Gentlemen: Pursuant to a motion previously passed at a recent meeting of the Board of Trustees, I take pleasure in appointing the following citi- zens to the Citizens Committee on Building Code Revision: James E. Appleby Village Manager Municipal Building Mount Prospect, Illinois Dear Mr. Appleby: In accordance with a request made by the Village Board, we have in- spected the existing sidewalk on the east side of Elmhurst Ave. bet- ween Shabonee Trail and Pine Street. September 25, 1956 ("") .,,1 Wi" LA. t_J ~.r,i Our inspection indicates that 498 square feet of the existing seven foot sidewalk is presently serviceable; 3,890 square feet of the e- xisting seven foot sidewalk is not serviceable inasmuch as it is broken and cracked; 996 square feet of the existing seven foot side- walk is not now serviceable due to settlement that has occurred ad- jacent to the curb. We find that approximately 230 square feet of the existing five foot sidewalk, which was recently constructed by the builder, is serviceable but its grade does not match the adja- cent 7' sidewalk. Approximately 25 square feet of the recently in- stalled five foot sidewalk is not serviceable. We have been asked to consider the advisability of jacking, that por- tion of the sidewalk which has settled, to the proper grade and pack- ing sand beneath the walk to maintain said grade. Because the settle- Ment has occurred adjacent to the curb, the procedure of packing sand beneath the raised sidewalk would be extremely difficult and, for this reason, we would not consider this procedure good construction prac- tice. Our estimate of cost for placing the sidewalk in consideration in acceptable condition is as follows: 4,911 S.F. Sidewalk Removal @ $0.25 $1,227.75 4, 911 S.F. 51t Sidewalk Replacement @ 0.55 2,701.05 92 S.F. Additional 51t Sidewalk @ 0.55 ~.60 Total Estimated Cost 3,979.40 We have also prepared and present herewith an estimate of cost to com- pletely remove the existing seven foot walk along the curb and to con- struct a new five foot walk in a conventional location one foot street- ward from the property line. This estimate is as follows: 5,639 S.F. 4,000 S.F. Thereupon the President declared the motion defeated. A motion then made by Trustee Wier, seconded by Willer, that the builder, Mr. DiMucci, be permitted, in lieu of restoring the existing curb sidewalk along the east side of Rt. 83 between Shabonee Trail and Pine Street, to construct a 5 foot parkway side- walk at the builders option. Gen tlemen : This is to confirm the agreement reached at a meeting held on Sep- tember 13, 1956, whereby we agreed to dedicate ten acres of usable land to the Village of Mt. Prospect, Illinois Dear Mr~ Willer: I have examined the communication from Hatlen Construction Co., Inc. with respect to their promise to dedicate ten acres of land for public use in connection with subdivision of lands and I wish to ad- vise as follows: The only certainty of performance, of course, is by a dedication of lands on a plat. This communication, while not an agreement in the legal sense, is a committment to perform as therein stated and I believe it would be enforceable in the event that it would become necessary to litigate the matter. <JI'::t.~ --. It would appear that if the plat of subdivision were approved con- tingent upon this committment, that the good faith of the Hatlen Construction Co. Inc. should be considered and I find it necessary to leave that to the judgment of the Village Board. A motion then made by Trustee Willer, seconded by Wier, that the President and Village Clerk be authorized to sign the plat of Subdivision of Hatlen Heights, 4th Unit, upon condition that 11 lot~ in said Subdivision, being lots 56, 57, 58, 59, 60, .61, 62, 85, 86, 87 and 88 of Hatlen Heights Unit No.4, a Subdivision of part of thE Northeast QUarter of Section 10, Township 41 North; Range 12 East oj the Third Principal Meridian, in Cook County, Illinois, be conveyed to Chicago Title and Trust Company as Trustee, pursuant. to a trust agreeMent to be executed between Hatlen Construction Co., Inc., and the Village of Mount Prospect, to be held as an escrow for a period of 6 months; the said 11 lots shall then be conveyed to the Village or, by its direction, to some pUblic body, or if the Hatlen Con- struction Co., Inc., is prepared to convey 10 acres of useable land for pUblic uses, then in that event the said 11 lots are to be con- veyed to Hatlen Construction Co., Inc. and said 10 acres to be con- veyed to the Village or its nominee, the provisions hereof to be in. corporated in an ordinance. Prospect Dear Sir: Following our letter or August 4, 1956 regarding the proposed revi- sion of the "B" Zoning Ordinance, --chierly to provide for off-street parking, the Commission realizes that so comprehensive.a revision will take time and much study. Meanwhile traffic' conSestion will con- tinue to plague the Village from those who improve property classi- fied as liB". We have a suggestion to cope with this problem. Attach to the present Ordinance (while awaiting the revision) a sti- pulation that a portion of the entire lot, expressed in percent of the lot area, is to be used for off-street parking. This could be made to apply to all except the old 25 foot lots. A separate sti- pulation, perhaps with a less stringent percentage could be made to apply to those lots. We, of the Commission, believe that with such an addition to the pre- sent "B" classification use of the Village streets for parking could be effectively handled. E. President Lams appointed Trustee Willer to investigate the acquisition of lots in Weber's Industrial Addition for parking lot purposes. September 25~ 1956 A motion was then made by Trustee Viger, seconded by SchlavE that the Metropolitan Sanitary District of Greater Chicago, Permit No. 1956-155, for Funk's Mount Prospect Gardens, be accepted and th~ the President be authorized to sign this permit on behalf of the Village. The President put the question, the Clerk pro-tem called roll with the following response: Ayes: All; Nays: None. Thereupon the President declared the motion carried. A motion made by Trustee Willer, seconded by Viger, that thE President be authorized to sign an application to the Metropolitan Sanitary District of Greater Chicago, for a permit for a sewerage system for the High School being built in M~. The following communication was then read: September 20, 1956 '<~~ Mr. H. G. Appleby, Village Manager, Village of Mt. Prospect 112 East Northwest Highway, Mt. Prospect, Illinois. Dear Mr. Appleby: ~.",~ ,::i~; Re: Prospect High School The Board of Education of Township High School District Number 214, Cook County, Illinois, has instructed us, as its counsel, to take whatever steps are necessary to arrange for the connection of the sewer servicing the new Prospect High School site. The legal de- scription of this site is as follows: "The Northeast q,uarter (NEt) of the Northeast quarter (NEt) and the North Half (N-l/2) of the Southeast quarter (SE-l/4) of the North- east quarter (NE-l/4) of Section 33, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois." We understand that since this site is now part of the Village of Mt. Prospect, action with regard to securing necessary permit from the Metropolitan Sanitary District of Greater Chicago must come from the Village of Mt. Prospect. Unfortunately, at the present time the site, while adjacent to the territory of the Sanitary District, is not part of it. It will be- come a part of the District if the election on the subject is carrie on November 6, 1956. If the election fails, then action by the Legi slature will apparently be required. Therefore, on behalf of the said Board of Education of Township Hi~ School District Number 214, Cook County, Illinois, we hereby request that the Village of Mount Prospect take such steps as are required to obtain permission for connection of the said sewer. In the event the election fails this fall, we also request that such steps as necessary on behalf of the Village of Mt. Prospect be taken to see that the above school site is annexed to the said Sanitary District. Your cooperation in the foregoing will be greatly appreciated. Very truly yours, William R. Ingelhardt.
