MINUTES OF A REGULAR MEETING OF
THE PRESIDENT AND BOARD OF TRUSTEES
HELD IN THE MUNICIPAL BUILDING,
MOUNT PROSPECT, ILLINOIS ON
TUESDAY, MAY 21, 1957
The meeting was called to order by President Lams at .
8:45 P.M. The ,Clerk was then directed to call the roll.
On roll call, the f'ollowing Trustees answered "Present It :
Trustees Airey, Broad, Casterline, Norris, Schlaver and Willer.
Absent: None.
The Trustees having previously received copies of' the
minutes of' the meeting held May 14, 1957, a motion was made
by Trustee Casterline and seconded by Trustee ~orris that the
minutes be approved as corrected by the Village Clerk. The
President put the question, the Clerk called the roll, with
the f'ollowing result: Ayes: All, Nays: None. Thereupon
the President declared the motion carried.

Trustees having previously received copies of' the
Treasurer's report f'or. the Village of' Mount Prospect dated
April 30, 1957, a motion was made by Trustee Airey, seconded
by Trustee Schlaver, that the Treasurer's Report be accepted
and placed on f'ile. The President put the question, the
clerk called the roll, wi th the f'o110wing resu1 t: Ayes:
All, Nays: None. Thereupon the President declared the
motion carried, and the Treasurer's Report accepted.

A motion was then made by Trustee Airey and seconded
by Trustee Casterline that the Treasurer's Report of'Specia1
Assessment Funds f'or the Village of' Mount Prospect dated
April 30, 1957 be approved and placed on f'i1e. The motion
was voted upon by acclamation, whereupon the President
declared the me tion carried.
Trustee Airey rnade a motion that was seconded by Trustee
Norris, that a list of' bills incurred during the month of'
April, 1957, as submitted by the Village Treasurer, be
approved f'or payment. The President put the question, the
Clerk called the roll, with the f'ollowing result: Ayes: All,
Nays~ None. Thereupon the President declared the motion
carried.
President Lams called f'or Committee Reports.
Schlaver reporting f'or the Water Depar tment sta tad
would ask f'or bids f'rom 3 f'irms,to paint the words
Prospeetlt on the water tank in 8 ft. letters.
A motion was made by Trustee Casterline and seconded by
Trustee Norris, tha t the Village Attorney be ins tructed to
prepare an Ordinance f'or erection of stop signs on Hi Lusi
Avenue at the intersection of Evergreen and Hi Lusi.
Discussion f'o110wed and included participation from
pBrsons present. The President put the question, the
Clerk called the roll, with the f'ollowing result:
Ayes: ~rustees Broad, Casterline, Norris and Sch1aver.
Nays: Trustees Airey, and Willer.. Thereupon the Pres-
ident declared the motion carried.

,Trustee Sch1aver recommended that logs be removed
f'rom Prospect Avenue between Main Street and Emerson Street.
Police Chief Whittenberg recommended removal of' the logs and
the installation of' curbs. This matter was ref'erred to the
Street Commdttee for study and recommendation.
Trustee Willer then inDroduced Ordinance No. 553
entitled "AN ORDINANCE AMENDING CHAPTER V of THE MUNICIPAL
CODE OF MOUNT PROSPECIJ:I OF 1957, AS AMENDED BY ADOPTING
CERTAIN ADDITIONS THERETOu. This Ordinance pertains to
the Board of Fire & Police Commissioners, and covers member-
ship, term and duties of these off'icers. A motion was made

by Trustee Willer, that this Ordinance be adopted and the
motion was seconded by Trustee Schlaver. The President put
the question, the Clerk called the roll, with the f'ollowing
result: Ayes: All, Nays: None. Thereupon the President
declared the motion carried and Ordinance No. 553 passed
and approved.
Trustee Willer then recommended the passing of Ordinance
No. 554 entitled ttAN ORDINANCE AMENDING SECTION 2 of' CHAPTER
VI OF WE MOUNT PROSPECT BUILDING CODE OF 1957". Thi s
Ordinance pertains to procedures to be followed in connection
with the construction of any new building or structure. There
,was some di scussion of' the wording of this Ordinance by the
Board and minor corrections were made. Trustee Willer made a
motion that Ordinance No. 554 be passed and this motion was
seconded by Trustee Airey. The President put the question,
the Clerk called the roll, wi th the following result: Ayes:
All, Nays: None. Thereupon the President declared the motion
carried, ~nd Ordinance No. 554 passed and approved.
Mr. Robert Teichert spoke from the f'loor requesting
permission on behalf' of Mr. Joseph Brickman to pave 4 blocks
of' Highland Avenue, as set forth in a letter from Mr. Allan
R. Bloch to the President and Board of Trustees of the
Village of Mount Prospect. Details of this letter were
included in the minutes of' April 16, 1957. A suggestion was
made to Mr. Teichert that he meet with the Village Attorney
during the coming week to discuss proper ways and means of
submitting his application to the Village Board, f'or consider-
ation during the meeting to be held May 28, 1957. President
Lams stated, that he wished to go on record as f'avoring a
special assessment in this case.
Trustee Willer read a copy of Resolution No.9-57, a
Resolution to object to and oppose so much of House Bill 966
as curtails the p0wers of the County Zoning Board of Appeals,
and to favor so much of said bill as would give the said Board
authority to consider adequacy of provisions for schools,
transportation and other public services. The motion was
seconded by Trustee Airey. The President put the question,
the Clerk called the roll, with the following result: Ayes:
All, Nays: None. Thereupon the President declared the
motion carried and said resolution adopted.
Trustee Willer then made a motion, which was seconded by
Trustee Norris, tha t the Presiden t and Vill age Clerk be, au thor-
ized to sign an agreement wi th the Barrington Trucing Company
f'or the removal of household rubbish. The President put the
question, the Clerk called the roll, wi th the f'ollowing
reSlut: Ayes: All, Nays: None. Thereupon the President
declared the motion carried.

Gentlemen:
On May 7, 1957, the undersigned appointed Frank J.
Biermann, Jame s J. Murray, and Jerrold T. Shutt to the
Fire and Police Commission.
Under statute, it is necessary to appoint one member
f'or a one-year term, the .second member f'or a term of two
years, and the third member for a three year term upon the
f'ormation of said Commission. Thereafter, the term of
office is three years for a full period.
For the one-year term - Frank J. Biermann, May,1951 to May,1958
For the two Year term - James J. Murray, May,1957 to May,1959
f'or the three year term - Jerrold T. Shutt, May,1957 to May,1960

A motion was made by Trustee Willer and seconded by
Trustee Casterline that the Board concur in the terms of
office as designated in the letter. The motion was voted
upon by acclamation, whereupon the President declared the
motion carried.

A motion was then made by Trustee Willer, seconded by
Trustee Casterline that the Board concur in the appointment
of George E. Whittenberg as Captain.of Police as stated in
the letter. The motion was voted upon by acclamation,
Whereupon the President declared the motion carried.
The following communication was then read:

The Mt. Prospect Camp Fire Girls Committee would like per-
mission to have their Fund Drive (~house to house canvass)
on Tuesday, November 12, 1957.
May we also go on record at this time as requesting the use
of' the kitchen and adjoining hall of the Municipal Building
for the same evening? We will check with you again early in
the Fall as to the avai1abi1i ty 0 f the se f aci1i ti e s.
In order to obtain optimal cooperation f'rom our citizens,
and success of' other Youth Fund Drives as well as our own,
we would like to request that no youth organi.zation be given
permission to hold a Fund Drive within approximately three
weeks of' this date.
We would appreciate early confirmation of' this date.

A motion was made by Trustee Willer, seconded by Trustee
Norris, that the Board concur in the recommendation of' the

Village Manager to employ the Municipal Services in cleaning
catch basins as stated in Memo No.4 to the President and
Members of' the Board of Trustees. The President put the
question, the Clerk called the roll, with the following result:
Ayes: All, Nays: None. Thereupon the President declared
the motion carried.

I, the undersigned James W. Viger, being a legally
registered voter in the Village of Mt. Prospect, and having
voted in the election held April 16, 1957, hereby request the
Village Board of' Trustees to take the necessary action to
cause the ballots for the offices of Trustees to be recounted.
The Village Board of Trustees held in the election, according
to the statute, April 16, 1957, and at the reg~lar1y scheduled
meeting of the Village Board, April 16, 1957, canvassed the
ballots of the election with the following results, in part:

Subsequent to the canvass of the ballots, the Village
Board did, by Proclamation, proclaim that the following
candida tes were elected to the Off'ice of Village Trus tee:
R.. L. Airey
W. G. Casterline
L. R. Norris
In view 0 f the above results, I am reque sting a recount
of'the ballots f'or the following reasons:
1. The tabulated results are so close for some of
the candidates that a recount seems feasible.
2. The large number of split ballots cast in the
election could have been conducive to human error
in tallying the results.
3. There is, and has been, much discussion concerning
the correct and legal manner in which ballots should
be, counted wherein there is an "X" in a party circle
denoting a straight ballot and also an IIX" in a box
denoting a vote f'or a trustee in another party. There
is an apparent discrepancy between the manner in which
the Village Attorney would advise that these ballots
be ~ounted and the instructions that the election
clerks received f'or counting them. There is some
doubt that the ballots of this type were counted in
the same manner in all three precincts. These
descrepancies should be cleared up and entirely
clarif'ied.

Upon advice of' the Village Attorney, this matter was
referred to committee consisting of Trustees Broad, Schlaver
and Willer. Trustee Willer was instructed to act as. Chair-
man by President Lams. This committee will act as a Board
of Trustees sitting as an Election Contest Committee.
There being no f'urther business to be brought before
the board, a motion was made by Trustee Willer, seconded by
Trustee Norris, that the meeting be adjourned. The motion
was voted upon by acclamation, whereupon the President
declared the motion carried and the meeting regularly
adjourned at 10:15 P.M.

minutes of the regular meeting held May 21, 1957, a motion
was made by Trustee Norris and seconded by Trustee Schlaver,
that the minutes be approved as submitted. The President
put the question, the Clerk called the roll, with the
following result: Ayes: All, Nays: None. Thereupon the
President declared the motion carried.
President Lams called for Committee Reports. Trustee
Willer reporting for the Judiciary Comrni ttee, stated that a
new policy had been adopted. This policy calls for the
voting on a proposed ordinance at the following meeting from
that in which it is first submitted. It is planned that the
meaning of' each ordinance be advertised in the Mount Prospect
Herald for the purpose of informing the public of the intended
consideration of said ordinance. President Lams commended
Trustee Wil1e~ for this decision. A motion was then made by
Trustee Willer and seconded by Trustee Norris, that Ordinance
No. 555 entitled "AN ORDINANCE AMENDING THE MUNICIPAL CODE OF
MOUNT PROSPECT OF 1957 BY AMENDING CHAPTER 18, ARTICLE II" be
passed. This Ordinance pertains to the erection of stop signs
on Hi Lusi Avenue, at the intersection of Evergreen and Hi-Lusi.
The President put the que stion, the Clerk called the roll,
with the f'ollowing result: Ayes: Trustee Casterline, Norris,
and Sch1aver. Nays: Trustee Airey and Willer. Absent:
Trustee Broad. President Lams was called upon to cas the
deciding vote, and voted UAye". Thereupon the President
declared the motion carried and said Ordinance passed and
approved.
Trustee Willer read a copy of' Resolution lOfr57. This
Reso1uticn pertains to the Secretary of the Board of Fire
and Police Commissioners, and authorizes compensation in the
amoun t of $10.00 :per each meeting of the Board ef'::Fire and
Police Commissioners at which witnesses appear. A motion
