MINUTES OF A REGULAR MEETING
OF THE PRESIDENT AND BOARD OF
TRUSTEES HELD IN THE MUNICIPAL
BUILDING, MOUNT PROSPECT, ILLINOIS
ON TUESDAY, NOVEMBER 19, 1957
The me eting was c aIled to 0 rder at 8 :40 P.M. by
President Lams and the Clerk was then directed to call
the roll.
On roll call, the following Trustees answered
"Present": Airey, Broad, Casterline, Norris, Schlaver,
and Willer. Absent: None.
All Trustees having previously received copies of
the minutes of a meeting held November 12, 1957, a motie
was made by Trustee Norris and seconded by Trustee
Casterline that the minutes be approved as submitted.
The President put the question and the Clerk called the
roll, with the following response: Ayes: All; Nays:
None, whereupon the President declared the motion carrie

It was moved by Trustee Airey and seconded by
Trustee Norris that the List of Bills incurred during
the month of Octo.ber, 1957 as corrected, be approved
for payment. The President put the question and the
Clerk called the roll, with the following response:
Ayes: All; Nays: None, whereupon the President declared
the motion carried.
It was moved by Trustee Airey and seconded by
Trustee Willer that the Treasurer's Report for the
month ending October 31, 1957 be approved and placed
on file. The President put the question and the Clerk
called the roll, with the following response: Ayes:
All; Nays: None, whereupon the President declared the
motion earn ed.
It was moved by Trustee Airey and seconded by
Trustee Schlaver that the Treasurer's Report of Special
Assessment Funds for the Village of Mount Prospect for
the month ending October 31, 1957 be approved and placec
on file. 'I'he Presiden t put the question and the vote
was taken by acclamation whereupon the President
declared the motion carried.
Trustee Airey suggested that all Board members
visit the new Village Hall and Service Building in
Glencoe to obtain information and suggestions, since
an addition to the Municipal Building in Mount Prospect
is anticipated.
Trustee Casterline read the following letter:

To The Honorable President and
Members of the Board of ffrustees
I would like to take this opportunity to thank
the President and members of the Board of Trustees
for remembering me in such a wonderful way on my 25th
anniverary of service on the Mount Prospect Police
Department. I would like to thank them for their
kind expressions and the lovely gift they presented to
Mrs. Whittenberg and myself on behaif of the citizens
of Mount Prospect.
I do pope the good Lord will grant me good
health to continue my work as a public servant of the
Village of Mount Prospect and that I will be able to
live up to all the nice things that were said about me.

Trustee Willer referred to parts of a comm-
unication pertaining to the Sanitary District. He
stated that the program to complete the sewer system
for Mount Prospect would not exceed 2 years, and
could possibly be completed within 15 months. He
also stated that the approximate charge per month
for th~ average single family residence would be
about ~3.00. Trustee Willer stated that every effort
was being extended by the Sanitary District to make
this a model project.
Trustee Willer read Resolution 22-57 A RESOL-
UTION INCLUDING NORTHWES'I' MEADOWS AND NORlliWEST
HEIGHTS IN THE PROPOSED SEWER SYSTEM FOR :J.'HE VILLAGE
OF MOUNT PROSPECT. It was moved by Trustee Willer
and seconded by Trustee Schlaver that Resolution
No. 22-57 be adopted. The President put the question
and the Clerk called the roll, wi th the following
response: Ayes: All; Nays: None, whereupon the Pres-
ident declared the motion carried and Resolution
22-57 adopted.
Trustee Willer referred to Case 57-13 and moved
that the Village Attorney be directed to prepare the
necessary ordinances to annex and zone said property
in accordance with the petitioners request. This
motion was seconded by Trustee Norris. The President
put the question and the Clerk called the roll, with
the following response: Ayes: All; Nays: None, where-
upon the President declared the motion carried.
Trustee Willer read Ordinance No. 577 AN ORD-
INANCE REZONING LOT 23 IN MORNINGSIDE GARDENS FROM
R-l DISTRICT TO B-3 DISTRICT. It was moved by
Trustee Willer and seconded by Trustee Norris that
Ordinance No. 577 be passed. The President put the
question and the Clerk called the roll, with the
following response: Ayes: All; Nays: None, where-
upon the President declared the motion carried and
Ordinance No. 577 passed and approved.

Village of Mount Prospect
Mount Prospect, Illinois
Gentlemen:
On F~iday, October 25, 1957 the Zoning Commission
conducted a public hearing at the Village Hall. There
were three memoers present.
Case 57-12 presented by Mr. Robert Downing for
the Village of Mount Prospect. Request was for unpaved
parking in P-3 classification. Trustee Willer referred
to the Kincaid report indicating that this report was
in favor of additional off-street parking areas in the
Village of Mount Prospect. The Mount Prospect Planning
Commission also was in favor of this commuter parking
space.
Four residents of the area immediately surround-
ing the property in question indicated that they would
not object to this rezoning provided entrances and
exits were confined entirely to Prospect Avenue. These
residents also requested that the village plan to
construct this parking area so that there would not
be objectionable dust and dirt emanating into the
residential area.
The members of the Zoning Commission voted
unanimously for this rezoning classificatione The
Zoning Commission also unanimously joined with the
residents of the area concerning exits and entrances

of the Zoning Commission with respect to Case 57-12.

AN ORDINANCE REZONING LOTS 2 THROUGH 9 INCLUSIVE IN
J. A. WEBER'S ADDITION TO MOUNT PBOSPECT FROM R-l
DISTRICT TO P-4 DISTRICT. It was moved by Trustee
Willer and seconded by Trustee Airey that Ordinance
No. 578 be passed. 'Ihe President put the question
and the Clerk called the roll, with the following
response: Ayes: All; Nays: None, whereupon the Pres-
ident declared the motion carried and Ordinance No.
578 passed and approved.

Gentlemen:
Case 57 -15
The Zoning Commission recommends that the
petition as presented be denied. The vote was 3 to
0, although all five members heard the petition.
The other two could not be present but it is their
wish to make the recommendation unanimous.

It was moved by Trustee Willer and seconded by
Trustee Broad that the matter referred to as Case No.
57-15 be referred to the Judiciary Committee for further
study. The President put the question and the vote was
taken by acclamation, whereupon the President declared
the motion carried.
A motion was made by Trustee Willer and seconded
by Trustee Broad that the following letter be sent to
the Cook County Zoning Board of Appeals and that a copy
be sent to the Cook County Board of Commissioners.
liOn November 7,1957 a hearing was held in the
Mount Prospect Village Hall regarding certain land now
zoned "F" in the County of' Cook and a proposed sub-
division known as "Elk Ridge Villa" was the property in
question. 'Ihe Village of' Mount Prospect, through a
representative, asked for an opportunity to make known
its decision relative to this matter and f'urther asked
for additional time in which to do this. Our request
was granted by the Cook County Zoning Board of Appeals
due to the f'act that the prope rty in question was
within one and one half miles of' the limits of the
Village.
The Village of Mount Prospect, through its elected
officials, wishes to make no objection to the proposed
zoning but does wish to go on record in pointing out
items that should have very caref'ul consideration
before a decision on this matter is reached by the

Cook County Zoning Board of Appeals ,and the Cook
County Board.
The petitioner, at the public hearing, did
make cer~ain representations pertaining to his
willingness to contribute to the welfare of the
school district serving the proposed subdivision.
It would seem tb~t whatever value these represent-
ations might have would be far more important if
they were in writing and agreed to by the parties
concerned.
In the public interest, careful consideration
of the request for R-5 Zoning should be given. There
could be considerable doubt as to the logic of, this
Zoning Classification in this particular area.
We are not unmindful of the needs for rezoning
additional lands for residential purposes to take
care of the influx of people to the Chicagoland area.
We do, however, wish to point out that developments
of this type will help aggravate already overloaded
storm water outlets. The residents of ~he Village of
Mount Prospect are already faced with/inadequate drain-
age ditch known as Weller Creek. This problem is
even more serious because of the inadequate size of
a flume downstream from Mount Pr,ospect.. Part of
the drainage of this area in question will flow through
the Village of Mount Prospect. We would ask that the
County Board do everything they can to help eliminate
the inadequacy of present storm outlets.
We trust that the officials of Cook County will
give careful consideration to the above items, Inso-
far as the proposed improvements to the subject
property are concerned, we favor fully improved
developments with sewer, water, paved streets, curbs
and sidewalks over the lower type of subdivision now
permitted by Cook County Ordinances."

Trustee Willer read Ordinance No. 579. AN
ORDINANCE PERTAINING TO THE INCREASE OF ANNUAL FEES
FOR MOTOR VEHICLE LICENSES. After some discussion
concerning the increase of fees for licenses purchased
on or after March 1, Ordinance No. 579 was corrected
to eliminate such increased fees. It was moved by
Trustee Willer and seconded by Trustee Casterline that
Ordinance No. 579 be passed as amended. The President
put the question and the Clerk called the roll, with
the following response: Ayes: All; Nays: None, whereupon
the President declared the motion carried and Ordinance
No. 579 passed and approved.
Trustee Schlaver read Ordinance No. 580 AN ORD-
INANCE TO INCREASE 'IRE WATER DEPOSIT FEE FROM $5.00
TO ~lO.OO. It was moved by Trustee Schlaver and
seconded by Trustee NorriS that Ordinance No. 580
be passed. The President put the question and the
Clerk called the roll, with the following response:
Ayes: All; Nays: None, whereupon the President declared
the motion carried and Ordinance No. 580 passed and
approved.
Village Manager Appleby was requested to read bids
on tractor equipment for use by the Water Department.

Village Manager Appleby recommended that the bid
of Nord's Tractor & Equipment Service in Villa Park
for Case Equipmept be accepted in the amount of $4400.00.
It was moved by 'I'rustee Airey and seconded by Trustee
Norris to authorize the purchase of Case equipment from
Nord's Tractor & Equipment Service of Villa Park in the
amount of $4400.00 and for said purchase to be paid for
from Water Department funds. The Presiden t put the
question and the Clerk called the roll, with the follow-
ing response: Ayes: All, Nays: None, whereupon the
President declared the motlon carried.

President Lams referred to a proposed protest of
the Village of Arlington Heights to a proposed increase
in the racing season at Arlington Park from 36 days to 4S
days. It was moved by Trustee Willer and seconded by
Trustee Broad that the Village of Mount Prospect use the
Resolution as submitted by the Village Attorney of
Arlington Heights by substitutinf? the words "l"It.Prospecttl
for the words "Arlington Heights., and that said Resolutic
be offered for ,consideration at a future meeting. The
President put the question and the Clerk called the roll,

Attention: Village Board
Gentlemen:
My application for permit to build a commercial structurE
on Lot 1 in Block 4, in Prospect Park Subdivision No. I,
has been denied by your Superintendent of Buildings on
the grounds that this lot is zoned R-l District.
This I hold to be erroneous and charge that this lot was
mistakenly zoned as a Park in your Zoning Plan of May 4;;.,
1944. The size and shape of this lot make it impossible
to construct a single family residence thereon and still
conform to the requirements of your Building Ordinance.
Therefore, how could it be so zoned? This lot was zoned
Business and contained a Real Estate office prior to
1944. The assessments and taxes are paid up to date.
Further denial to use my property would amount to
confiscation without compensation. I respectfully
request that my application for pullding permit, which
was denied, be reconsidered and approved by the Village
Board.

I would appreciate it if you and the Board would
offer me a solution to my parking trouble.
I have received tickets for violating the parking
code during the day in front of my apt. located at
214 S. Emerson.
I rent this apt. and have absolutely no place to
park, no yard, driveway or garage and find this a
little hard to understand.
During the day normally It mat work and park at
the service station over night but this week I'm on
vacation; in and out shopping & etc. and frankly don't
know what to do about this, tickets are more than I can
afford to maintain daily, especially since this is
supposed to be my vacation.
I would sincerely appreciate your cooperation.

Dear Mr. Lams:
This is to advise you that I have sold to the J. O.
Ross Engineering Co. lot no. 13 and half of lot no.
12 in J. A. Weber's Addition to Mt. Prospect, who
will construct an office building on this property,
which is on the corner of East Lincoln St. and South
School Street.
It will be necessary that the easement running North
and South, between Lot 12 and 13 be lifted and since
this easement is of no value to the Public Service
Company or to the Telephone Company, who have already
given us their consent to remove this easement, we
are asking that you kindly advise us that it is
satisfactory to the Village, as I see no need for
it to the village either.

The meeting was called to order at 8:36 P.M. by
President Lams and the Clerk was then directed to call
the roll.
On roll call, the following Trustees answered

Willer. Absent: Trustee Airey.
All Trustees having previously received copies
of the minutes of a meeting held November 19, 1957, a
motion was made by Trustee Broad and seconded by Trustee
Norris that the minutes be approved as submitted. The
President put the question and the Clerk called the roll,
with the following response: Ayes: All; Nays: None, where-
upon the President declared the motion carried and said
minutes approved as submitted.
President Lams referred to a petition signed by 21
citizens, protesting the proposed annexation and rezoning
of property referred to as Case 57-15 and consisting of
property bounded on the South by Foundry Road, on the
North by Rand Road, and on the West by Elmhurst Avenue.
This petition was referred to the Village Clerk for file.
Trustee Willer stated that consideration was being given
Case 57-15 by the Judiciary Committee and that several
weeks might possibly elapse before a final report could
be given.
