approve applications of Town Development Company for three
signs located on Cathy Lane between Central Road and Busse
Avenue. The President put the question, ilie Clerk called the

the President declared the motion defeated.
Trustee Willer then introduced Ordinance No. 533 en-
titled "AN ORDINANCE AMENDING,ENAGTING, CODIFYING AND CONSOLI-
DA'lIING THE BUILDING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT,
ILLINOIS.tI A motion was then made by Trustee Willer, seconded
by Wier, that this Ordinance be passed. The President put the
question, the Clerk called the roll with the following responsE

motion carried and said Ordinance passed and approved.

Wier, that a price of $2.00 we charged for the 1957 Mt. Prospeci
Building Code, as printed. The President put the question, the

A motion made by Trustee Willer, seconded by Viger,
that Sanitary District Permit No. 1956-270 be accepted and
that the Village President be authorized to sign the permit on
behalf of the Village. The President put the question, the
Clerk called the roll, with the following response: Ayes: All;
Nays: None. Thereupon, the President declared the motion
carried.
There being no further business to come before ilie

The meeting was called to order by President Lams at
8:25 P.M. and the Clerk was then directed to call the roll.
On roll call the .following Trustees answered "Present":
Schlaver, Wier, Willer and Wilson. Trustees Pirey and Viger
were absent on roll call.
The Trustees,having previously been given copies of the
minutes of the meeting held January 2, 1957, a motionVJas made
by Trustee Willer, seconded by Schlaver, that the minutes be
approved as submitted. The President put the question, the Cler
called the'roll, with the following response: Ayes: All; Nays~
None. Thereupon the President declared the motion carried.

To The Village of Mt. Prospect:
We would like to bring to your attention the need of a four-way
stop sign at Evergreen and South Elmhurst Ave., also the inforce-
ment of the posted speed. We have many young children on this
street, and the trucks that use this street to by-pass the Village
seem to out-number the cars. They are causing a lot of damage
to the street. These are not light weight trucks. The gravel
and cement trucks are going by in a steady stream. Also big
trucks hauling Trailers loaded with maChinery. Who will have to
pay when the street goes to pieces?
We also have a school located on this street and that means many
small children walking to and from school.
If we wanted a home on a truck route we would have bought one
there. We have a big inves~nent in our homes, but we have a
bigger investment in our children. So help us keep our children
alive.

A motion was then made by Trustee l'llller, seconded
by Schlaver, that the Village Attorney be authorized and instructed
to prepare an ordinance prohibiting through truck traffic on Wille,
Pine, Elmhurst, Ioka, HiLusi, between Prospect Avenue and Lincoln
Street and on WaPella from Central Road to Lincoln street. The
President put the question, the Clerk called the roll, with the
following response: Ayes: All; Nays: None. ThBreupon the president
declared the motion carried.
A motion w as then made by Trustee Schlaver, seconded
by Wier, tha.t the Village Attorney be authorized and instructed to
prepare an ordinance providing for four-way stop signs at the
Evergreen Avenue and South Elmhurst Avenue intersection.
A motion was then made by Trustee Willer, seconded
by Wier, that the preceding motion be tabled and referred to
committee for study and reconL~endations. The President put the

The writer wishes to acknowledge receipt of your letter of
January 3rd, 1957.
Be assured that we feel that we have a moral obligation to
fulfill your request for a contribution of $300.00 to your
school system for each home in our subdivision. However, our
stock-holders do not feel that these monies should be paid out
of invested capital, but that such contributions should be
paid from profits, when realized.
In our bvsiness, profits in a development, requiring such largE
working capital, are not forthcoming until the project is
either completed, or very close to completion. In fact, the
hard money market, of which you are no doubt aware, has
necessitated additional investment on our part, which we did
not anticipate.

The increased cost of construction, exhorbitant V. A. dis-
counts, unlooked for competition from new developers in Mount
Prospect, who to the best of our knowledge, have not been
called upon, or who have not agreed to school contributions,
and additional charges paid to the Village, which were
originally not considered, have added to our costs.

Application for Public Service Company
for Variation of Residence Zonin~.
Gentlemen:
Pursuant to due public notice, the Zoning Commission of Mt. Prospect
did, on December 28, 1956, conduct a public hearing into the merits
of the application of the Public Service Company (a division of
Commonwealth Edison Company) for a variation in the residence zoning
of the property loca~d on the west side of Mt. Prospect Road, 134
feet north of the intersection of Northwest Highway and Nt. Prospect
Road, so as to permit the installation and operation of an electrical
distribution center or substation on said site.
In attendance at said meeting were Mr. Ralph Brow~,representative
of the Public Service Company, four abutting property owners who
were objecting to the application, Mr. Eugene Martin, Chairman of
the Zoning Commission, and myself. .
The petitioner and objectors were informed that a quorum
Commission was not present, whereupon the petitioner, at
suggestion of the Commission, requested that the hearing
before the two members of the Commission in attendance.

1. That the property in question is composed of two lots having a
total frontage of 13L,. feet on lit. Prospect Road and having an approx-
imate depth of 162 feet; that the southermost lots is triangular in
shape.
2. That the property immediately to the south of said property is
zoned llbusiness" and used as a gasoline filling station. That the
property to the north of said property is substantially vacant, but
that there is a new residence under construction four or five lots to
the north of said propert;)T. Tha t t he property to the west of said
property is built up with residences. That the property to the
east of said property is being developed with scattered residences.
3. That the Public Service Company has made an exhaustive survey
of future electrical rieeds of the eastern portion of Mt. Prospect
and the Cumberland area of Des Plaines, and from said survey has
determined that an electrical distribution center is needed in the
vicinity of the instant property to anticipate future residential
growth as well as growing demands of the existing residential
community.
4. That the real estate department of the Public Service Company
has sought sites south of the Chicago, Northwestern Railroad in the
vicinity of the property in question, but that said sites are either
unsuitable or unavailable. That they have sought sites north of
Northwest Highway in the comrnercially zoned area bordering on North-
west Highway, but that they have decided against such sites for the
following reasons:

(a) That the 120 foot depth of said lots would not be adequate
for the best engineering design of their equipment.
(b) That they would prefer not to interrupt the continuity of
comraercial development as it progresses along the highway.
(0) That the cost of acquiring said property would be from two
and one-half' to three times what t hey are paying for the
instant property, and that the said additional cost would
eventually have to be reflected in their rates.
5. That the proposed distribution center would be of con-
ventional metal design and stand about nine feet in height;
that it would accupy a small portion of said site and be
located in approximately the middle of said site. That the
entire periphery of said site would be enclosed with a six
foot cyclone fence, topped with strands of barbed wire, and be
landscaped by professional landscapers.
6. That the Public Service Company has explored the poss-
ibility of submerging the equipment, enclosing it in a brick
enclosure and fencing it with a solid wall, but that said
possibili ties he.ve been ruled out as impractical and un-
desirable.

7. That the four objectors represent twenty percent or more
of the abutting or adjoining property, and that they filed a
written objection to the variation requested by the applicant.
That they expressed the willingness to withdraw such objection
if they themselves were satisfied that the Public Service
Company had e~~austed their search for available and suitable
property, but not formal withdrawal of the objection was made
at the time.
8. That the objectors feel that the variation requested, if
granted, will encourage the development of comraercial areas
along the west side of Mt. Prospect Road, since adjacent
property owners will not be able to sell residential lots with-
in sight of the electrical distribution center.
9. That the objectors further feel that the erection of such
equipment will mar the aesthetic values of the area and thus
have a generally depreciative effect on the area.
After a full and thorough examination of all facts, the Zoning
Commission recommends that the variation be granted .for the
following reasons:
1. That there is a real need for an electrical distribution
center in the vicinity of the site and that the Public Service
Company has eY~austed all possibilities of locating said
electrical distribution center in other areas near the site in
question.
2. That the public interest and welfare and especially public
interest and welfare of the Mt. Prospect comraunity will be
served by the location of an electrical distribution center on
the site in question.
3. That shouldhhe Zoning Comrrlission deny the variation, the
petitioner would be forced to seek other sites which would be
more costly to it both in terms of land acquisition cost and
machinery cost. That the additional cost would not only be a
hardship to the petitioner, the Public Service Company, but it
would also be a hardship to the public in general, since the
cost would be passed on to the public with increased rates.
4. That the trianb~lar shaped lot in question is undesirable
for residential development.
5. That the presence of a newly constructed house four or
five lots to the north of the property in question prevents
the growth or stimulation of a corM1ercial area in the vicinity
of the property.
6. That the Public Service Company has made sincere efforts
to mask the undesirable features of their equipment.
7. That the highest and best use of the instant property from
a community point of view lies in its development with the sub-

After a thorough discussimn onthe preceding con~un-
ication from the Zoning Commission during which time comments
were heard from residents adjacent to the site in question and
Mr. R. J. Seitz, District Superintendent of Public Service
Company, a motion was made by Trustee Willer, seconded by
Schlaver, to concur in the recommendations of the Zoning
Commission. The President put the question, the Clerk called
the roll, with the following response: Ayes: None, Nays:
Trustees Schlaver, Viger, Wier, Willer and Wilson. Absent:
Trustee Airey. Thereupon the president declared the motion
defeated and the petition for variation denied.

Gentlemen:
It has come to our attention that the Firemen of the Village of
~1t. Prospect do not intend to sponsor a carnival this year or
for years to come. Due to this fact, we of Prospect Post 1337
would like to sponsor one yearly.
In the past, we have always alternated with the Firemen, in other
words, we would sponsor a carnival one year and the Firemen would
sponsor it the next, etc. Henceforth, our above request.
We plan to have these carnivals on our Club House Grounds at 601
North Main street which we consider more than adequate for such an
affair. Storage, ground area and wash room facilities will not
be a problem at all, for this we have.
The date .for the carnival would be the smae as it would have
been for the Firemen, June 13, l~_, 15 and 16, (Thursday thru
Sunday) 1957.
An early reply would be appreciated for booking dates with the
amusement companies have to be made approximately five months in
advance.

Viger, that the Mt. Prospect Volunteer Fire Department be per-
mitted to hold their carnival on June 13, 14, 15 and 16, 1957 in
an area as approved by the Village Board of Trustees and in the
event the Firemen do not elect to hold the carnival, that the
VeDerans of Foreign Wars be granted this perraission. The President
put the question, the Clerk called the roll, with the following

the motion carried.
A motion made by Trustee Wier, seconded by Willer, to
grant permission for removal of the sign at 605 West Central Road,
this sign to be re-erected at the southeast corner of Central Road
and We-Go Trail, and for the erection of a new sign at the south-
west corner of Cathy Lane and Central Road. The President put the
question, the Clerk called the roll, with the following response:

We have made a final inspection of the sanitary sewer~, storm
sewers, water mains, and paving improvements in the subject
development, constructed by Joe B. DiVito and Company and
Skokie Valley Asphalt Company for Mr. Theodore C. Moehling.
We wish to advise you that we have found the work to have been
completed in substantial conformance with the plans and
specifications previously approved by the Village and recow~en(
therefore, that these improvements be accepted by the Village.
"As-Built" plans for this project were forw~rded to the VillagE
Manager on August 6, 1956.

improvements in Lonnquist Boulevard between Lonnquist Court
and the existing pavement west thereof which has been submittec
by DeSoto B. McCabe and Pssociates.
The revised sketcb, bearing a revision date of December 14, 195
is substantially in accordance with the recor~nendations con-

recommend that this plat be approved by the Village of Mount
Prospect.

Attention: Nr. Theodore A. Lams, President
Gentlemen:
Approximately a year and a half ago I appeared before the
Village Board of Trustees at a regular business meeting and
explained the action that I was then proposing to take to clear
up a situation that was at the time a problem facing tbe
Village of Mount Prospect. I refer specifically to the
property at the southeast corner of the intersection of Council
Trail and Emerson Street, then an unincorporated tlisland"
lacking public sidewalks on two sides and lacking curb, gutters
and paving for a distance o.f 216 feet in the east half of
Emerson Street.
Some time prior to the above described meeting, in a con-
versation with President Lams, I was informed that because of
the public benefit to be derived, I could expect to be re-
imbursed by the Village of Mount Prospect in the amount of ten
percent (10%) of the cost of improvements producing public
benefit.

penditure of $2,052.60 for payments for work and materials

Motion was then made by Trustee Wilson, seconded by
Willer, that the ten percent (10%) public benefit be paid sub-
ject to verification of the cost and areas in question. The
President put the question, the Clerk called the roll, with thE
following response: Ayes: All; Nays: None. Thereupon the
President declared the motion carried.
A motion made by Trustee Viger, seconded by Willer,
that the plat of the proposed Bluett's Fairview Gardens Sub-
division, that is within a mile and a half of the Village
limits, be submitted to the Plan C01YJmission for their study
and report. The motion was voted upon by acclamation, where-
upon the President declared the motion carried.
A motion was then made by Trustee Viger, seconded by
Airey, that the meeting be adjourned until Tuesday, January
22nd at 8:00 P.M. The motion was voted upon by acclamation,
whereupon the President declared the motion carried and the
meeting adjourned.
