SUBJECT: Zoning Board of Appeals Hearings
Robert J. Zima - 201 N. Maple st.
Thomas P. Miller - 122 N. Maple St.

Gentlemen:
~~
Public hearings were held Saturday November 24, 1956, on
petitions of the two subject residents regarding requests for
granting variations to permit less than required 20 ft. setbacks
for garages to be built at the addresses shown.
In the Zima case it was very apparent that our Building
Department through an oversight, had allowed work to be started
and then issued a stop order. Because of expense to petitioner,
and hardship that would be incurred the Zoning Board of Appeals
voted unanimously (five members present - two absent) to grant
a variation and allow a 10 ft. setback instead of 20ft. as calle
for in the Zoning Ordinance.
In the Miller case it was the Zoning Board of Appeals'
unanimous opinion that to refuse a permit, unless the 20 ft.
setback was adhered to, would cause a hardship and the
circ~tances; size of lot etc; warranted granting a variation
, to allow the garage in question to be built at a 10 ft. setback,
but not less than house setback. The five members present voted
unanimously to allow construction with 10 ft. setback.
After the public hearings on the above cases and based
on discussion with Mr. Wax, Chairman of Architectural Committee
and Mr. Appleby, Village Manager, the five members present voted
unanimously to call to the Village Trustees' attention the out-
moded Sectiona13 and 16 of our present Zoning Ordinance which
tend to create hardship cases when building on older narrow lots
that presently exist in the Village and to suggest study' by
Trustees toward possible revision of these sections to cover
older lots.
