MINUTES OF A REGULAR MEETING OF
THE PRESIDENT AND B3ARD OF TRUSTEES
HELD IN THE MUNICIPAL BUILDING,
MOUNT PROSPECT, ILLINOIS ON
TUESDAY, SEP'lEMBER 17, 1957
The meeting was called to order at 8:47 P.M. by
President Lams and the Clerk was then directed to call
the roll. On roll call, the following Trustees answerec
Present: Airey, Broad, Casterline, Norris, Schlaver
and Willer. Absent: None.
All Trustee having previously received copies of
the minutes of the meeting held September 3, 1957, a
motion was made by Trustee Schlaver and seconded by
Trustee Broad that the minutes be approved as submitte(
The President put the question and the Clerk called
the roll, with the following response: Ayes: All,
Nays: None, whereupon the President declared the
motion carried and said minutes approved.
All Trustees having previously received copies
of the Treasurer's Report for August, 1957, a motion
was made by Trustee Airey and seconded by Trustee
Norris that the Treasurer's Report be accepted and
placed on file. The President put the question and
the Clerk called the roll, with the following response
Ayes: All, Nays: None. Thereupon the President declarl
the motion carried.
It was moved by 'l'rustee Airey and seconded by
Trustee Broad that the list of bills incurred during
the month of August, 1957 be approved for payment and
placed on record. The President put the question
and the Clerk called the roll, with the following
response: Ayes: All, Nays: None. Thereupon the
President declared the motion carried.
A motion was made by Trustee Willer and seconded
by Trustee Norris to authorize the opening of two bids
for street maintenance work usinglMotor Fuel Tax Funds
The President put the que stion and a vote was taken by
acclamation, whereupon the President declared the moti
carried. Bids received were: (a) Skokie Valley Asphalt

Company in the amount of $4,883.00 (b) Milburn Bros.
Inc. in the amount of $4,463.60. The Village
Engineer's estimate for this project was $4,284.10.
A motion was made by Trustee Willer and seconded by
Trustee Casterline that the contract be awarded to
Milburn Bros., Inc.in the amount of $4,463.60, subject
to checking by the Village Engineers and approval by
the State Highway Department. The President put the
question and the Clerk called the roll, with the
following response: Ayes: All, Nays: None, whereupon
the President declared the motion carried$
Village Manager Appleby was requested by Trustee
Airey to obtain a list of properties where sidewalks
have not been installed or an escrow agreement ful-
filled as covered in Resolution 15-57. Mr. Appleby
was further requested by Trustee Willer to issue
permits for all sidewalk construction to enable the
Village to maintain a perpetual record of all side-
walk installations.
A citizen voiced an opinion that bicycles should
be subject to traffic rules such as traffic lights
and signs. Trustee Sehlaver requested that some
thought be given to licensing bicycles. This matter
was referred to the Village Manager for his consider-
ation.
Trustee Willer read the following communication:

Gentlemen:
We transmit herewith our final plat as approved by the
Mount Prospect plan comrndssion relative to 1st Addition
to Country Club Terrace Subdivision.
Also enclosed please find our check in the amount of
$4,500.00 as payment in lieu of land dedication for
~ublic use. The amount was determined on the basis of
$6,000.00 per acre, 1 acre per 60 lots or a total of
3/4 acres for 45 lots.

A motion was made by Trustee Willer and seconded by
Trustee Broad that the plat of the First Addition to Country
Club Terrace be referred to the Plan Corronission for recommend-
ation and signatures, if approved. The President put the
question and a vote was taken by acclamation, whereupon the
President declared the motion carried.
Trustee Willer referred to a letter from Evert Kincaid
& Associates pertaining to a preliminary subdivision plan
prepared for Mr. Salvator Dimucci, having to do with the
anproximate 16l acres of land located south of Golf Road
and east of Busse Road. It was moved by Trustee Willer and
seconded by Trustee Broad that this preliminary subdivision
plan be referred to the Plan Commission for study and
recommendation. The President put the question and a vote
was taken by acclamation, whereupon the President declared
the motion carried.

letter pertaining to Case 57-7 as follows:

Gentlemen:
On Friday, August 30 at 8:00 P.M. the Zoning
Commission conducted pUblic hearings at the Village
Hall on rezoning requests, Cases 57-7, 57-8 and 57-9.
Five members were present. Approximately 150 home
owners of the area surrounding the property in questio!
in the cases involved were in the audience.

Although the property involved in Cases 57-7 and
57-8 is not now annexed to the Village of Mount Prospec
Attorney Downing instructed this Commission that a
public hearing should be held and again at a speoial
meeting of the Zoning Commission on Wednesday,
September 4, our village attorney again stated that
this Commission was to report its recommendations to
the Board of Trustees. A complete transcript of the
proceedings in all cases will be available.
Case 57-7 was presented by Attorney Allan Bloch
in behalf of the Western National Bank, Cicero, Illino:
and Joseph Brickman owner of the property. Proof of
ownership was submitted. The request wars for rezoning
the area from farming to I-I. During th earing, the
petitioner indicated the area, if rezone, would
include three sections, one involving construction of
apartment dwellings' containing 72 units. The second
area would be definitely in the industrial classifica-
tion and would be used for the construction of two
buildings, and the ground area would be used for
storage of building equipment and heavy machinery of
various types. The third area, bordering on Rand Road
would be in the business classification with intended
use as a site for a gasoline station.

Enc1ose.d is a copy of the Petition of Protest against
the proposed Amendment to the Zoning Ordinance of the
Village of Mount Prospect, Illinois as contained in
Case 57-7, Petition Trust Number 1686, as submitted
to the Zoning Commission of the Village of Mount
Prospect, Illinois during the Public Hearing held for
this case on Friday Evening, August 30, 1957.
We, as members, have been instructed by the North East
Home Owners Association to present this copy to you as
one of the OFFICIAL Protests of this organization to
the proposed Annexation and Rezoning of the above
mentioned case in accordance with a resolution passed
by a majority of the members of this organization in a
meeting held on Monday August 26, 1957.

Accompanying the above letter was a petition
signed by 150 citizens protesting the rezoning of the
properties referred to in Case No. 57-7 from Farming
to I-I Light Industrial. Trustee Willer again referred
to a petition which was included in the minutes o~
September 3. This petition signed by 10 citizens
protested the annexation and rezoning of the properties
referred to in Case 57-7. A motion was made by Trustee
Willer and seconded by Trustee Schlaver that the Board
of Trustees concur in the recommendation of the Zoning
Commission pertaining to Case 57-7. The President put
the question and the Clerk called the roll, wi th the
following response: Ayes: All; Nays: None, whereupon
the President declared the motion carried.
Trustee Willer read that portion of the letter
~rom the Zoning Commission pertaining to Case No. 57-8.
nCase 57-8 - This petition was presented by
Attorney Allan Bloch in behalf of the Exchange National
Bank of Chicago. The Serafine Home Builders o~ Mount
Prospect proof of ownership was not available on the
evening of the hearing, but such records were submitted
th the Zoning Commission for the special meeting held
at the Village Hall on Wednesday, September 4.
The area in question, now zoned for farming, was
requested to" be reclassified to B-3. A proposed plan
was submitted by Dan Serafine, President, indicating
that the area would contain apartment buildings and
several stores - the stores fronting both on Rand Road
and on Central Road. The petitioner was unable to submit
any detailed plan indicating .the number of apartment
dwellings that would be contained in thl s area, n'or
definite information concerning the arrangements for
parking facilities. Mr. Serafine stated that he had
discussed this particular area with members of the
Mount Prospect Planning Commission who, he indicated,
looked t'avorably upon the development of this area for
apartments and a business section.
At the special meeting at the Village Hall on
September 4, the Zoning Cc>rnmissionOOl'lllllis.::liuri unanimously
voted to deny this rezoning request."
Trustee Willer read portions of a petition signed
by 7 citizens formerly protesting the legality of a
hearing held August 30, 1957 by the Zoning Commission
pertaining to Case 57-8. Mr. Dan Serat'ine referred to
a petition signed by 28 citizens in which they stated
they wished to withdraw any opposition or objection to
the application for zoning filed by Mr. Serafine and to
consent to such zoning as provided for in a revised
plat. Mr. William Burke of 905 E. Central, stated that
the revised plan pertaining to Case 57-8 was substantially
the same as the previously submitted plat. Mr. Thomas
Cas~of 6 S. George Street read a communication in
which he stated that the majority of home owners in the
vicinity ot' Mr. Serafine's property were in accord with
provisions of the revised plat. This permit was ret'erred
to the Judiciary Committee t'or study and recommendation.
Trustee Willer then read a portion of the letter
t'rom the Zoning Commission pertaining to Case 57-9:
uCase 57-9 involved two lots on the Northwest Highway.
This case was presented by Attorney Bloch ror the owner,
Joseph Brickman. ~e adjoining property to the lots in
question is now zoned for business. The rezoning request
to change from residential to business should be granted.
This is the unanimous recommendation of the Zoning
Commission".
A motion was made by Trustee Willer and seconded by
Trustee Norris that the Board ot' Trustees concur in the
recommendation of the Zoning Commission pertaining to
Case 57-9, and that the Village Attorney be instructed
to prepare the necessary ordinances. The President put

OF THE VILLAGE OF MOUNT PROSPECT
MOUNT PROSPECT, ILLINOIS.

We, the undersigned, residents of Mount Prospect~
Illinois, and owners of property situated in The
Prospect Park Country Club Subdivision, which propert~
fronts on and along the North Side of Lonnquist
Boulevard between Elmhurst Avenue and We-Go Trail,
do hereby petition your Honorable Board, as follows:
Whereas, it has come to the knowledge of the undE
signed, that certain residen ts of Lonnquist Gardens
Subdivision and others wi th property fronting on the
unimproved South Side of Lonnquist Boulevard, have
recommended to your Board that a portion, if not all,
of the Unimproved South one-half of said Boulevard
be vacated and the existin~ improved parkway, which
is part of the North one-half thereof, be paved,
thereby reducin~ the one hundred foot wide boulevard
to an ordinary village street, practically all of
which would be located on the North one-half of
Lonnquist Boulevard, and

Whereas, vacation of a substantial portion or al:
of the South one-half of Lonnquist Boulevard will be
detrimental to the interests of all of the undersigne(
property owners, as welL as other property owners in
the Prospect Park Country Club Subdivision in the
vicinity of Lonnquist Boulevard, because it will
destroy the existing improved parkway on the complete<
North one-half of Lonnquist Boulevard and bar
completion of the balance of said parkway on the
unimproved South one-half of Lonnquist Boulevard,
thereby materially detracting from the appearance
and beauty of the neighborhood as well as that of
each individual home, to say nothing as to the
resul tant damage to property values, and
Whereas, vacating by the Village of a substantia:
part or all of the South one-half of Lonnquist
Boulevard would result in ti tIe thereto vesting in
abutting property owners, who are the recommending
parties hereinab.~ referred to, ibereby promoting and
subserving private interests, and
Whereas, the Village of Mount Prospect accepted
Lonnquist Boulevard as a boulevard when the sub-
division plats of this area were filed by virtue of
such acceptance, the Village holds title to Lonnquist
Boulevard in trust for the benefit of the pUblic, and
the President and Board of Trustees of said Village
are committed by law not to a vacate any street or
boulevard or any part thereof unless the public
interest is subserved or promoted.
NOW, THEREFORE, the undersigned do hereby respec
fully request and earnestly petition this Board of
Trustees and its President, that it take a firm stand
in opposition to any proposed ordinance or ordinances
that may be submitted to it, the terms of which call
for vacation of all or any part of the unimproved
portion of Lonnquist Boulevard; further, that your
board notify Lloyd Talbot, who is designated as Chair
man of the undersigned group, of any meetings of your
board, or the Village Planning Commission, concerning
this subject.

A motion was made by Trustee Willer and seconded by
Trustee Norris that the Village Attorney be authorized to
represent the Village or Mount Prospect in Case No.
57-C-12l27. The President put the question and the Clerk
called the roll, with the following response: Ayes: All;
Nays: None, whereupon the President declared the motion
carried.
Trustee Schlaver read a proposed ordinance. Ord-
inance No. 569, AN ORDINANCE PROVIDING FOR THE ISSUANCE
OF SPECIAL ASSESSMENT BONDS UNDER WARRANT #57 PAYABLE IN
NUMERICAL ORDER. A motion was made by Trustee Schlaver
and seconded by Trustee Norris that Ordinance No. 569
be passed. The President put the question and the Clerk
eal1ed the roll, with the following response: Ayes: All,
Nays: None, whereupon the President declared the motion
carried and said Ordinance passed and approved.
The following motion was made by Trustee Schlaver
and seconded by Trustee Board: I move that it is the
expression of the Mount Prospect Village Board that ,the
proposed rerouting of heavy traffic on Route 83 to/avoid
Mount Prospect as advocated by the Palatine Plan domm-
ission and printed in the Paddock Publications be given
hearty approval. The Village Clerk is hereby directed
to point out such approval, based on the present almost
intolerable situation caused by Route 83 traversing Mount
Prospect's business section, to William J. Mortimer, Cook
County Superintendent of Highways; Ralph R. Bartelsmeyer,
Chief State Highway Engineer, and Charles Klppp, chairman
of the Palatine Plan Commission. The President put the
question and a vote was taken by acclamation, whereupon
the President declared the motion carried.
Trustee Schlaver stated that he would like to
recommend to the Board that they take the necessary
steps to open up the commuter parking lots for free park-
ing on Saturday in order that the Business men could take
advantage of the publici ty which would thus accrue. He
further stated that this might possibly result in a habit
of parking in the lots and opening up the streets somewhat.
A motion was made by Trustee Schlaver and seconded by
Trustee Willer that the Village Attorney be directed to
investiage the necessary legal steps for free parking on
the commuter parking lots on Saturdays and Sundays and
legal holidays. The President put the question and the
Clerk called the roll, with the following response: Ayes:

A motion was made by Trustee Schlaver and seconded
by Trustee Broad that the Village Manager be instructed
to have all poles removed from the parkway on Prospect
Avenue forthwith. The President put the question and a

We transmit herewith two (2) copies of a tabulation
of the bids received at the letting on September 10,
1957, for the resurfacing of streets in the Hillcrest
and Country Club Subdivisions, known as MFT Section
II-OS. Bids were submitted by the following contractl

The bids have been checked and all extensions and
totals were found to be correct. It will be noted
that Allied Asphalt Paving Company is the low bidder

engineer's estimate.
It is recommended that the contract be awarded to
Allied Asphalt Paving Company, the low bidder, subjec
to the approval of the Illinois Division of Highways.
Kindly advise what action is taken on this matter
by the Board and, upon request, we will prepare the
necessary copies of the contract and submit them to
September 17, 1957

the contractar for execution..
We are returning herewith, for your files, the proposals
submitted by the aforementioned contractors at the letting
on September 10. It is suggested that the proposal guarantee
checks for both bidders be retained until a contract has
been executed and approved by the State Highway Department.

by Trustee Norris that a contract be awarded to the Allied
Asphalt Paving Company in the amount of $34,796.00 and
authorizing the Village President and the Village Clerk to
sign on behalf of the Village of Mount Prospect. The
President put the question and the Clerk called the roll,
with the following response: Ayes: All, Nays: None.
Absent: Trustee Airey. ~bereupon the President declared
the motion carried.
A motion was made by Trustee Willer an~ seconded by
Trustee Norris alloting an additional sum of $250.00 for
tree removal and resurfacing of the islands at Maple and
Evergreen Streets as covered in the Memorandum to the
Village President and Trustees from the Village Manager
dated September 6, 1957. The President put the question
and the Clerk called the roll, with the following response:
Ayes: All, Nays: None. Absent: Trustee Airey. Thereupon
the President declared the motion carried.
A motion was made by Trustee Willer and seconded by
Trustee Broad that the President and Village Clerk be
authorized to sign the agreement with Mr. Poczatek on
behalf of the Village of Mount Prospect and that a copy
of this agreement be forwarded to Mr. Poczatek after he
has presented payment to cover the cost of recording
said agreement. The President put the question and the

house to the sewer line to be installed by said Frank
Poczatek along Gregory Street.
