HomeMy WebLinkAboutRes 09-79 04/04/1979 RESOLUTION NO. 9-79 A RESOLUTION AUTHORIZING THE FIRE AND POLICE COMMISSION TO UTILIZE COOPERATIVE TESTING OF RECRUITS WHEREAS, the Village of Mount Prospect deems it to be in the best interests of the said Village to participate in cooperative testing of recruits for the Police and Fire services of the Village of Mount Prospect; and WHEREAS, a cooperative testing service has been established by several municipalities in the area known as the Northwest Municipal Conference Area Police and Fire Recruitment and Testing Consortium. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Board of Fire and Police Commissioners be and is hereby authorized to utilize the Northwest Municipal Conference Areal Police and Fire Recruitment and Testing Consortium to administer such segments of recruit testing as the Fire and Police Commissioners shall determine to be in the best interests of the Village from time to time. SECTION TWO: That the Board of Fire and Police Commissioners be and is hereby authorized to utilize the results of such testing in establishing its list of eligibles for service in the Fire and Police Departments. SECTION THREE: That the Board of Fire and Police Commissioners be and is hereby authorized to utilize eligibility tests compiled by utilization of test results reported by the Northwest Municipal Area Police and Fire Recruitment Testing Consortium in making appointments to positions in the Fire and Police service. SECTION FOUR: That the Northwest Municipal Area Police and Fire Recruitment Te.sting Consortium be and is hereby authorized to act as an agency of the Fire and Police Commission for the purpose of administering tests as hereinbefore authorized. SECTION FIVE: That the Village of Mount Prospect hereby approves the by-laws of the Northwest Municipal Area Police and Fire Recruitment Testing Consortium, a copy of which is attached hereto, expressly incorporated by reference herein and made a part hereof as though fully set forth herein. BE IT FUTHER RESOLVED that this RESOLUTION be and the same is hereby enacted pursuant to the powers granted the Village of Mount Prospect under the terms and provisions of the Constitution of the State of Illinois of 1970, Article VII, Section 10, empowering units of local government inter alia to share services and to ~xel'ci&e, combine, or transfer functions or powers among themselves in order to further intergovernmental cooperation and benefits to the public resulting therefrom. PASSED and APPROVED this ATTEST: r, ,I a7l~a_Ld Village Clerk \ 0) day of c~ft(tL0 j/ Mayor (. ,,/ /:CftzL<:->d->L-- ,-I! ~ /~-u-Z'~n/u2-~ By-Laws Northwest Municipal Conference Area Fire-Police Recruitment and Testing Consortium Article I Purpose The Northwest Municipal Conference Area Police Recruitment and Testing Consortium, hereinafter referred to as the "Consortium" is a cooperative venture voluntarily established by its members pursuant to Article VII, Section 10, of the 1970 Constitution of the State of Illinois. The expressed purpose of this body is to provide the operating framework through its organization or such organization as may be designated by it for the common recruitment and testing .of police candidates. In addition, the Consortium shall serve as a forum for discussion, study, development and/or implementation of ideas or plans of mutual interest and concern regarding the recruit- ment, application process, and physical agility and psychological testing of candidates for the member fire and police departments. The specific objectives of this organization will be: 1) Develop a Combined Recruiting Program An area wide recruiting program will enable the munici- palities to pool their efforts to draw the MOST qualified prospects. This capability may prove very cost effective if the present supply of available quality prospects should become limited. . 2) Develop the Best Testing Devices The test program would necessitate professional review as to its validity and applicability to the' job classification. The pooling mechanism would present a cost effective method of determining this and enable retention of consulting expertise to assist with addressing the requirements of Equal Opportunity Employment. 3) Develop a Valid and Efficient Screening Technique The technique utilized in oral interviews and in the analysis of written data is a difficult one to master. It can often serve to be the determinant that can clarify one candidate's position over another. It would be the purpose to develop validity guidelines that could be employed by the local municipal fire and police commission. By's - Fi re-Pol ice Recruitment and Testi ng page 2 4) Reduction of Cost and Time The time required and the cost of duplicate testing programs administered to a candidate who applies to a number of departments would be eliminated by a pooling program. Also the costs that would occur to a number of municipalities attempting test verification (or court defense of an unveri- fied test) would be limited. 5) Maintenance of Local Fire-Police Commission Control of the Candidate Selection Process This program would be a cooperative venture by the partici- pating municipality. It seeks to eliminate duplication and to improve the standards of selection in relation to performance. It will NOT usurp local determination of the candidate they desire to serve in their community. All testing and screening information will be made available to the local fire-police commission.of the municipality to which the'candidat~e has applied. The manner in which that information is utilized by the local municipality will be determined by that local boaro. Art i c 1 e II Powers The Consortium shall have the following powers: A) To enter into contracts in its own name, including but not limited to service and performance contracts with private consultants and other governmental units. B) To employ agents and employees should the need be manifested. C) D) To acquire, lease, hold and dispose of property. To incur debts, liabilities, or obligations necessary for the accomplishment of its purpose and as deemed necessary by its Board of Directors. E) To exercise those powers necessary and incidental to carrying out the purposes set forth in Article I of the By-Laws, including but not limited:to: l) Establish Testing Standards 2) Selection of Testing Mechanisms 3) Authorize Recruitment Programs 4) Authorize all Forms 5) Authorize Test Dates and Procedures 6) Administer Tests 7) Grade and Compile Test Results - 8) Forward Test Results to Applicant Designated Municipalities 9) Notify Candidates of Test Results 10) Make Recommendations to Local Fire-Police Commissions Relative to Their Rules and Regulations . By- Laws - I-Pol ice Recrui tment and Testi ng page 3 Article III Participation A) All municipalities who adopt an ordinance of participation by their respective Boards of Trustees/City Councils shall be members in 'equal standing of the Consortium. B) Continued membership shall be contingent upon the payment by each municipality of the annual and/or additional fees as may b~_determined by the Board of Directors. C) Upon becoming a member, any new member municipality shall become subject to all existing debts and liabilities of the Consortium to the same extent as all other members. Article IV Board of Directors The Board of Directors Shall be established for the Consortium which shall consist of the chairman of the fire-police commission of each community or his designate. A) The Board of Directors shall determine general policy of the Consorti um', adopt and amend these By-Laws, accept new members, and approve the budget. B) The Board shall also designate the agency to serve as staff consultant and/or employ as may be deemed necessary, individuals to function as staff support. C) The Board of Directors shall meet at least once a year in January of that year. Special meetings of the Board of Directors may be called by the Chairman on his initiative or on the request of the representatives of two member municipalities. l) Unless otherwise specified, a quorum for the transaction of business shall consist of a majority of member municipalities. 2) Roberts Rules of Order (Newly Revised), when not in conflict with these By-Laws, shall govern all meetings of the Board of Di rectors. Article V Offi cers There are hereby established by these by-laws three officers of this organization who shall be the Chairman, Vice-Chairman and Secretary- Treasurer. rev. 4/19/78 By-Laws '-ire-Pol ice Recruitment and Testing page 4 A) Election of officers shall be held each January. A majority vote of the representatives constituting a quorum shall be required to elect the officers. B) Chairman - The duties of the Chairman are: I)' To preside at all meetings of the Consortium 2) To review the agenda and insure its issuance to all members with (15) fifteen days of a scheduled meeting 3) To call a special meeting of Consortium representatives when deemed necessary , 4) To act as chief spokesman for the Consortium in all matters concerning its policy considerations C) Vice-Chairman - The Vice-Chairman shall serve as Chairman in the absence of the Chairman and will assume all duties and responsi- bilities of the Chairman in the eventuality that he may no longer be able to serve in that capacity. In addition, he shall perform all the duties incident to that office and all other duties rela- tive to the Consortium as from time to time may be assigned to him by the Board of Directors. D) Secretary-Treasurer - The Secretary-Treasurer shall have charge of all the minutes and official records of the Consortium. He shall also review the financial reports prepared by the staff and present them at the regularly scheduled meetings. Article VI. Support Personnel The Board of Directors shall designate an agency or municipality to operate in the capaci.ty of support personnel as may be deemed necessary by the nature of this project. If in the opinion of a majority of the member municipalities of the Consortium further support or coordination assistance would become necessary, full or part-time personnel may be hired according_ to the policy of the Board. Article VII. Budget The fiscal year of the Consortium shall run from May 1 to April 30. The annual budget shall be approved at the regular meeting of the Consortium. The budget will reflect the day to day operations of the Consortium. The annual budget appropriation for non-testing related staff expense shall be divided equally by all members. Additional funds will be forthcoming within 30 days of invoice for the direct and indirect expenses incident to the administration of each testing cycle and/or for the special research or consultation approved by the Board of Directors. All such expenses incurred by the Consortium will be divided proportionately as to the percentage of total candidate applications processed by each member community of the Consortium during the test cycle. rev. 3/1/79 By-Laws - ~-Police Recruitment and Testing page 5 . The budgetary process of the Consortium shall require the specific approval of each member municipality to that member's maximum annual liability for participation in the costs of conducting the functions of the Consortium. Article VIII. Audit The Board of Directors shall call for an annual audit of the financial affairs of the Consortium. This audit shall be performed by a Certified Public Accountant in accordance with generally accepted auditing principles and shall be presented to the member municipalities forty-five (45) days prior to the January meeting for approval at that meeting. Article IX. Withdrawal, Termination, and Dissolution A) Withdrawa 1 Any member municipality may withdraw from this agreement effective on the first day of the new fiscal year. Upon withdrawal it is respon- sible for: 1) 2) 3) 4) Non-payment of prior year dues for operating ex'penses,. Non-payment of special direct and indirect expenses relative to their participation in any prior testing cycle. Pro-rata share of any and all debts incurred by the Consortium. while they were a member. Any contractual obligations it has separately signed with the Consorti um. B) Termination The voting membership of any municipality shall be terminated for non-payment of annual dues or failure to render payment of a special assessment within ninety (90) days of invoice. Termination shall require a Majority vote of all member municipalities with the muni- pality in question not permitted to vote on the question. The terminated municipality is responsible for all finanical indebtedness as outlined in "Withdrawal Article IX, Section A." C) Dissolution The dissolution of the Consortium shall be deemed to have occurred on the withdrawal of all but two members or upon successful adoption of a motion of dissolution which must be approved by a majority of the membership. Upon dissolution, all assets of the Consortium shall be divided according to the apportionment ratio for membership as outlined in Article VII. Assets shall be dis- tributed only to those members who have participated in Consortium activity for the fi~cal year in which dissolution occurs. rev. 4/19/78 By-Laws ire-Police Recruitment and Testing Page 6 Article X Amendment These By-Laws may be amended by a 2/3 vote of the member municipal- ities represented by any scheduled meeting. Motions for amendment must be received by the Secretary no less than forty-five (45) days prior to the scheduled meeting for inclusion on the agenda., Article XI Ratification The By-Laws are considered in force and the Consortium agreement applicable to those member communities whose municipal Board of Trustees/ ' City Councils have adopted by ordinance the intent and concomitant conditions of membership. A copy of such ratification resolution shall be transmitted to the offices of the Northwest Municipal Conference upon board approval and until such time as a Secretary is selected pursuant to Article V, Section C. Article XII Separability That each article, section, paragraph, sentence, clause and prOV1Slon of these By-Laws is separable and if any provision is held unconstitutional or invalid for any reason, such decision shall not affect the remainder of these By-Laws nor any part thereof, other than that part affected by such decision. dm rev. 4/19/78
