me to advise you that, upon adoption of an ordinance by the
Board of' Trustees of' the Village of' Mt. Prospect, vacating so
much of the public street as is encroached upon by the new
post of'f'ice building, Associated Constructors, Inc., will pay
to the Village of' Mt. Prospect, in consideration of said
portion of' the p~blic street, the sum or $525.00, which sum
it believes to be the reasonable value of said real estate.
In addition, Associated Constructors, Inc., agrees to
pay all costs and attorneys' fees in connection with said
vaea tion .
In the event that the Judiciary Commdttee decides to
recommend. the adoption of' such an ordinance, I would
appreciate being advised or the decision in order that I
may arrange to have a check f'or $525.00 deposited with the

Treasurer and with the understanding that attorneys' fees
will be paid f'or by Associated Constructors, Inc. The

SUBJECT: PAY RATES IN 'IRE WATER DEPARTMENT.
After Mr. Collison's death, it was f'elt that the other
two men in the Water Department should be given a chance to
step up, that is Dave, Creamer would be more or Ie ss in
charge of the outside work, and Kenneth Miller, the second
man. It was felt that Miller should be given an opportunity
to learn the meter testing work as soon as the equipment is
received. He already knows the outside work, and could be
pulled f'rom the meter testing in case of an emergency. Two
men have been hired on a probationary a?rangement to learn
the outside work.

Because of the additional responsibilities required of'
Creamer and Miller, it is recommended that their wages be
raised from:

TO: THE PRESIDENT AND BOARD OF TRUSTEES
SUBJECT: TELEPHONE FRANCHISE.

Ordinance No. 370 adopted October 14, 1952 granted the
Illinois Bell Telephone Company a 25 year franchise. Under
the terms of' this f'ranchise the Village was to receive the
equivalent of 19 f'ree telephones. At the present time we
are using the equivalent of 30 telephones.
Af'ter several conferences with the local manager of' the
Telephone Company, it has been tentatively agreed that he will
recommend increasing the amount of' free service to the equiv-
alent of 41 phones, cancelling the present f'ranchise and
entering into a new f'ranchise at this time. The Telephone
Company would like to have a perpetual franchise, whjch was
not recommended by Mr. Opeka after he had studied the proposed
franchise Ordinance.

It is recommended that the old franchise be cancelled
and be renewed f'or 25 years from the present time, and that
the equivalent of 41 free phones be accepted. This in eff'ect,
will mean that the franchise will have approximately 5 years
more to run than the present franchise, had it been allowed
to run out.
There should be an inf'ormal concurrance with this
recommendation and then the Telephone Company will prepare
the necessary documents and present them to the Board for
its final action.
Extending the f'ranchise with the additional f'ree
service will save the Village approximately $88.00 a
month on its present telephone service. It is therefore
recommended that action be taken without any unnecessary
delay.

Gentlemen:
It has been broughtto our a ttention that the Hatlen
Construction Company and Sal DiMucci are about to subdivide
some land ror the construction of' residential houses along
Busse Road, north and south of Golf' Road. This area lies
within School District No. 56 and is adjacent to and within
the one and one-half' miles of your village.
It is also our understanding that you have an Official
Plan giving you jurisdiction with respect to subdivision
plats in an area within one and one-half miles of' the
boundaries of your village.
School District No. 56 is rather small in area and has a
low assessed valuation. It maintains one school house on
State Road near Algonquin Road. The construction of the
proposed homes will create an unbearable situation in that
the existing f'acilities will be wholly inadequate to meet
any sudden increase in enrollment. Our bonding capacity
is practically exhausted and we have no means of raising
funds for the construction or additional facilities and
providing educational requirements.
It is urgently requested that when a plat of sub-
division from either or both of' the above named developers
is submitted to you f'or your approval that you give due
consideration and demand dedication of lands of' school
purposes bef'ore giving your approval, or in the alternative,
such cash consideration as may of'f'-set the land dedication
which could be used to expand or extend the existing
f'acilities. Also, before any action on such plat is taken
by you, perhaps the developers should clear with our board
f'irst.

Gentlemen:
Recently publicity with regard to the Hatlen Heights and
Hatlen Heights Estates subdivisions raise questions as to the
dedication of' land for public use. It is our understanding
that 311 homes are involved in the area north of Lincoln
Avenue and west of Busse Road, which is wi thin school District
#57.
Under Mt. Prospect Village rules with respect to new sub-
divisions, this would require a dedication of' approximately
5 acres. It is rumored that a somewhat similar sized develop-
ment is planned f'or the area south of Lincoln Avenue, which
is within School District #56.
The Board of Education of School District #57 and the
Board of' Directors of' School District #56, have discussed
this matter and believe that the best interest of' the two
school districts would be served in the requirement for
dedication would be handled on the f'ollowing basis:

SUBJECT: STATEMENTS OF THE VILLAGE IN REGARD TO COUNTY
ZONING ADMENDMENT.
A report on this matter has already been made to the
Board. No action was taken but authorization or direction
should be given for filing of a statement on behalf of' the
Village with the Zoning Board of' Appeals.
It is suggested that a brief' letter, substantially as
follows be authorized at the next meeting:
"The Village of' Mount Prospect concurs in the s tate-
ments made by Mr. Paul Fischer of' the Chicago Regional Plan-
ning Association at the hearing held on February 15, 1957 on
the Ordinance to amend the County Zoning Ordinance.
"It is the belief of the Village that the proposed
amendment will create more, rather than less, declaratory
judgements. It is the fUrther belief that suits brought
in regard to variations granted under the proposed amend-
ment might jeopardize the entire Zoning Ordinance.
"Thi s Ie tter is en t at the direction of the Village
Board of' the Village of' Mount Prospect.". .

Rich~_ Doherty, to whom the position of Superintend-
ent of Building was of'fered by the Village Board, has had
dif.ficult;y in making himself available fop tlBt posit:l(_ln.
He has suggested that other applicants be contacted and
if a satisfactory one can be secured before he is avail-
able that he will drop out of the picture.
An application has been received from Kenneth E.
Long who has been City Engineer f'or the City of Ironwood,
Michigan since April 1951. Mr. Long is a graduate of'
Marquette University with a Civil Engineering Degree in
June, 1950. He was born July 19, 1922, is 611u tall,
weighs 190 pounds, is married and has six children. He
was in military service f'rom 1943 to 1946.
November 1950 to April 1951 he was on special assign-
ment with the Lake Superior District Power Company for re-
mapping and distribution system.
In August 1950 to October 1950 he was Field Engineer
wi th the Milwaukee County Highway Department. August 1949
to August 1950, Engineer Aid (Part Time) United States
Department of Agriculture, Soil Conservation Service.
President Lams, Trustees Wier and Wilson were present
when Mr. Long was interviewed. He seems to have an
excellent background and enthusiasm. If he can fi~d
housing, he has indicated a willingness to accept $7500.00
per year plus $300.00 per year car allowance if the
position is offered to him. It is therefore suggested

The proposed plat of Bluett's Fairview Gardens
Subdivision was ref'erred to the Plan Commission f'or study
and report.
The Commdssion requested the suggestions of' Evert
Kincaid and Associates on this plat and a copy of' their
comments is attached.
The Plan Commission concurs in the Kincaid comments,
and a copy of' them has already been sent to R. J. Bluett
& Son.
The Commdssion further recommends that the following
deviations from the Village's Planning Ordinance be called
to the attention of the subdivider:
1. Lots 29, 53, 82, 83, 84, 153, 168, 196,
213, and 214, while not meeting the requirement of' 125'
depth are acceptable because of' their f'rontage and area.
2. The frontage of' lots 96, 112, 136, and 143 be
increased to the minimum of 75'.
3. A 20' right of way for public walk ways be
provided between lots 221 and 222, between lots 179 and
180, and between lots 102 and 103.
4. While the block containing lots 96 thru 112
is 1230' in length and the block containing lots-113, 114,
and 215 thru 229 is 12241; they substantially comply with
the 1200 maximum established ordinance.
5. On the basis 0 f 1 acre per 60 lots, the
dedication f'or public use should be a minimum of 3.816
acres instead of 3.30 acres as proposed.
6. Lots 145 and 147, containing .506 acres be
added to the land dedicated for public use, making a
total of 3.806 acres so dedicated. This would leave
227 lots in the subdivision requiring a minimum dedicat-
ion of 3.784 acres for public use.
7. The tier of lots 19 thru 24 and 30 thru 35
rront on two streets, a practice not permitted by the
planning ordinance.
It is further recommended that the land to be
dedicated f'or public use be located along the east side

of the subdivision for combination with f'uture dedication
from the area immediately east of the proposed plat. ,
It is further recommended that the subdivision
be re-designed.

Gentlemen:
The Zoning Commission conducted their f'irst meeting
of' 1957 on Friday, February 22, at the Village Hall at
8:00 P.M. Four. members of' the Commission were present.
Case 57-1 involved a request f'or rezoning part or
the property on the west side of' Main Street between
Central Road and Henry Street.
Mr. Erwin Hurt presented papers indicating proof'
of' ownership with a Torrence survey of title. Part of'
the property in the location mentioned is now zoned f'or
business. Another section, now zoned f'or residential
usage, is being used f'or business purposes.
The plot submitted by the above mentioned gentleman
covered full territory, indicating one-story buildings
would be erected on about one-third of the area; the
remaining two-thirds would be conf'ined to driveways aqd
parking areas. The plot submitted, however, covered a
portion of' land that was not described in the legal
description of' the property and in the petition for
rezoning. Under the circumstances, we believe that
the decision will have to be withheld until additional
ownership of the full parcel is covered in the March
hearing.
Mr. Hurt stated that the intended use of this
property would be to the best interest of' the village
as we ROW a~' f'aced with a shortage of parking area~
in the shopping center of our community. Property
improvement such as he indicates will not devaluate
the surrounding property - it will be properly land-
scaped and will be designed f'or exits and entrances to
parking areas to af'f'ord best possible saf'ety f'or school
children, and also f'or the elimination of' traf'fic bottle-
necks or slowing down of traf'fic on Main Street.

Each of' these representatives indicated that re-
zoning, as requested, would devaluate their property.
All of them also indicated that they had purchased
homes in the location, believing that the particular
parcel under discussion would remain as residential
property. Some of' those protesting also indicated
that a new shopping area at this location would cause
additional traf'fic problems.
It is the intention or the Zoning Commission to
awai t a further hearing on addi tional property at the
March meeting and then bef'ore making a recommendation
to the Board of' Trustees, we want to discuss the
proposals with the School Board and Chier Wittenberg
of' the Police Department.

notif'y Chicago Title & Trust Company that in relation
to escrow agreement #219295 dated September 25, 1956,
between the Village of Mount Prospect and Hatlen
Construction Company, Inc. that Mr. Robert J. Downing
be substituted as Village Attorney in lieu of' Mr. Frank
M. Opeka and that Mr. Downing, in the case of' Hatlen
Construction Company, Inc. be instructed to take such
legal action as is necessary to protect the interests
or the Village of' Mount Prospect. The President put.
the question, the Clerk called the roll, with the
