RESOIDTION NO. 16-79
A RESOLUTICN GRANTING A CERTAIN LICENSE TO THE
METROPOLITAN SANITARY DISTRICT OF GREATER OHCAGO
WHEREAS, Section 6 (a) of Article VII of the 1970 Constitution of
the State of Illinois provides that "any municipality which has a }X>pulation
of rrore than 25,000 (is) a Hare Rule Unit" and the Village of Mount Prospect,
Cook County, Illinois, with a }X>pulation in excess of 25,000 is, therefore,
a Harre Rule Unit and may, un::1er the power granted by said Section 6 (a) of
. Article VII exercise any pcMer and perfonn any function pertaining to its
government and affairs; and
WHEREAS, pursUant to such authority, the Mayor and Board of
Trustees of the Village of Mount Prospect have heretofore passed and
approved an ordinance anending the Mount Prospect Municipal Code of 1957,
by adding thereto Section 9.202 and 9.203 requiring specified approvals by
the Mayor and Board of Trustees of the Village of Mount Prospect prior to
. the corrmencerrent of specified work wi thin the corp:>rate limits of the
Village of Mount Propect; and
WHEREAS, the Metro}X>litan Sanitary District of Greater Chicago.
has asked the Village for authority to construct, reconstruct, repair,
maintain and operate an intercepting sewer upon, under and through specified
streets located in the Village of Mount Prospect.
NOO, THEREFDRE, BE IT RESOLVED BY THE MAYOR AND OOARD OF TRUSTEES
OF THE VILIAGE OF MJUNT POOSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Subject to the provisions of Section 9.202
and Section 9.203 hereinabove nentioned as well as subject to the conditions
hereinafter stated, the Village hereby authorizes and grants the
Metro}X>litan Sanitary District of Greater Chicago (hereinafter referred to

as "Sani taIy Dis trict"), a license to construct, reconstruct, repa1.r,

maintain, .and operate an Intercepting Sewer in the locations and in
accordance with the plans and specifications therefor as set forth in
Contract 73-314-2S for the Upper Des Plaines #22 interceptor sewer, a copy
of which plans and SPeCifications are filed with the Village engineer in

Contract 73-314-2S (which interceptor sewer shall be referred to hereafter
as the "Intercepting Sewer"), upon, under and through those certain streets,
highways, public right-of-way, and public easements of the Village of Mount
Prospect, (hereinafter referred to as "The Village") within the territorial
lirni ts of The Village traversEd by said Intercepting Sewer, which rights-of-
way within said territorial limits are shovm u}X>n a ma.p attached hereto and
hereby made a part hereof as Exhibit "All

1I11 A. The Sanitary District shall not move, remove, relocate,
ternp:::>rarily disconnect or disturb in any manner any steet
I lights, street signs, traffic signals, police or fire alarm
I. equipnent, fire hydrants, underground Village o\'med or operated
I facili ties, including, but not lirni ted to water lines and other
ill' water systan facilities and storm water drainage facilities,
i I wi thout first obtaining the written approval of the Village
I i Engineer who shall, if he deans it necessary, require the
II Sanitary District to subnit plans and specifications for his
II review, which plans and sped.fications .the Srtnitary Djstrict
II sl}alJ sul:::mit. If the Village Engineer approves any oanitary
Ii District's requests or plans to move, rerrove, relocate, dis-
1'1 connect tanporarily or disturb the facilities hereinabove
indicated, the Sanitary District shall pay any and all costs
II and expenses connected therewith.

SE.X:TION 'lW):
The license hereby granted to the Sanitary District
B.
The Sanitary District shall install and maintain along the
construction route of the Intercepting Sewer any and all
barricades, lights, signs and signals which will insure the
heal th, safety and convenience of the vehicular and pedestrian
traffic in the vicinity of the construction route of the Inter-
cepting Sewer.
c.
The Intercepting Sewer of the Sanitary District shall be con-
structed, reconstructed, repaired, and efficiently maintained
and operated solely by the Sanitary District at its sole
expense and cost; and the Village shall not be held responsible
in any manner for the location or manner of construction,
reconstruction, repair or operation of the same.
D.
The Sanitary District shall defend, protect, indEmnify, keep
and save and hold harmless the Village, its Mayor, Trustees,
officers, agents, employees, contractors and subcontractors
and/or their employees against all claims of any kind or
nature whatsoever, including, but not limited to, damage to
real and personal property as well as against any and all
personal injuries, deaths, liens, suits, liabilities, judgments,
costs, expenses, and attorneys' fees suffered and/or incurred
by the Village, its Mayor, its Trustees, its officers, its agents,
its anployees and/or any person, which claims, injuries,' deaths,
losses, darrages, liens, suits, liabilities, judgments, costs,
expenses, and attorneys' fees may directly or indirectly be
incurred, suffered, and/or arise by, from or in connection with
the construction, reconstruction, repair, maintenance, and/or
operation by the Sanitary District of the Intercepting Sewer.
The Sanitary District shall defend, indEmnify, and hold the
Village, its Mayor, its Trustees, its agents, its employees,
its contractors and subcontractors, its officers and/or its
citizens thereof harmless from any and all liability, cost, or
expense resulting from the failure of the Sanitary District
to keep and perfonn the foregoing covenant.
E. Subject to the approval of and acceptc.1l1ce by the Village
Engineer, the Sanitary District shall, at its own cost and
expense, repair, replace and restore, any and all streets,
alleys, highways, sidewalks, walks, curbs, crosswalks, gutters,
catch basins and ditches and any and all structures, shrubs,
trees, grass sod or any other propertY or facility of any type
or nature whatsoever which the Sanitary District destroys,

damages, disturbs or interferes within the construction,
maintenance, repair or operation of the Intercepting Sewer
wi:thin thirty (30) days of the date such construction,
ma.intenance or repair of the Intercepting Sewer is completed;
provided, however, that any repairs to or replacement and
restoration of Village water lines shall be completed as soon
as practicable after such repair, restoration or replacement
becanes necessary as deteJ::mined by the Village Engineer. The
Sanitary pistrict shall maintain at its own cost and expense,
any repair, replaCEment and restoration made in accordance
with this Section 2E of Resolution No. 16-79 for a
period of t:'M:> years following the canpletion of such repair,
replacement or restoration. If the Sanitary District fails
to canpl y with the provisions of this Section '&0 E wi thin
the time specifiErl, the Village shall have the right to repair,
restore and replace any and all property or facilities damaged,
destroyed, disturbed or interfered with by the Sanitary District
and backcharge the Sanitary District for any and all costs and
expenses incurred by the Village in connection therewith. The
Sanitary District shall pay such backcharges within ten (10)
days of receipt of a bill therefor from the Village.

F.
All surplus excavation material, other s}X>il, debris, construc-
tion equipnent and any and all other rEmains frcm the construc-
tion of the Intercepting Sewer shall be rEmoved by the Sanitary
District from property locatErl wi thin the Village wi thin seven
(7) days after construction of the Intercepting Sewer is
<XJrnpleted. If the Sanitary District fails to so rerrove said
material and equipuent with the time specified, the Village
shall have the right to ranove said ma.terial and equipnent and
backcharge the Sanitary District therefor for any and all costs
and expenses incurred by the Village in connection therewi tho
The Sanitary District shall pay such backcharge within ten (10)

At all times during construction of the Intercepting Sewer, the
Sanitary District shall maintain one unobstructed lane in each
direction for moving traffic, which lanes shall be kept free
of any mud, dirt or other debris.
H.
The Village does hereby order and direct all persons, partner-
ships or corporations which shall at the time of the construc-
tion of the Intercepting Se-wer awn, operate or maintain any ,
conduits, wires, p::>les, pipes, natural gas lines, cables,
electrical wiring, and any and all other equipnent or other
structures wi thin any fOrtion of the streets and public highways
to be excavated during the construction of the Intercepting
Sewer at his, its, or their own 'expense, to make such changes
in the location of such conduits, wires, fOles, pipes, gas
mains and cables, electric, and equipnent or other structures
as may be rendered necessary by the construction of the Inter-
cepting Sewer.
1. The Sanitary District and its contractors are hereby given and
granted the right to use in the construction of the Intercepting
Sewer such motor trucks, excavators, hoisting engines, and other
plant equipnent arrl ma.terials as may be necessary for the
canplete construction of said v;ork; provided, however, that such
equipnent and ma.terials shall not obstruct traffic as provided
in Section T\t.u G hereinal:::xJve.
J. The Sanitary District shall sul::mi t any and all revisions, nodi-
fications and changes to the plans and specifications for the
Intercepting Sewer to the Village Engineer. No v;ork shall be

done by the Sanitary District in accordance with such revised
plans and specifications until such plans and specifications
have been reviewed and approved in writing by the Village
Engineer .
K. The Village shall give, grant, and issue without fees or cost
therefor, to the Sanitary District or to any contractor to
whcmthis v;ork or any part thereof specified in this Resolution
shall be awarded, all permits or licenses required for doing
said v;ork u}X>n application and shall not require the Sanitary
District or its contractors to de}X>si t any sums of money
required under any ordinance of the Village for similar work
and, further, shall not require the payment by the Sanitary
District of any fees or salaries for inspectors employed by
the Village on said v..Drk. Water should not be furnished the
8 ani tary District or any contractor to '\--mom said v;ork or any
part thereof shall be awarded, unless and until construction
meters have been paid for by the Sanitary District and then
all water needed in the performance of said VoDrk shall be paid
for by the Sanitary District at the then regular rate charged
by the Village to its consumers, all said water to be measured
through meters furnished as aforesaid by the Village at the
expense of the Sanitary District or its contractors.
SECTION FOUR: That this Resolution shall be in full force and
its passage and approval in the manner provided by law
acceptance of the provisions of this Resolution by the Sanitary
