Each of these representatives indicated that re-
zoning, as requested, would devaluate their property.
All of them also indicated that they had purchased
home s in the loc a ti on, believing that the parti cular
parcel under discussion would remain as residential
property. Some of those protesting also indicated
that a new shopping area at this location would cause
additional traffic prOblems.
It is the intention of the Zoning Commission to
awai t a further hearing on additional property at the
March meeting and then before making a recommendation
to the Board of Trustees, we want to discuss the
proposals with the, School Board and Chief Wittenberg
of the Police Department.

The meeting was recessed at 11:04 P.M. and re-
convened at 11:53 P.M.
A motion was then made by Trustee Willer, seconded
by Wilson, that the Village Manager be authorized to
notify Chicago Title & Trust Company that in relation
to escrow agreement #219295 dated September 25, 1956,
between the Village of Mount Prospect and Hatlen
Construction Company, Inc. that Mr. Robert J. Downing
be substituted as Village Attorney in lieu of Mr. Frank
M. Opeka and that Mr. Downing, in the case of Hatlen
Construction Company, Inc. be instructed to take such
legal action as is necessary to protect the interests
of the Village of Mount Prospect. The President put'
the question, the Clerk called the roll, with the
following response: Ayes: Trustees Schlaver, Viger,
Wier, Willer and Wilson. Nayes: None. Absent,
Trustee Airey. Thereupon the President declared the
motion carried.
There being no further business to come before
the meeting a motion made by Trustee Viger, seconded
by Wier, that the meeting be adjourned. The motion
voted upon by acclamation, whereupon the President
declared the motion carried and the meeting regularly
adjourned.

THE PRESIDENT AND BOARD OF TRUSTEES
HELD IN 'IRE MUNICIPAL BUILDING,
MOUNT PROSPECT, ILLINOIS ON
TUESDAY, MARCH 19, 1957
The meeting was called to order by President
Lams at 8:10 P.M. and the Clerk was then directed to
call the roll.
On roll call the following Trustees answered

Trustee Wilson was absent.
The Trustees having previously received copies of the
minutes of the meeting held March 5th, a motion was made by
Trustee Willer, seconded by Airey, that the minutes be
approved as submitted. The President put the question, the
Clerk called the roll with the following response: Ayes:'
All, Nays: None. Thereupon the President declared the
motion carried.
A motion was made by Trustee Schlaver, seconded by
Willer, that the Treasurer's report for the period ending
February 28th, 1957 be approved and placed on file.
The President put the question, the Clerk called the roll,
with the following response: Ayes: All, Nays: None.
Thereupon the President declared the motion earried.
A motion made by Trustee Schlaver, seconded by Airey,
that the Treasurer's report of the Special Assessment
Funds be approved and placed on file. The motion voted
upon by acclamation, whereupon the President declared the
motion carried.
A motion made by Trustee Schlaver, seconded by Airey,
that the bills for the month of February as approved by the
Finance Committee, be approved for payment. rrhe Presiden t
put the question, the Clerk called the roll with the follow-
ing response: Ayes: All, Nays: None. Thereupon the
President declared the motion carried.
A motion made by Trustee Viger, seconded by Airey, that
the Village Attorney be authorized to prepare an agreement
between High School District #214 and the Village of Mount
Prospect regarding the installation and maintenance of the
water main located on the High School property in the Village
of Mount Prospect. ~he President put the question, the Clerk
called the roll, with the following response: Ayes: All,
Nays: None. Thereupon the President declared the motion
carried.
A motion mad~ by Trustee Viger, seconded by Willer,
that the amount of $500.00 be paid by the Village to the
Des Plaines~ Arlington Heights, Mount Prospect, Palatine
Water Commission. The President put the question, the Clerk
called the roll, with the following response: Ayes: All,
Nays: None. Thereupon the President declared the motion
carried.
A motion made by Trustee Viger, seconded by Wier, to
authorize final payment of ~1785.00 to John Erskine Co.
for work done on the building at the water tower site.
The President put the question, the Clerk called the roll,
with the following response: Ayes: All, Nays: None.
Thereupon the President declared the motion carried.
A motion made by Trustee Wier, seconded by Airey,
that a renewal of permit be granted to Mar-Don Construct-
ion Company for the sign located at 1116 W. Busse Avenue.
The President put the question, the Clerk called the roll,
with the following response: Ayes: All, Nays: None.
Thereupon the President declared the motion carried.
A motion made by Trustee Wier, seconded by Willer,
that the renewal of permit be granted to Town Development
Company for the sign located at 600 W. Central Road.
The President put the question, the Clerk called the roll,
with the following response: Ayes: All, Nays: None.
Thereupon the President declared the motion carried.
A motion made by Trustee Willer, seconded by Airey,
that Ordinance No.. 538 entitled "AN ORDINANCE AMENDING
THE MUNICIPAL CODE OF MOUNT PROSPECT OF 1957 (ORDIN~~CE NO.

POLLING PLACES AND APPOINTING JUDGES AND CLERKS FOR THE

be passed. The President put the questi on, the Clerk
called the roll, with the following response: Ayes: All,
Nays: None. 1hereupon the President declared the motion
carried and said ordinance passed and approved.
A motion made by Trustee Schlaver, seconded by Airey,
that the American Cancer Society's request of March 18th
to hold their annual drive in Mount Prospect on Wednesday,
April 24th be granted. The motion was voted upon by
acclamation whereupon the President declared the motion
carried.

A letter under date of March 14th from Mr. Hugo J.
Thal regarding the Des Plaines, Mount Prospect, Arling-
ton Heights, Palatine Water Commission and the possible
supplying of water by Metropolitan Sanitary District of
Chicago was then read.
This correspondence to be turned over to Mr. Mott, the
Mount Prospect Commissioner of the Des Plaines, Arlington
Heights, Mount Prospect, Palati~e Water Commission.
A letter under date of March 15th from the Office df
the Zoning Committee, Board of Commissioners of Cook
County was then read. This letter was referred to the
Village Manager for a reply.
A motion made by Trustee Wilier, seconded by Wier,
that Ordinance No. 541 entitled "AN ORDINANCE AMENDING
THE MUNICIPAL CODE OF MOUNT PROSPECT OF 1957 (ORDINANCE
NO. 534) BY AMENDING CHAPTER 2511 be passed. The
President put the question, the Clerk called the roll,
with the following response: Ayes: All, Nays: None.
Thereupon the President declared the motion carried.,
and said ordinance passed and approved.
A motion made by Trustee Willer, seconded by Schlaver,
that a proposed ordinance amending Section 3 of the
Village of Mount Prospect Zoning Ordinance be submitted
to the Zoning Commission for the holding of a public hear-
ing and their recommendations and that the Village Attorney
be authorized to represent the Village at this hearing.
The Presidant put the question, the Clerk called the roll,
with the following response: Ayes: All, Nays: None.
1hereupon the President declared the motion carried.
A motion made by Trustee Willer, seconded by Airey,
that a proposed Ordinance amending Section 6 of the Village
of Mount Prospect Village Plan (Ordinance No. 235) be
referred to the Plan Commission for their study and
recommendations. 1be motion voted upon by acclamation
whereupon the President declared the motion carried.

Committee as of April first.
This resignation is necessitated by my change of
residence from Mt. Prospect and the Chicago areae
I sincerely regret leaving the Committee, as I have
found the work very interesting and I have enjoyed the
association with the other members of the Committee and
the members of the Board.

A motion was then made by Trustee Willer, seconded by
Wier, to accept Mr. Cobb's resignation with regrets. The
motion was voted upon by acclamation, whereupon the President
declared the motion carried.
The following communication was then read,:

Gentlemen:
Reference is made to our letter dated March 8, 1957'
with respect to your obligation to convey certain property
to the Village of Mount Prospect. To date we have received
no response to the aforesaid letter nor have we been advised
that the property which you have agreed to deed to the
Village of Mount Prospect has been deeded as agreed.
On behalf of the Village of Mount Prospect, this is
to advise you that if action has not been taken on or
before the seventh day following the date of this letter,
iJll'e shall instruct the Village attorney to take such legal
action as is necessary to enforce our rifpts.
We trust that you are interested in disposing of this
matter without litigation. However, in view of your
apparent unwillingness to fulfill your contractual oblig-
ation, it may be necessary to proceed otherwise.

that the Village Attorney be authorized and instructed to
follow through as outlined in the aforegoing letter. The
President put the question, the Clerk called the roll, with the
following response: Ayes: All, Nays: None. Thereupon the
President declared the motion carried.
A motion made by Trustee Willer, seconded by Airey,
that the plat of N. J. Funk's Subdivision be referred to
the Plan Commission for thelr study and comments. 'I'he
motion voted upon by acclamation whereupon the President
declared the motion carried.
A motion made by Trustee Viger, seconded by Schlaver,
that Mr. Kenneth Miller be authorized to obtain training
at the Badger Meter Company in Milwaukee, Wisconsin and
that his expenses be paid in the amount not to exceed
Narch 19, 1957
$200.00. The President put the question, the Clerk
called the roll, with the following response: Ayes: All,
Nays: None. Thereupon the President declared the motion
carried.

The following communication was then read:
April 1, 1957
To the President and Board of Trustees
of the Village of Mount Prospect
112 East Northwest Highway
Mount Prospect, Illinois
Gentlemen:
High School District No. 214 does hereby request, in
accordance with terms set forth in this letter, permission
to install a 4" compound water meter in the Pro spect High
School building located on the property South of Foundry
Road and West afForest Avenue in Mount Prospect as shown
on plans for said high school prepared by Nicol & Nicol,
Architects & Engineers, their file No. 5405 and dated April
16, 1956 rather than to install an 8" compound water meter
in a pit on Memory Lane at a point where the water service
pipe for said High School is connected to the Village's
water main.
It is understood the water lines as shown on the above
mentioned plans are to be installed at the complete cost
of the High School District and said water lines will
include fire hydrants, all of which will be at locations
shown on the aforementioned plans. Regular water rates
will be charged in accordance with the current practice
of the Village. .ate valves, as needed, are to be
installed by the High School District at locations to be
determined by the Village.
It is understood and agreed that the High School
District No. 214 shall be responsible for the maintenance
and repair of all water lines on the High School property
provided, however, that the Village of Mount Prospect shall
have the right to enter the High School property for the
purpose of inspecting all water lines that are located on
April 2, 1957
