No. 1956-216 be accepted and that the Village Clerk be authorized t<
sign the permit on behalf of the Village. The President put the

A motion was made by Trustee Wilson, seconded by Airey, to
accept the Metropolitan Sanitary District of Greater Chicago, permi1
No. 1956-143, covering Frank Serafine's 1st Addition, and that the
Village Clerk be authorized to sign this permit on behalf of the
Village. The President put the question, the Clerk called the rollJ

Gentlemen:
The Zoning Commission held their September public hearing on the 281
day of the month. There were three members present. Proof of ownel
ship by the petitioners was acceptable in all cases heard.
Case 56-17
This case involves lots 8, 9, and 10 on the west side of Emerson
Street between Central Road and Busse Street. These are the re-
maining lots between the school property and the Library. Also lotf
4, 1, 5, and 6 on the west side of Emerson Street between the Gas
Station on the Highway and Busse Street. They all are petitioned fc
rezoning from R-l to B.
Due to legal complications, the Commission voted separately for the
property north and south of Busse Street. The Commission voted 3 t<
o to recommend denying reHoning of the lots north of Busse Street;
and voted 3 to 0 to recommend the rezoning to B of the lots south
of Busse Street.
It developed during the hearing that lots 8 and 9 are presently in-
volved in Condemnation Proceedings in the courts. Consequently, thE
Commission felt that prior to the results of the court case, action
on lots 8, 9, and 10 would be inadvisable.
The Commission felt that the lots south of Busse Street would be a
desirable and well planned expansion of the Village's centra,l busi-
ness district. Our recommendation is in accordance with the sug-
gestions of the Plan Commission.

This is one lot on the north side of N.W. Highway between Will:5.8m
and Louis Streets. It is petitioned for a B classification.
The Commission voted 3 to 0 to recommend a B classification.
The lot in question is one of the old 25 foot lots, and is bet-
ween existing B classifications.
Case 56-19
This case involves two lots on N.W. Highway between George and
Albert Streets. They are petitioned for B classification.
The Commission voted 3 to 0 to recommend a B classification.
The lots in question are old 25 foot lots, and are between exist-
ing B classifications.

Dear Mr. Martin:
In your undated letter of recent date referring to the public
hearing held on the 28th day of September, 1956, you refer to Case
56-15 as follows: "Due to legal complications, the Commission
voted separately for the property north and south of Busse Street.

of Busse Street would be a desirable and well planned expansion of
the Village's central business district.---"
In order for the Village Board to reach a satisfactory conclusion
on your recommendations, it is necessary that we ask you one im-
portant question: Does the Commission feel that, were there, in
its opinion, no "legal complicationslt pertaining to the property
north of Busse Street, would the Zoning Commission then feel that
the property in question north of Busse would also be itA well
planned expansion of the Village's central business district?"
This letter is being sent to you through the courtesy of Mount
Prospect Police Department so that you can have an answer in my
hands for the Village Board Meeting on October 2nd.

Dear Mr. 'willer:
Referring to our letter of recommendations of the September hear-
ing of the Zoning Commission, and your letter of October I, 1956,
the Zoning Commission is of the opinion (3 to 0) that the three
lots in question north of Busse Street should be considered as a
single parcel, and should be zoned B. We made no recommendation
because we feel that in the event that the Court permits the con-
demnation of lot 8 the Village should take no action regarding lot
9 and lot 10; that the school district be urged to acquire all
three lots.

Gentlemen:
I have been advised that the Mount Prospect State Bank has filed an
application to amend the zoning ordinance of the Village of Mount
Prospect by reclassifying the following described property from re-
sidential to commercial:
Lots 8 and 9 in Block 4 in Busse and Willets Resubdivision
of Mount Prospect, in the West 1/2 of Section 12~ Township
41 North, Range 11, East of the Third Principal Meridian
in Cook County, Illinois.
As you may know, this property is presently being utilized by the
Board of Education of School District Number 57, Cook County, Illi-
nois, for school purposes and a petition to condemn 'lot 8 thereof hl
already been filed in the Circuit Court of Cook County, Ca'se No. 5~
C 12979. A resolution to condemn Lot 9, if it cannot be acquired b~
purchase from the Mount Prospect State Bank, has been adopted by thE
Board of Education and an offer served upon the Bank. In the event
this lot cannot be acquired by purchase a condemnation proceeding
will be filed forthwith.

In view of the foregoing I am writing to request that any action in
connection with the reclassifying of this property be deferred.
Prior comrrdtments do not permit my being present to make this requel
However, I cannot see that there is any urgency about the petitioneJ
application and since the Board of Education in its opinion finds
these lots necessary for school purposes it would be appreciated if
no further action was taken at this time.

Gentlemen:
It has been brought to my attention that the Village Board is being
asked to approve a plat of sub-division covering the area at the
October 2, 1956
Southwest corner of Lonnquist and WaPella Avenues. For some time
the Board of Education, School District 57, bas been attempting to
acquire a school site in the area covered by the proposed plat. In
fact, a condemnation sui~-has been instituted for this purpose. The
Board of Education has been advised by Mr. Allan Block on behalf of
Mr. Sal DiMucci that the owners of the property are willing to work
out with the Board of Education the acquisition of a suitable school
site in this sub-division. Upon questioning, Mr. Block stated that
there have been no changes in ownership status which would affect
the willingness of the owners to sell a portion of the proposed sub-
division to the school. The Board of Education has therefore en-
gaged an appraiser to make a thorough appraisal of the value of this
property, and plans to enter into discussion with the owner rela-
tive to purchasing the site in question as soon as it has received
this appraisal.
For the above reasons, it is hoped that action on the proposed plat
of sub-division may be postponed until a solution to the school
site question is reached.

SIGNS: DEFINING PARKING METER ZONES AND PROVIDING FOR THE ENFORCE-
MENT AND PENALTY FOR VIOLATION THEREOF" be passed. The President
put the question, the Clerk called the roll, with the following
response: Ayes: Trustees Airey, Viger, and Wilson. Nays: Trustees
Wier and Willer. Absent: Trustee Schlaver. President Lams then
voted "Aye" and declared the motion passed and said ordinance
passed and approved.

Gentlemen:
It has been brought to the attention of the Board of Education,
School District Number 57, that a request has been submitted to
the Village for approval of a sub-division at the Southwest cor-
ner of Lonnquist and WaPella Avenues. It is our understanding that
the developer is proposing to dedicate land along Central Road,
west of Weller Creek in lieu of making a dedication at the site of
the sub-division. I am sure that your Board is aware that there
is a substantial difference in the value of the land in the two
areas and will take that into consideration in determining the size
of the area to be dedicated, if the dedication is made outside the
area of the sub-development.
The Board of Education is attempting to acquire a school site in
the area covered by the proposed sub-division, and respectfully
requests that that fact be taken into consideration in consider-
ing the proposal of the developer. If, in your opinion, it would
be helpful, we would be happy to meet with you at any convenient
time in order to keep you informed of the schools needs, so that
the land dedicated for public purposes may be the greatest posm-
ble help in meeting public needs.

The Board of County Commissioners on August 7, 1956, passed a Reso-
lution concerning Shopping Center Regulations. Wa enclose a copy
of this Resolution for your information.
Please note the action of the Board relates only to the unincorpo-
rated areas insofar as permits, etc., are concerned. However, therE
are many State Aid roads in Cook County located within the corpo-
rate limits of the many cities and villages. We enclose a map show.
ing these State Aid roads under the jurisdiction of the County of
Cook located in your Village.

We submit this information to you for the purpose of coordinating
the pUblic efforts in proper traffic control measures resulting fro!

A motion made by Trustee Airey that the Berkshire Lane side-
walk escrow in the amount of $1,324.00 be refunded subject to appro-
val by Village Engineers of sidewalks covered by this escrow. Aftel
some discussion on this matter, the motion was withdrawn.
A motion then made by Trustee Airey, seconded by Willer,
authorizing the Village Manager to engage Milburn Brothers to black-
top and make concrete entrance adjustments for the railroad proper-
ty parking lots, the amount of the contract to be $8,245.00 with the
understanding that payment is to be made when the,meter revenue bone
are sold. The President put the question, the Clerk called the rol]
with the following response: Ayes: All; Nays: None. Thereupon the
President declared the motion carried.
A motion then made by Trustee Viger, seconded by Willer, to
authorize partial payment No.2, final, in the amount of $14,966.80
to Archille, Scully & Son covering Highland Avenue feeder main, con-
tract No.4, and as recommended by the Village Engineers. The Pre-
sident put the question, the Clerk called the roll, with the follow-

Gentlemen:
October 2, 1956
The plans for the above referenced project provide for the construc-
tion of an 8" water main, with appurtenances, which will tie in to
an existing 8" water main in Northwest Highway.
Before the contractor can perform this construction in the North-
west Highway, which is State right-of-way, a resolution must be
passed by the Village Board and conveyed to the Illinois Division
of Highways, which relieves the State of any responsibility in con-
nection with the installation, operation and maintenance of this
water main. Therefore, we are transmitting herewith two copies of
the appropriate resolution on the standard form provided by the
State. This resolution should be passed by the Village Board and
certified by the Village Clerk and then one copy should be made
available to the contractor, Joe Pezzette Company, who shall con-
vey this resolution to the State when applying for an Illinois
Division of Highways construction permit.
If there are any questions regarding this resolution, please
advise.

A motion was then made by Trustee Airey, seconded by
Wilson, to authorize the hiring of another Police Officer to start
employment October 15th. The President put the question, the Clerk

Thereupon the President declared the motion carried.
A motion made by Trustee Willer, seconded by Airey, to
authorize the,attendance of Messrs. Appleby, Hinz, and Miller, at
the annual convention of the Illinois Municipal League to be held
in Springfield, Illinois, on November lIth, 12th, and 13th, and
that their expenses be paid by the Village. The President put the
question, the Clerk called the roll, with the following response:
Ayes: All; Nays: None. Thereupon the President declared the motion
carried.
A motion made by Trustee Willer, seconded b:l Wier, to
authorize the expenditure of $1,264.50 for proposed furnishings
to be used in the revamped Council Chambers making this space avail-
able for the Village Manager and the Building Department.
