, and that only a portion of the addition
encroached into the required setback. The proposed encroachments were compared to bay windows, used to
break-up the mass of the addition and blend the addition and the proposed porch to the existing house. There was
discussion that a 2'8" unenclosed porch would meet the criteria for a Conditional Use because a 25-foot setback
would be maintained. However, several Commissioners and the Petitioner said that the size of the permitted
porch was not functional and limited the Petitioner's ability to use the porch due to its shallow depth.
The Planning & Zoning Commission voted 5-0 to recommend that the Village Board approve 1) the Variation
request to construct an unenclosed porch and create a 22'8" front setback and 2) the Variation request to construct
a second story addition with a 27'8" front setback as shown on the Petitioner's exhibits, subject to the porch
remaining unenclosed for the residence at 1705 Verde Drive, Case No. PZ-41-05.
Please forward this memorandum and attachments to the Village Board for their review and consideration at their
December 6, 2005 meeting. Staff will be present ~ ler any questions related to this matter.

Acting Chairman Richard Rogers called the meeting to order at 7:32 p.m. Keith Youngquist moved to approve
the minutes, of the October 27, 2005 meeting and Joseph Donnelly seconded the motion. The motion was
approved 4-0, with Leo Floros abstaining. At 7:43 pm, Acting Chairman Rogers introduced Case No. PZ-41-05,
a request for Variation for the front yard setback. He said that the case is Village Board final and the Commission
will make a recommending vote tonight.
Judy Connolly, Senior Planner, summarized the case. The Subject Property is located on the east side of Verde
Drive, south of Bonita Avenue, and contains a single-family residence with related improvements. The Subject
Property is zoned R1 Single Family Residence and is bordered on all sides by the R1 District. The Subject
Property has an irregular shape as the front of the lot measures 62-feet wide, but the rear of the lot measures 80-
feet wide. In addition, the lot depth varies, with the southern lot line measuring 23-feet longer than the northern
lot line. The existing home is currently setback 27'8" from the front lot line, 12'11" and 10'6" from the interior
lot lines, and approximately 86' from the rear lot line.
Ms. Connolly said the Petitioner's proposed improvements to the existing home include a second story addition
and an unenclosed porch. The proposed porch would extend 5-feet from the existing house, resulting in a 22'8"
setback. The proposed unenclosed porch request requires a Variation because the front yard will be less than 25-
feet, which is the minimum yard required as a condition of the Conditional Use approval process. In addition, the
Petitioner's plans call for the second story addition to continue the existing nonconforming front setback, 27'8".
This aspect of the project also requires a Variation because the Zoning Ordinance requires that new construction
comply with the current front yard setback of 30-feet.

Ms. Connolly said the existing home does not comply with the Village's zoning regulations because the house
encroaches into the required front yard. However, the existing structure is a legal nonconformity and is allowed
to remain in its current locations. The proposed unenclosed porch and second story addition require relief from
the Rl District's bulk regulations for the front yard setback. The project would be constructed according to all
applicable Village Codes. The table in the Staff Report compares the Petitioner's proposal to the Rl Single
Family Residence District's bulk requirements. It shows that the Subject Property would continue to be well
below the maximum lot coverage and that the only changes to the setbacks would occur in the front yard.
Ms. Connolly summarized the standards for a Variation listed in the Zoning Ordinance. She said that the Zoning
Ordinance requires a 30-foot front yard for the house. However, the existing structure does not meet this
requirement and the Petitioner would like to construct an unenclosed porch 5-feet further into the existing
nonconforming setback. Also, the proposed second story addition would maintain the existing nonconforming
setback, which is 27'8". Staff researched adjacent properties' setbacks and found that most houses in the area are
setback at least 30' from the front property line. However, there was one exception and the house has a 24' front
setback. Therefore, Staff found that the Petitioner's request would not be in keeping with the adjacent properties'
setbacks.
Ms. Connolly said the Petitioner is proposing to expand the existing home to create additional living space. After
meeting with Staff and discussing the project in great detail, the Petitioner explored different designs for the
addition. However, they determined the porch was necessary to link the addition to the existing house and that
modifying the second story addition, to meet the 30-foot setback requirement, would not be aesthetically pleasing.
Ms. Connolly said that although the lot has a somewhat odd shape, the front yard is not impacted by its
irregularities. While the proposed design is aesthetically pleasing and Staff can appreciate the Petitioner's desire
to improve their property, the request fails to meet the standards for a Variation because there is no hardship as
defined by the Zoning Ordinance. The front yard is typical of most lots in the Village, and the lot shape
irregularities effect the rear yard, not the front yard.
Based on this analysis, Staff recommends that the P&Z deny the following motion:
"To approve a Variation to allow a 22'8" front yard for an unenclosed porch and to allow a 27'8" setback for a
second story addition, as shown on the Petitioner's site plan for the residence at 1705 Verde Drive, Case No. PZ-
41-05."
Ms. Connolly said that the Village Board's decision is final for this case because the amount of the Variation
exceeds 25% of the Zoning Ordinance requirement.
Acting Chairman Rogers requested clarification on his understating of the porch request: he said historically the
Commission has allowed an unenclosed front porch up to the 25-foot setback line, and theoretically by building a
3-foot front porch versus the proposed 5-foot porch, it would be acceptable at the 25-foot setback line. Ms.
Connolly confirmed his understanding was correct.
Mark Neuhalfen of 1705 Verde Drive, Mt. Prospect, IL was sworn in. Mr. Neuhalfen said he is the Petitioner and
property owner. He presented his case with a detailed presentation. Mr. Neuhalfen stated they have been
residents of Mt. Prospect for 13 years and intend to stay in this home. They are not looking for a short-term
resolution or any financial gain. He has a young, growing family and find the need to expand the home to
accommodate their living space needs. They have considered other expansion options and the plans, as
submitted, are the ideal choice for their situation. Aside from meeting the needs of his family, Mr. Neuhalfen
indicated that this addition would add value to the home and the neighborhood. Mr. Neuhalfen stated he would be
happy to answer questions from the Commission.

Acting Chair Rogers requested information on the age of the home. It was determined that the home was
constructed in 1955 and improvements were made to the home in 1989, which was verified per the plat of survey.
Acting Chair Rogers stated that the Petitioner "inherited" the home at its current nonconforming setback and that
is disadvantageous. He stated that the Commission could approve a porch up to the 25-foot setback, however he
realizes the decreased size would make the porch less accessible. Mr. Neuhalfen acknowledged the 3-foot porch
would be easier to get approval on, but again, the decreased size would make the porch virtually unusable space.
Keith Youngquist asked the Petitioner for clarification on their decision to not proceed with a backyard addition.
Mr. Neuhalfen said that they had considered all options, but loosing yard space was not conducive to the daily
activities of the family. It is very important to the Neuhalfen Family to continue to have ample backyard space
for their children. Mr. Youngquist acknowledged his understanding of what the Petitioner is requesting.
Leo Floros asked Ms. Connolly to identify the front yard setbacks on other homes in the area. Ms. Connolly said
Staff found one other home in the immediate area that had a sub-standard setback. She explained that the
placement of the front stoop, which also encroaches in the front yard and creates to a 22-foot setback, is what may
give the impression of a shallow front yard. Ms. Connolly said the stoop is a permitted encroachment on the
property and that design is a common design for other homes in the neighborhood. Joseph Donnelly added that
the home is located on the curve of Verde Drive and that could give the appearance of a shallow front yard.
Ronald Roberts asked how far the new porch and steps would encroach into the setback. The current steps are at
a 22-foot setback and the proposed steps will be placed at a 22'8" setback. Joseph Donnelly said that the
proposed porch will actually have a decreased setback from the existing stairs. He also pointed out there may be
some discrepancy in the measurements on the plat of survey due to the curvature in the road. He further stated
that the proposed porch will not change the side view of the streetscape and there is little to no difference on how
far the proposed porch will encroach the front yard versus the existing stairs. Acting Chair Roberts acknowledged
this viewpoint.
Acting Chair Roberts called for additional questions, hearing none, the hearing was closed at 8:03 pm.
Joseph Donnelly summarized that while the Petitioner's request is not ideal, he feels that potentially inaccurate
measurements resulted in the home being built at a sub-standard setback. Ronald Roberts pointed out that there
were no other residents from the neighborhood at the meeting to object. Also, the aesthetics of the project are
appealing and add a lot of architectural interest to the neighborhood. Keith Youngquist stated that 5-foot front
yard encroachments have become a common request and that the Petitioner has done an excellent job of
architecturally presenting his proposal. The Commission concluded that they feel this is a pro-active project to
improve a single-family residence in the neighborhood.
Joseph Donnelly made a motion to approve the proposed variation of the front yard setback as submitted by the
Petitioner for the residence at 1705 Verde Drive, Case No. PZ-41-05 with the condition that the porch remains
unenclosed. Leo Floros seconded the motion.

A public hearing has been scheduled for the November 10, 2005 Planning & Zoning Commission meeting to
review the application by Mark and Marlene Neuhalfen (the "Petitioner") regarding the property located at 1705
Verde Drive (the "Subject Property"). The Petitioner is seeking a Variation to allow an unenclosed porch and
second floor addition to encroach into the required front yard. The P&Z hearing was properly noticed in the
October 26, 2005 edition of the Journal Topics Newspaper. In addition, Staff has completed the required written
notice to property owners within 250-feet and posted a Public Hearing sign on the Subject Property.

The existing home does not comply with the Village's zoning regulations because the house encroaches into the
required front yard. However, the existing structure is a legal nonconformity and is allowed to remain in its
current locations. The proposed unenclosed porch and second story addition require relief from the RI District's
PZ-41-05

bulk regulations for the front yard setback. The project would be constructed according to all applicable Village
Codes. The following table compares the Petitioner's proposal to the R1 Single Family Residence District's bulk
requirements.

VARIATION STANDARDS
The standards for a Variation are listed in Section 14.203.C.9 of the Village Zoning Ordinance and include seven
specific findings that must be made in order to approve a Variation. The following list is a summary of these
findings:
. A hardship due to the physical surroundings, shape, or topographical conditions of a specific property not
generally applicable to other properties in the same zoning district and not created by any person
presently having an interest in the property;
. Lack of desire to increase financial gain; and
. Protection of the public welfare, other property, and neighborhood character.
The Zoning Ordinance requires a 30-foot front yard for the house. However, the existing structure does not meet
this requirement and the Petitioner would like to construct an unenclosed porch 5-feet further into the existing
setback. Also, the proposed second story addition would maintain the existing 27'8" setback. Staff researched
the adjacent properties' setbacks and found that most houses are setback at least 30' from the front property line
(see attached exhibit). However, there was one house that had a 24' front setback. Therefore, the Petitioner's
request would not be in keeping with the adjacent properties' setbacks.
As detailed in the attached application, the Petitioner is proposing to expand the existing home to create additional
living space. After meeting with Staff and discussing the project in great detail, the Petitioner exp Iored different
designs for the addition. However, they determined the porch was necessary to link the addition to the existing
house and that modifying the second story addition, to meet the 30-foot setback requirement, would not be
aesthetically pleasing.
Although the lot has a somewhat odd shape, the front yard is not impacted by its irregularities. While the
proposed design is aesthetically pleasing and Staff can appreciate the Petitioner's desire to improve their property,
the request fails to meet the standards for a Variation because there is no hardship as defined by the Zoning
Ordinance. The front yard is typical of most lots in the Village, and the lot shape irregularities effect the rear
yard, not the front yard.

RECOMMENDA TION
Although the Petitioner's request to have an unenclosed porch and second story addition encroach into the front
yard may be an attractive enhancement to the house, the request does not meet the Variation standards contained
in Section 14.203.C.9 of the Zoning Ordinance. Based on this analysis, Staffrecommends that the P&Z deny the
following motion:
"To approve a Variation to allow a 22'8" front yard for an unenclosed porch and to allow a 27'8" setback for a
second story addition, as shown on the Petitioner's site plan for the residence at 1705 Verde Drive, Case No. PZ-
41-05."
The Village Board's decision is final for this case because the amount of the Variation exceeds 25% of the Zoning
Ordinance requirement.

WHEREAS, Mark and Marlene Neuhalfen ("Petitioners") have filed a petition for a Variation with
respect to property located at 1705 Verde Drive ("Subject Property") and legally described as
follows:
Lot 3 in Block 5 in Hatlen Heights Unit No. One, a subdivision in the south 'Yz
of the Northeast Xi of section 10, Township 41 North, Range 11, East of the Third
Principal Meridian, according to Plat thereof registered in the office of
the Registrar of Title of Cook County, Illinois, on August 17, 1955 as
Document Number 1614665.

and
WHEREAS, the Petitioner seeks a Variation to 1) construct an unenclosed porch and create a
twenty-two foot and eight inch (22'8") front setback, and 2) construct a second story addition with a
twenty-seven foot and eight inch (27' 8") front setback; as shown on the attached Exhibit "A"; and
WHEREAS, a Public Hearing was held on the request for a Variation being the subject of PZ-41-05
before the Planning and Zoning Commission of the Village of Mount Prospect on the 10th day of
November, 2005, pursuant to proper legal notice having been published in the Mount Prospect
Journal & Topics on the 26th day of October, 2005; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and positive

SECTION ONE: The above recitals are incorporated as findings of fact by the President and

FOR THE VillAGE OF MOUNT PROSPECT
I. A public hearing to approve a proposed property tax levy
for the Village of Mount Prospect for the fiscal year beginning
January 1, 2005 and ending December31, 2005 will be held
on December 6, 2005 at 7:00 p.m. at the Mount Prospect
Village Board Room, 50 South Emerson Street, Mount
Prospect, Illinois. Any person desiring to appear at the pub-
lic hearing and present testimony to the taxing district may

II. The corporate and special purpose property taxes extend-
ed or abated for the fiscal year beginning January 1, 2004
and ended December 31, 2004 were $16,349,527.
The proposed corporate and special purpose property taxes
to be ievied for the fiscal year beginning January 1, 2005 and
ending December 31,2005 are $17,413,698. This represents
a 6.51 % increase over the previous year.
III. The property taxes extended for debt service for the fiscal
year beginning January 1, 2004 and ended December 31,
2004 were $2,816,948.
The estimated property taxes to be levied for debt service for
the fiscal year beginning January 1, 2005 and ending
December 31, 2005 are $3,024,745. This represents a
7.38% increase over the previous year.
IV. Tile total property taxes extended or abated for the fiscal
year beginning January 1, 2004 and ended December 31,
2004 were $19,166,475.
The estimated total property taxes to be levied for the fiscal
year beginning January 1, 2005 and ending December 31,
2005 are $20,438,443. This represents a 6.64% increase
over the previous year.

PURPOSE:
To obtain approval of the attached three ordinances related to the tax levies of the Village, the Mount Prospect
Public Library, and the Village's special service area.
BACKGROUND:
Prior to December 27, 2005 the Village must have on file with the County Clerk its 2005 tax levy and abatement
ordinances. The Village will receive the proceeds from the 2005 tax levy in 2006.
The Village Board first discussed the proposed 2005 tax levy at its October 25th Committee of the Whole
meeting at which time the proposed Village levy was $12,698,307. At the November 8th Committee of the Whole
meeting, the levy was modified to account for changes in the amount allocated for the General and Refuse
Funds. The levy as presented in this ordinance is $13,020,278, an increase of 7.66% over the prior year.
The Mount Prospect Library Board approved their tax levy request at its meeting on October 20, 2005. They are
asking for a total levy, inclusive of a 2% provision for loss and cost, of$7,418, 165. This represents an increase
of 4.89% over the 2004 levy.
DISCUSSION:
The following table compares the proposed 2005 levy to the 2004 levy for the Village and Library. The amounts
presented in the table are net of abatements and are inclusive of the 2% provision for loss and cost.

A detailed spreadsheet of all proposed levies, including detailed levies and abatements for each outstanding
bond issue, is also attached.
The Village's 2004 equalized assessed valuation (EAV) was $1,491,117,145. Our 2005 EAV is estimated to
remain unchanged from the prior year. The Village's 2005 tax rate is expected to increase to $0.873 from the
2004 rate of $0.811. The Library's 2005 tax rate is estimated at $0.497, compared to the 2004 rate of $0.474.
For illustration purposes only, a home with an EAV of $86,545 (a market value of approximately $350,000) in
2005 will pay taxes of $755 to the Village of Mount Prospect and $430 to the Library for the levy extended in
2004. This represents increases of $53 and $20, respectively, over the levy extended in 2003.
Special Service Area NO.5 was created in the mid-eighties to help fund the bringing of Lake Michigan water to
the Village's water system. It is recommended the 2005 levy remain the same as the 2004 levy ($1,545,773).
The resulting tax rate is estimated to be $0.125.
The Village Board is being asked to consider three ordinances related to the 2005 tax levy. Two of the
ordinances establish the initial levy of the Village (including the Library) and the Village's special service area.
There is also one abatement ordinance that reduce a portion of the debt service tax levies established by the
various bond ordinances. The proposed ordinances reflect the numbers as presented in the proposed 2006
budget.
RECOMMENDATION:
It is recommended the Village Board approve the attached 2005 tax levy and abatement ordinances.

AN ORDINANCE AUTHORIZING THE LEVY AND COLLECTION OF TAXES FOR
THE CORPORATE AND MUNICIPAL PURPOSES OF THE VILLAGE OF MOUNT
PROSPECT FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2005 AND ENDING
DECEMBER 31, 2005
NOW, THEREFORE, BE IT ORDAINED BY THE President and Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois, as follows:
Section 1: That the sum of Twenty Million Thirty-Seven Thousand Six Hundred and
Eighty-Eight ($20,037,688), the same being the total amount to be levied of budget
appropriations heretofore made for the corporate and municipal purposes for the fiscal year
beginning January 1,2005 and ending December 31, 2005 as approved by the President and
Board of Trustees of the Village of Mount Prospect, be and the same is hereby levied on all
taxable property within the Village of Mount Prospect according to the valuation of said
property as is, or shall be assessed or equalized by the State and County purposes for the
current year 2005.
Section 2: The budgetary appropriations having been made by the President and
Board of Trustees of the Village of Mount Prospect were passed and approved by
Ordinance No. 5475 at a meeting hereof regularly convened and held in said Village of
Mount Prospect, Illinois, on the 21st day of December, 2004, and as amended by
Ordinance No. 5489 passed and approved on the ih day of June, 2005, thereafter duly
published according to law, the various objects and purposes for said budgetary
appropriations are heretofore made and set forth under the column entitled "Amount
Budgeted", and the specific amount herein levied for each object and purpose is set forth
under the column entitled "Amount Levied", in Articles I through XIII.

Section 3: The sum of $278,065 is estimated to be received from personal property
replacement tax revenue during the fiscal year commencing January 1, 2005 and ending
December 31,2005 and has been included herein as funds to be derived from sources other
than property taxes for general obligation bonds and interest, pensions, library services and
general corporate purposes.
Section 4: That the County Clerk is directed to add 2% to the requested tax levy as a
provision for loss and cost.
Section 5: That the Village Clerk of the Village of Mount Prospect is hereby directed to
certify a copy of this Ordinance and is hereby authorized and directed to file a copy of the
same with the County Clerk of Cook County, Illinois, within the time specified by law.
Section 6: That, if any part or parts of this Ordinance shall be held to be unconstitutional
or otherwise invalid, such constitutionality or invalidity, shall not affect the validity of the
remaining parts of this Ordinance. The President and Board of Trustees of the Village of
Mount Prospect hereby declares that they would have passed the remaining parts of the
Ordinance of they had known that such parts or parts thereof would be declared
unconstitutional or otherwise invalid.

NOW THEREFORE, BE IT ORDAINED BY THE President and Board of Trustees of the Village
of Mount Prospect, Cook County, Illinois:
Section 1: That the sum of One Million Five Hundred Fifteen Thousand Four Hundred Sixty-
Four Dollars ($1,515,464), the same being the total amount to be levied of budget appropriations
heretofore made for the municipal purposes for the fiscal year beginning January 1, 2005, and
ending December 31, 2005, as approved by the President and Board of Trustees of the Village of
Mount Prospect, be and the same is hereby levied on all taxable property within the Special Service
Area Number 5 of the Village of Mount Prospect according to the valuation of said property as is, or
shall be, assessed or equalized by State and County purposes for the current year 2005. The
budgetary appropriations having been made heretofore by the President and Board of Trustees of the
Village of Mount Prospect were passed and approved by Ordinance No. 5475 at a meeting hereof
regularly convened and held in said Village of Mount Prospect, Illinois on the 21 8t day of December,
2004, and as amended by Ordinance No. 5489 passed and approved on the ih day of June, 2005, and
thereafter duly published according to law, the various objects and purposes for said budgetary
appropriations were heretofore made are set forth under the column entitled "Amount Budgeted,"
and the specific amount herein levied for each object and purpose is set forth under the column
entitled "Amount Levied" in Article I.
Section 2: That the County Clerk is directed to add 2% to the requested tax levy as a provision for

JANUARY 1,2005 AND ENDING DECEMBER 31, 2005
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
Section One: The President and Board of Trustees of the Village of Mount Prospect find as
follows:
A. That pursuant to Village Ordinance No.4 780 adopted March 6, 1996 and authorizing
issuance of general obligation bonds for financing flood control capital improvement
projects within the Village there was levied for the year 2005 the sum of$213,815.00
for bond principal and interest payments.
B. That pursuant to Village Ordinance No. 4917 adopted March 18, 1998 and
authorizing issuance of general obligation bonds for financing flood control capital
improvement projects within the Village there was levied for the year 2005 the sum
of $65,345.00 for bond principal and interest payments.
C. That pursuant to Village Ordinance No. 4977 adopted December 1, 1998 and
authorizing issuance of general obligation bonds for financing land acquisition costs
and other redevelopment costs within the Village's District No.1 Tax Increment
Redevelopment Project Area there was levied for 2005 the sum of$155,675.00 for
bond principal and interest payments.
D. That pursuant to Village Ordinance No. 4999 adopted March 2, 1999 and authorizing
issuance of general obligation bonds for financing the acquisition ofland within the
Village's District No. I Tax Increment Redevelopment Project Area there was levied
for the year 2005 the sum of$839,800.00 for bond principal and interest payments.
E. That pursuant to Village Ordinance No. 5114 adopted June 6, 2000 and authorizing
issuance of general obligation bonds for financing various flood control capital
improvement projects there was levied for the year 2005 the sum of$492,228.00 for
bond principal and interest payments.
F. That pursuant to Village Ordinance No. 5301 adopted January 21, 2003 and
authorizing issuance of general obligation bonds for financing a portion of the costs
of constructing a new village hall and community center as well as a multi-level

parking deck there was levied for the year 2005 the sum of $911,708.00 for bond
principal and interest payments.
G. That as of December I, 2005 there has been collected, deposited to and on hand in
the Series 1996A General Obligation Bond and Interest Funds the sum of
$213,815.00 for application to bond principal and interest payments for the bonds
issued pursuant to Village Ordinance No. 4780 adopted March 6, 1996.
H. That as of December 1,2005 there has been collected, deposited to and on hand in
the Series 1998A General Obligation Bond and Interest Funds the sum of$65,345.00
for application to bond principal and interest payments for the bonds issued pursuant
to Village Ordinance No. 4917 adopted March 18, 1998.
1.. That as of December 1, 2005 there is available in the Village's Downtown
Redevelopment Fund the amount of$155,675.00 for application to bond principal
and interest payments for the bonds issued pursuant to Village Ordinance No. 4977
adopted December 1, 1998.
J. That as of December 1, 2005 there is available in the Village's Downtown
Redevelopment Fund the amount of $839,800.00 for application to bond principal
and interest payments for the bonds issued pursuant to Village Ordinance No. 4999
adopted March 2, 1999.
K. That as of December 1,2005 there is available in the Village's Series 2000 General
Obligation Bond and Interest Fund the sum of $492,228.00 for application to bond
principal and interest payments for the bonds issued pursuant to Village Ordinance
No. 5114 adopted June 6, 2000.
L. That as of December 1, 2005 there has been collected, deposited to and on hand in
the General Fund the sum of$315,000 for application to bond principal and interest
payments for the bonds issued pursuant to Village Ordinance No. 5301 adopted
January 21,2003.
Section Two: It is hereby declared and determined by the President and Board of Trustees of the
Village of Mount Prospect that the amount of $213,815.00 levied for G.O. Bond and Interest
payments for the purpose of financing flood control capital improvement projects within the Village
pursuant to Village Ordinance No. 4780 be and the same is hereby abated in the amount of
$213,815.00 being the entire amount levied for such bond and interest payment purposes for the
fiscal year commencing January 1, 2005 and ending December 31, 2005.
Section Three: It is hereby declared and determined by the President and Board of Trustees of the
Village of Mount Prospect that the amount of $65,345.00 levied for G.O. Bond and Interest
payments for the purpose of financing flood control capital improvement projects within the Village
pursuant to Ordinance No. 4917 be and the same is hereby abated in the amount of$65,345 .00 being
the entire amount levied for such bond and interest payment purposes for the fiscal year
commencing January 1, 2005 and ending December 31, 2005.

Section Seven: It is hereby declared and determined by the President and Board of Trustees of the
Village of Mount Prospect that the amount of $911,708.00 levied for G.O. Bond and Interest
payments for the purpose of financing a portion of the costs of constructing a new village hall and
community center and parking deck pursuant to Ordinance No. 5301 be and the same is hereby
abated in the amount of$315,000.00 leaving a balance of$596,708.00 as that amount levied for such
bond and interest payments for the fiscal year commencing January 1,2005 and ending December
31,2005.
Section Eight: Village Ordinance Nos. 4780,4917,4977,4999,5114, and 5301 are and each is
hereby amended with respect to the tax abatements declared herein and set forth in Sections Two
through Seven of this Ordinance.

SUBJECT: PROPOSED 2006 BUDGET
PURPOSE:
To present for the Village Board's consideration an ordinance adopting the annual budget
for the fiscal year beginning January 1,2006 and ending December 31,2006.
BACKGROUND:
The Village Manager released his proposed budget on October 7, 2005. Over the past two
months the Finance Commission met four times to review the document. The Village
Board, meeting as a Committee of the Whole, reviewed the document on October 25th,
November 9th and November 22nd.
DISCUSSION:
Attached hereto are changes to the proposed 2006 budget and 2007 forecast that resulted
from the above-mentioned meetings held with the Village Board and Finance Commission.
Chanaes to the 2006 Proposed Budaet
Total Village revenues decreased $161 ,563 from the proposed budget amount. Actual new
revenues totaled $2,243,909, but an accounting change to the way property taxes for
Police and Fire pension are recorded reduced this amount by $2,405,472. Total Village
expenditures decreased $2,490,377, but again changes in the accounting for Police and
Fire pensions increased this amount by $2,405,472. Absent these accounting changes,
total Village expenditures decreased $84,905. Included with this memo is a spreadsheet
detailing the changes from the proposed budget for total Village revenues and
expenditures.
General Fund: Total revenues for 2006 for the General Fund are projected at $34,161,176.
This is a decrease of $724,736 from the original proposed budget. Excluding accounting
changes for the police and fire pensions, actual revenues increased $1,680,736. The
additional revenue is primarily due to changes to three items; property taxes ($669,092),
vehicle license fees ($225,000), and ambulance billing charges ($748,000). Total
expenditures for 2006 for the General Fund are projected at $33,397,322. This is a
decrease of $2,539,777. Reductions in staffing ($134,305) and an increase to spending for

civic events ($1,000) accounted for all of the non-accounting type changes to budgeted
expenditures. A surplus of $763,854 is projected for 2006. Utilization of the surplus funds
will be discussed later in the budget year and will be based on results of operations at that
time.
Refuse Fund: Total revenues for the Refuse Fund for 2006 are projected at $4,033,827.
This is an increase of $638, 173 from the original proposed budget. A reduction in property
taxes of $353,552 and a new direct bill for residents generating $1,019,025 account for
most of the change in revenue.
Motor Fuel Tax Fund (MFT): Total expenditures for the MFT Fund are projected to
increase $50,000 from the original proposed budget. This was due to an adjustment for the
cost of infrastructure improvements. The George Street bridge rehab is expected to cost
$150,000. Only $100,000 was included in the original budget amount.
2002B B&I, Public Buildings: The budget for this fund was reduced to $0 as all the debt
related to this issue has been paid off. $600 that had been budgeted for banking fees was
removed since this expense will no longer be incurred.
Street Improvement Construction Fund: 2006 total revenues for this fund are projected
to decrease $75,000. This is due to the reallocation of vehicle license fees ($225,000) to
the General Fund and an increase in the municipal motor fuel tax ($150,000). There
remains sufficient ongoing revenue for the street program from other sources to support
this change.
Library Fund: At the time the proposed budget was prepared and distributed, the Mount
Prospect Public Library budget, included in the Village's budget as a component unit, was
not yet available. The Library's budget for 2006 reflects revenues and expenditures of
$8,113,291. Included in their budget is $1,578,275 for debt service on the Series 2002
Library bonds the Village issued on their behalf.
Changes to 2007 Forecast Budget
Total Village revenues decreased $190,201 from the proposed budget amount. Actual new
revenues increased $2,562,677, but as in 2006, an accounting change to the way property
taxes for Police and Fire pension are recorded reduced this amount by $2,752,878. Total
Village expenditures decreased $2,919,000, but again changes in the accounting for Police
and Fire pensions increased this amount by $2,752,878. Absent these accounting
changes, total Village expenditures decreased $166,122.
Summary
With the aforementioned changes, the proposed 2006 Budget for the Village totals
$77,815,943. This represents a 9.85% increase over the current 2005 Budget. Projected
revenues for the Village in 2006 are $78,382,263. This is an increase of 9.69%.

A public hearing on the proposed budget has been scheduled for December 20th. Notice
of the public hearing will be published in the Dailv Herald on December 8, 2005.
The proposed ordinance attached would officially adopt the budget for the Village of Mount
Prospect. Once the ordinance is passed, the Finance Department will revise the budget
document to incorporate the approved changes. We expect to have the approved budget
document produced no later than January 20th.
RECOMMENDATION:
It is recommended the Village Board pass the accompanying draft ordinance adopting the
2006 annual budget.

VILLAGE OF MOUNT PROSPECT FOR THE FISCAL YEAR
COMl\1ENCING JANUARY 1, 2006 AND ENDING DECEMBER 31,2006
IN LIEU OF PASSAGE OF AN APPROPRIATION ORDINANCE
WHEREAS, the President and Board of Trustees ofthe Village of Mount Prospect in accordance with State
Statutes, have provided for the preparation and adoption of an Annual Budget in lieu of passage of an
Appropriation Ordinance; and
WHEREAS, the tentative Annual Budget for the Village of Mount Prospect for the fiscal year beginning
January 1, 2006 and ending December 31, 2006, as prepared by the Budget Officer for the Village and
submitted to the President and Board of Trustees, was placed on file in the Office of the Village Clerk on
October 7,2005 for public inspection, as provided by Statute; and
WHEREAS, pursuant to notice duly published on December 8, 2005, a public hearing was held by the
President and Board of Trustees on said tentative annual budget on December 20, 2005, as provided by
Statute; and
WHEREAS, following said public hearing, said tentative Annual Budget was reviewed by the President and
Board of Trustees and a copy of said tentative Annual Budget is attached hereto and hereby made a part
hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The Annual Budget for the Village of Mount Prospect for the fiscal year beginning
January 1,2006 and ending December 31,2006, a copy of which is attached hereto and made a part hereof,
is hereby approved and adopted as the Annual Budget for the Village of Mount Prospect for said fiscal year.
SECTION TWO: Within thirty (30) days following the adoption of this Ordinance there shall be filed with
the County Clerk of Cook County a copy thereof duly certified by the Village Clerk and Estimate of
Revenues by source anticipated to be received by the Village in the fiscal year beginning January 1, 2006
and ending December 31, 2006, duly certified by the Chief Fiscal Officer.
SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and
publication in pamphlet form in the manner provided by law.

BUDGET
During budget discussions with the Village Board and Finance Commission, several
alternatives for new revenue to support the 2006 budget were discussed. The attached
three ordinances support the recommendations of the Village Board for eliminating the
licensing of dogs, increasing the rate for the municipal motor fuel tax and modifying the
ambulance billing program to include billing of residents. Discussion on each of these
ordinances is to follow.
Dog Licensing
Article II, Chapter 20 entitled "Dogs and Cats" and the accompanying sections of Appendix
A have been modified to eliminate the requirement of owners of dogs to acquire licenses on
an annual basis and provides for monetary fines for impoundment of animals in violation of
this section of the code. These sections of the code have been replaced with requirements
that all dogs and cats be inoculated with the rabies vaccine and collar and identification
tags are mandated when pets are off the property of the owner. Future proposed changes
regarding the remaining sections of the Village Code pertaining to Animal Control are being
reviewed by Environmental Health staff and will be brought to the Village Board at a later
date.
The impact to revenues for the General Fund budget by eliminating the dog-licensing
requirement is a reduction of $10,000.
Municipal Motor Fuel Tax
Section 8.1802 of Appendix A of the Village Code is amended to reflect the increase in the
per gallon gasoline tax from $0.01 to $0.02. The rate increase is effective January 1,2006.
Monies generated by this increase in tax ($150,000) will be allocated to the Street
Improvement Construction Fund. Existing revenue from the sale of vehicle stickers
($225,000) will be reallocated to the General Fund resulting in a net decrease in revenue to
the Street Improvement Fund of $75,000. Sufficient funds to support the street program
are available from other sources to maintain the street program.

Ambulance Billing Program
Article X, Chapter 8 entitled "Nonresident Ambulance Fee" and the accompanying sections
of Appendix A have been modified to reflect changes in the ambulance billing program for
the Village. Currently only nonresidents are being assessed a charge for utilizing
ambulance transport services provided by the Village. The new program as modified now
assesses a charge to residents as well. Fee for all users will be according to approved
Medicare rates and based on type of service (BLS, ALS1 and ALS2). There is also a
component for mileage. Listed below are the 2005 Medicare rates for ambulance transport
service. Information on the 2006 approved rates is not available at this time.

Total revenue generated by the modified ambulance-billing program is projected to be
$783,000. The monies will be allocated to the General Fund to defray a portion of the costs

Every owner, except animal shelters, animal impounding facilities, and
laboratory animal facilities, of a dog or cat four months or more of age
shall cause such dog or cat to be inoculated with rabies vaccine by a
licensed veterinarian at such intervals as approved by the Illinois
Department of Agriculture.
SECTION TWO: Section 20.202, entitled "License Application: Fee," of Article II,
entitled "Dogs and Cats," of Chapter 20 of the Village Code of the Village of Mount
Prospect is hereby deleted in its entirety and the following new Section 20.202, entitled
"Collar and Identification - Dogs and Cats," to be and read as follows:
Section 20.202. Collar and Identification - Dogs and Cats:
Every dog or cat, when off the property of the owner, shall wear a collar,
attached to which shall be the identification of the dog or cat's owner,
along with the serially numbered tag, issued by the Cook County
Department of Animal and Rabies Control, or similar agency of another
county, evidencing the dog or cat's rabies inoculation.
Every dog or cat found in the village without such collar and
identification will be deemed to be in violation, and shall be impounded as
provided in this chapter.
SECTION THREE: Section 20.203, entitled "Issuance of License," of Article II, entitled
"Dogs and Cats," of Chapter 20 of the Village Code of the Village of Mount Prospect is
hereby deleted in its entirety and Section 20.203 is hereby reserved.
SECTION FOUR: Appendix A, Division II of the Village Code of the Village of Mount
Prospect shall be amended to delete Section 20.206 in its entirety and insert a new
Section 20.206, to be and read as follows:
Section 20.206: IMPOUNDMENT PROCEDURES
C. 1. Dog or cat impounded as stray: $25.00
Horse impounded as stray: $150.00

Section 8.1002: DEFINITION: For the purpose of this article, the following definitions apply:
A. "Ambulance services" is the provision of medical care by the Mount Prospect fire
department and transportation by the Mount Prospect fire department ambulance to a
hospital or other approved medical facility
B. "Patient" is any person who requires medical care and transportation of any type,
whether knowingly or unknowingly, by the Mount Prospect fire department ambulance.
C. "Resident patient" is any person, who resides within the corporate limits of the Village
of Mount Prospect.
D. "Nonresident patient" is any person, who resides outside of the corporate limits of the

Section 8.1003: FEE ESTABLISHED:
A. If a resident patient receives ambulance services, a fee in the amount set forth in
appendix A, division II of this code, shall be due and owing to the village upon receipt
of a bill issued by or on behalf of the village.
B. If a nonresident patient receives ambulance services due to an injury related in any way
to a motor vehicle accident, a fee in the amount set forth in appendix A, division II of
this code, shall be due and owing to the village upon receipt of a bill issued by or on
behalf of the village.
C. If a nonresident patient receives ambulance services due to an injury or illness occurring
at any location other than within a residential dwelling unit, a fee in the amount set forth
in appendix A, division II of this code, shall be due and owing to the village upon
receipt of a bill issued by or on behalf of the village.
D. If a nonresident patient receives ambulance services due to an injury or illness which
occurred within a residential dwelling unit in the Village, the nonresident patient shall
be considered a resident patient for billing purposes and a fee in the amount set forth in
appendix A, division II of this code, shall be due and owing to the village upon receipt
of a bill issued by or on behalf of the village
Section 8.1004: COLLECTION:
A. The Director of Finance of the Village shall cause an invoice for ambulance services to
be issued to patients in accordance with this ordinance. The Village may enter into a
contract with an independent billing service and/or collection agency in order to
facilitate this process.
B. Invoices shall be provided directly to the patient's insurance company or companies,
self-insurers, Medicare, Medicaid or Public Aid. Assignments of insurance benefits for
resident patients shall be accepted as payments in full. Fees, assessed by insurance
carriers, as "deductibles" or "co-payments," shall be waived for resident patients, in
consideration of municipal/property taxes paid to the Village.
C. In the event of hardship or special circumstance, the Director of Finance is authorized to
waive, on an individual basis, fees charged to resident patients under this ordinance, but
not paid by insurance, Medicare, Medicaid or Public Aid.
SECTION TWO: Appendix A, Division II of the Village Code of the Village of Mount Prospect shall
be amended to delete Section 8.1003 in its entirety and a new section 8.1003 is inserted to be and read
as follows:
Section 8.1003: FEE ESTABLISHED:
A. Level of medical care, i.e., BLS (basic life support), ALS 1 (Advanced Life Support
level I ), or ALS2 (Advanced Life Support level 2), and mileage, based upon the
Medicare rate and definitions effective at time of transport.
B. Level of medical care, i.e., BLS (basic life support), ALS1 (Advanced Life Support
level 1), or ALS2 (Advanced Life Support level 2), and mileage, based upon the
Medicare rate and definitions effective at time of transport, plus $100.00.
C. Same as for B.
D. Same as for A.
SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.

Attached to this memorandum is an Ordinance proposing the amendment of a Redevelopment Plan and
Project for the amendment of the Downtown TIF NO.1 Redevelopment Project Area, the amendment of
the Downtown TIF No.1 Redevelopment Project Area, the convening of a joint review board and calling
a public hearing to accomplish this task.
This ordinance is a necessary step in the process to amend the Village's Tax Increment Financing
District. The ordinance would establish dates for a Joint Review Board meeting (January 4, 2006) and a
public hearing (February 7,2006) to discuss the proposed amendments to the scope and boundaries of
the TIF.
Please forward this memorandum and attached Ordinance to the Village Board for their review and
consideration at their December 6h meeting. Staff will be at that meeting to answer any questions
related to this matter.

Whereas, pursuant to the Tax Increment Allocation Redevelopment Act, as supplemented
and amended (the "TlF Act "), the President and Board of Trustees (the "Corporate
Authorities") of the Village of Mount Prospect, Cook County, Illinois (the "Municipality"), has
heretofore detenuined and does hereby determine that it is advisable and in the best interests of
the Municipality and certain affected taxing districts that the Municipality amend a proposed
redevelopment plan (the "Redevelopment Plan") and project (the "Project") for and amend the
redevelopment project area known as the Downtown TIF No.1 Redevelopment Project Area (the
"Redevelopment Project Area") as further described in EXHIBIT A attached hereto and that the
Municipality confirm tax increment allocation financing for the amended Redevelopment Project
Area; and
Whereas, pursuant to Section 11-74.4-4.2 of the TIF Act the Municipality is required to
create an interested parties registry for activities related to the Redevelopment Project Area, to
adopt reasonable registration rules, and to prescribe requisite registration fonus for residents and
organizations active within the Municipality that seek to be placed on said interested parties
registry, and the Corporate Authorities have heretofore, and it hereby expressly is, determined
that the Municipality has created such registry, adopted such registration rules and prescribed
such requisite registration fonus and give public notice thereof; and
Whereas, the TIF Act requires the Municipality also to convene a joint review board and
conduct a public hearing prior to the adoption of ordinances amending a redevelopment plan and
project, amending the redevelopment project area, and confinning tax increment allocation
financing therefor, at which hearing any interested person or affected taxing district may file with

the Municipal Clerk written objections to and may be heard orally with respect to the amended
Redevelopment Plan and Project; and
Whereas, the TIF Act further reqmres that such joint reVIew board consist of a
representative selected by each community college district, local elementary school district and
high school district or each local community unit school district, park district, library district,
township, fire protection district and county that will have authority to directly levy taxes on the
property within the amended Redevelopment Project Area at the time that the amended
Redevelopment Project Area is approved, a representative selected by the Municipality and a
public member to consider the subject matter of the public hearing; and
Whereas, the TIF Act further requires that the time and place of such public hearing be
fixed by ordinance or resolution adopted by the Corporate Authorities; and
Whereas, the TIF Act further requires that not less than 10 days prior to adopting such
ordinance or resolution fixing the time and place of a public hearing, the Municipality must make
available for public inspection the amended redevelopment plan or a separate report that provides
in reasonable detail the basis for the proposed amendments to the Redevelopment Project Area's
qualifying as a "redevelopment project area" under the Act; and
Whereas, the finn of Kane, McKenna & Associates, Inc., has conducted an eligibility
survey of the proposed amendments to the Redevelopment Project Area and has prepared its
report (the "Report") that said proposed area qualifies as a "redevelopment project area" as
defined in the TIF Act, which survey and findings have been presented to the Corporate
Authorities and are now on file in the official files and records of the Municipality; and
Whereas, the Report has heretofore been on file and available for public inspection for at
least 10 days in the offices of the Municipal Clerk as required under the TIF Act; and

Whereas, the TIF Act requires that notice of the public healing be given by publication
and mailing; and
Whereas, the Corporate Authorities have heretofore and it hereby is detennined that it is
advisable to convene a joint review board and hold a public hearing to consider the proposed
approval of the proposed amendments to the Plan and Project; and
WHEREAS, the Corporate Authorities have heretofore and it hereby expressly is found
that the amended Redevelopment Plan and Project will not displace residents from 10 or more
inhabited residential units:
Now Therefore, Be It Ordained by the President and the Board of Trustees of the Village
of Mount Prospect, Cook County, Illinois, as follows:
Section J. Redevelopment Plan and Project Amendments. The approval of the
amended Redevelopment Plan and Project, the amended Redevelopment Project Area and the
confirmation of tax increment allocation financing therefor are hereby proposed.
Section 2. Interested Persons Registly Created. There has been created an interested
persons registry (the "Registry") for the amended Redevelopment Project Area. The Village
Clerk was hereby expressly authorized and directed to maintain the Registry for the
Redevelopment Project Area.
Section 3. Registration Rules and Forms. The registration rules for the Registry have
been previously approved by the Village and are available from the Village Clerk.
Section 4. Joint Review Board Convened. A joint review board as set forth in the TIF
Act is hereby convened and the board shall meet, review such documents and issue such report as
set forth in the TIF Act. The first meeting of said joint review board shall be held at 3 :00 p.m. on
the 4th day of January, 2006, at Village Hall, Mount Prospect, Illinois. The Municipality hereby
expressly finds and determines that said date is at least 14 days but not more than 28 days after

the notice to affected taxing districts hereinafter authorized in Section 7 of this ordinance will be
mailed.
Section 5. Time and Place of Public Hearing Fixed. A public hearing (the "Hearing")
shall be held by the President and the Board of Trustees of the Municipality at 7:00 o'clock p.m.
on the 7th day of February, 2006, at Village Hall, Mount Prospect, Illinois, for the purpose of
hearing from any interested persons or affected taxing districts regarding the proposed
amendment to the Redevelopment Plan and Project, amendment of the Redevelopment Project
Area, and confirmation of tax increment allocation financing therefor.
Section 6. Publication of Notice of Hearing. Notice of the Hearing, substantially in
the form attached hereto as EXHIBIT B, shall be published at least twice, the first publication to
be not more than 30 nor less than 10 days prior to the Hearing, in a newspaper of general
circulation within the taxing distIicts having property in the proposed Redevelopment Project
Area.
Section 7. Mailing of Notice of Hearing Authorized. (a) Notice shall be mailed by
certified mail not less than 10 days prior to the date set for the Healing, addressed to the person
or persons in whose name the general taxes for the last preceding year were paid on each lot,
block, tract or parcel of land lying within the amended Redevelopment Project Area. In the event
taxes for the last preceding year were not paid, the notice shall also be sent to the persons last
listed on the tax rolls within the preceding three years as the owners of such property. Notice
shall also be given within a reasonable time after the adoption of this ordinance by first class
mail to all residential addresses located outside the proposed Redevelopment Project Area and
within 750 feet of the boundaries of the proposed Redevelopment Project Area and to those
organizations and residents that have registered with the Municipality for that infonnation in
accordance with the registration guidelines herein established by the Municipality. Notice shall

also be given by certified mail to all taxing districts of which taxable property is included in the
proposed Redevelopment Project Area and to the Illinois Depmiment of Commerce and
Economic Opportunity not less than 45 days prior to the Hearing, and such notice (i) shall advise
the taxing bodies represented on the joint review board of the time and place of the first meeting
of the joint review board and (ii) shall also include an invitation to each taxing district and the
Illinois Department of Commerce and Economic Opportunity to submit written comments prior
to the date of the Hearing to the Village, to the attention of the Village Clerk, Village Hall, 50
South Emerson, Mount Prospect, Illinois 60056 concerning the subject matter of the Hearing.
Each such mailed notice to the taxing districts shall include a copy of the Report, the name of an
appropriate person to contact for additional information, and a copy of the proposed
Redevelopment Plan.
Section 8. Superseder; Effective Date. All ordinances, resolutions, motions or orders
in conflict with the provisions of the Ordinance are, to the extent of such conflict, hereby
repealed. This Ordinance shall become effective upon its adoption.

Notice is hereby given that on the 7th day of February, 2006, at 7:00 p.m. at the Village
Hall, 50 South Emerson Street, Mount Prospect, Illinois, a public hearing will be held to consider
the amendment of the Downtown TIF No. 1 redevelopment plan (the "Redevelopment Plan")
and the amendment of that redevelopment project area known as the Downtown TIF No. 1
Redevelopment Project Area (the "Redevelopment Project Area "). The Redevelopment Project
Area consists of the territory legally described in Exhibit 1 attached and is generally described
below:
The existing Downtown TIF No. 1 is generally bounded by Northwest Highway on the
south and west, Central Road, Busse Avenue and Evergreen Avenue to the north, and Maple
Street and Owen Street to the east.
The proposed amendments include property generally located at the southeast comer of
Emerson Street and Busse A venue, and property generally located at northwest comer of Main
Street and Central Road.
There will be considered at the hearing amendment of the Redevelopment Plan and
Project for and the amendment of the proposed Redevelopment Project Area and confirmation of
tax increment allocation financing therefor. The amended Redevelopment Plan and Project is on
file and available for public inspection at the office of the Village Clerk, Mount Prospect Village
Hall, 50 South Emerson Street, Mount Prospect, Illinois. Pursuant to the amended
Redevelopment Plan and Project the Village proposes to alleviate conservation area conditions in
the amended Redevelopment Project Area and to enhance the tax base of the Village and the
taxing districts having taxable property within the Redevelopment Project Area by utilizing tax
increment financing to fund various eligible project costs to stimulate private investment within
the Redevelopment Project Area. These eligible project costs may include, but may not be
limited to, studies, surveys, professional fees, propeliy assembly costs, construction of public
improvements and facilities, financing, administrative and other professional costs, all as
authorized under the Tax Increment Allocation Redevelopment Act, as amended. The
Redevelopment Plan objectives include promoting and protecting the health, safety, morals and
welfare of the public by establishing a public/private partnership, establishing economic growth,
and development in the Village, encouraging private investment while conforming with the

Village's comprehensive plan, restoring and enhancing the Village's tax base, enhancing the
value of the amended Redevelopment Project Area, improving the environmental quality of the
amended Redevelopment Project Area, and retaining and attracting employment oPPOliunities
within the proposed Redevelopment Project Area. To achieve these objectives, the
Redevelopment Plan proposes to provide assistance by paying or reimbursing costs related to the
acquisition, construction and installation of public facilities, property assembly, site preparation
and improvement, environmental remediation, job training and other eligible redevelopment
project costs, the execution of one or more redevelopment agreements, and the payment of
financing, administrative and other professional costs.
Prior to the date of the hearing, each taxing district having property in the Redevelopment
Project Area and the Illinois Department of Commerce and Economic Opportunity may submit
written comments to the Village, to the attention of the Village Clerk, 50 South Emerson Street,
Mount Prospect, Illinois 60056.
There is hereby convened a joint review board to consider the amended Redevelopment
Plan and Project for and the designation of the proposed Redevelopment Project Area and the
confimlation of tax increment allocation financing therefor. The joint review board shall consist

RESOLUTIONS EXTENDING THE 6B INCENTIVE PROGRAM FOR
MANUFACTURING & C-L1NE PRODUCTS
SUBJECT:
As outlined in the attached correspondence, Braun Manufacturing and C-Line Products have requested
that the Village of Mount Prospect approve an extension of their participation in Cook County's 6B
Incentive Program for their facilities in the Kensington Business Center. The extension of the 6B
Incentive Program requires approval by the Village of Mount Prospect.
The 6B Incentive Program is offered by Cook County and provides real estate tax incentives for
developing new industrial facilities, rehabilitating existing industrial structures and reusing industrial
buildings that have been vacant for a minimum of two years. The program entitles properties to a
reduced rate of assessment over a 12-year period, resulting in assessment rates of 16% for the first 10
years, 23% for the 11th year, and 30% for the 1ih year. In absence of the incentive program (or
following completion of the program) the County's standard assessment rate of 36% would apply.
The 6B Program was established to help compensate for Cook County's high property tax burden by
offsetting some of the initial property taxes for new or redeveloped industrial properties. The theory is
that the initial 1 a-year period would help even the playing field and that an initial sacrifice by the various
taxing bodies would result in an overall property tax base increase in the future. It is important to note
that the property tax savings enjoyed by the 6B Program participants is offset by higher property taxes
for other properties within Mount Prospect. The County amended the Class 6B Program in 2002 to
allow for the 1 a-year extensions in their continued effort to maintain its industrial base.
Staff met previously with representatives from the local school and park districts to ascertain their
opinions on the Class 6b extension requests. It was noted that the extensions would not have any
impact on the tax base of these taxing districts due to the way that the County Assessor's Office views
the incremental assessed value. Since the Assessor doesn't consider the growth in assessed value
that would be realized when the Class 6b incentive expires as "new growth", the districts that are
affected by tax caps do not benefit from this increase in assessed value.
The two current requests require action by the Village before the end of the calendar year. Please
forward this memorandum and attachments for their review and consideration at their December 6th
meeting. Staff will be present at that meeting to answer any questions related to this matter.

In 1998 the Village of Mount Prospect passed an inducement resolution that allowed us
to receive a Cook County Class 6 Tax Abatement. This tax abatement was instrumental
in allowing C-Line Products Inc. to purchase our building at 1100 E. Business Center
Drive and operate our business.
The past 7 years has seen many changes in the manufacturing environment. Many small
manufacturers have been forced out of business, out of state, or like us have had to
reinvent their businesses to try and not only be competitive but to remain viable.
Our level of employment has declined over the years as we have had to outsource some
of our production to China. However we have now reached a point where we are stable
and hope to grow our business more on the distribution side rather than the production
side. New product development continues as more than 25% of our sales come from
products that are less than 3 years old. In the past 24 months we have invested close to
$500,000 in distribution equipment and technology equipment to allow us to become
more efficient and service the constant growing needs of our customers.
Cook County will allow us to apply for an extension of our Class 6 Abatement. We need
to do so by December 31, 2005. I am requesting that the Village of Mount Prospect
continue to support us and agree to extend the resolution to allow us to apply for this
abatement with the County. The support of the Village is critical to us in our efforts to
maintain the jobs we employ as well as remain competitive in today's marketplace.

Company moved to Mt. Prospect end of 1996 we are now in the first year of our phase out. I have
been informed that the final date/year will be January 1,2007. We are seeking a renewal of the
Class 6 tax incentive rate.
Braun Mfg. Company employs an average of thirty people, some have relocated to the general area
to be closer to work.
Due to the import of product from China we have suffered along with other manufacturing
companies. We are currently at 16'70 and an assessment of 26-34% would leave us no alternative

A RESOLUTION CALLING FOR COUNTY ACTION WITH RESPECT TO
VICIOUS ANIMALS
Preamble
It has become clear in recent years that the risk to society in keeping certain types of
animals in urban and suburban areas greatly outweighs any right that an individual may claim in
keeping such animals. Examples of animals which create such a risk are those whose species
are principally found in the wild rather than as domestic pets and canine breeds such as pit bull
terriers (American Staffordshire, American Pit Bull). Irrespective of the gentle nature of certain
individual animals, species which are generally feral and canine breeds that have historically
been bred for fighting are undeniably more prone to violent human attacks than generally
domesticated species or in the case of pit bulls, other canine breeds. Each such attack creates a
tragedy that might have been prevented.
It is also clear that a vicious animal is no respecter of political boundaries. An out of
control pit bull or other such animal would not stop its attacks at a boundary line between two
municipalities. Therefore, any legislation prohibiting or otherwise regulating the keeping of
vicious animals, in order to be effective, must be accomplished on an area wide basis.
Moreover, rabies protection and other types of animal control measures have historically
been addressed on a countywide basis.
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect, calls
upon the County Board of Cook County to create and adopt an ordinance that appropriately
defines and prohibits or strictly regulates the breeding or keeping of vicious animals throughout
the County for the protection of all County residents.
SECTION TWO: That this Resolution shall be in full force and effect from and after its passage
and approval in the manner provided by law.

A RESOLUTION CONSENTING TO ASSIGNMENT OF
TELECOMMUNICATIONS FRANCHISE AGREEMENT
WHEREAS, the corporate authorities of the Village of Mount Prospect entered into a non-
exclusive Franchise Agreement with Metropolitan Fiber Systems (MFS), which agreement
was effective on January 22, 1997, pursuant to approval of Resolution No. 2-97 (the
"Franchise Agreement"); and
WHEREAS, the Franchise Agreement allows MFS to install fiber optic cable in certain
locations within the Village rights-of-way; and
WHEREAS, MFS has been succeeded-in-interest by MClmetro Access Transmission
Services, LLC (MATS), which is a wholly owned subsidiary of MCI, Inc. (MCI); and
WHEREAS, MATS has given the Village notice of a pending merger between Verizon
Communications, Inc., Eli Acquisition, LLC, and MCI, pursuant to a certain Agreement and
Plan of Merger, dated February 14, 2005, as amended, such that MATS will undergo a
change in control with MATS to remain the franchisee/permittee under the Franchise
Agreement with the Village of Mount Prospect; and
WHEREAS, MATS agrees that, upon and after the aforestated merger, it will assume all of
the obligations, liabilities and responsibilities of MFS pursuant to and in accordance with
the Franchise Agreement, including those accruing prior to the date of the assignment; and
WHEREAS, Sections 18.1 and 18.2 of the Franchise Agreement require the Village's
consent prior to an assignment, which includes a substantial change in control of MFS.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois:

SECTION 1: That the Village Manager is hereby authorized to execute the Petition
for Consent to Assignment between MClmetro Access Transmission Services, LLC, and

This letter hereby references the franchise agreemenVpermiVordinance
("Franchise Agreement") between Metropolitan Fiber Systems of Chicago, Inc.
and the Village of Mount Prospect. MClmetro Access Transmission Services
LLC is the successor-in-interest to Metropolitan Fiber Systems of Chicago, Inc.
and is a wholly owned subsidiary of MCI. Inc. ("MCI").
Pursuant to the terms and conditions of that certain Agreement and Plan of
Merger, dated as of February 14, 2005, as amended, by and among Verizon
Communications Inc. ("Verizon"), Eli Acquisition, LLC ("Merger Sub") and Met
(the "Merger Agreement"), Verizon, Merger Sub and MCI have agreed that at the
closing of the transactions contemplated by the Merger Agreement, Verizon shall
acquire MCr by the merger of MCI with and into Merger Sub, a wholly-owned
subsidiary of Verizon, with Merger Sub being the surviving corporation in the
merger. 1 In connection with such acquisition, MClmetro Access Transmission
Services LLC will undergo a change in control, but MClmetro Access
Transmission Services LLC will remain the franchisee/permittee under the
Franchise Agreement with the Village of Mount Prospect after the closing of the
transactions contemplated by the Merger Agreement.
MCI recognizes that a change in control is deemed an "assignment" under the
Franchise Agreement. Accordingly, MCI hereby gives the Village of Mount
Prospect notice of its intent to complete the transaction contemplated by the
Merger Agreement. MCI also hereby petitions the Village of Mount Prospect for
consent to such transaction.
MClmetro Access Transmission Services LLC acknowledges and agrees that the
"assignment" described above will not relieve or release MCrmetro Access
