MINUTES OF A REGULAR MEETING
OF THE PRESIDENT AND BOARD OF
'l'RUSTTES HELD IN THE MUNICIPAL
BUILDING, MOUNT PROSPECT, ILLINOIS
ON TUESDAY, JANUARY 21, 1958
The meeting was called to order at 9:03 P.M. by Pres-
ident Lams and the Clerk was then directed to call the roll.
On roll call, the following Trustees answered ttpresentu:
Airey, Broad, Casterline, Norris, Schlaver and Willer. Absent:
None.
All Trustees having previously received copies of the
minutes of the meeting- held January 14, 1958, a motion was
made by Trustee Norris and seconded by Trustee Broad that
the minutes be approved as corrected. The Presiden t put
the question and the Clerk called the roll, wi th the follow-
ing response: Ayes: All; Nays: None; whereupon the President
declared the motion carried.

Dear Mr. Appleby:
In reply to your letter of December 12, 1957, regarding the
defective sidewalks in Pine Street, on the above referenced
project, we advise as follows:
The sidewalk in concern has been examined by a testing
laboratory, Walter H. Flood & Company, and judged to be
structurally sound, per their letter report of November 27,
1957 .
In the judgment of our construction supervisor, the defects
noted in the sidewalks are not serious enough as to constitute
a hazard- to public safety and, therefore, in fairness to the
sidewalk contractor, it is difficult to recommend a total
removal and replacement of these sidewalks. We recommend
that the Contractor be permitted to patch the defects in
an approved manner. In order to safeguard the Village's
interest, if additional defects should occur, or the patch-
ing becomes defective, we recommend that a two-year maint-
enance bond be furnished to the Village by the Contractor
prior to acceptance.
If the above measurers are satisfactory to the Village,
please advise and we shall so inform the developer so
that proper arrangements can be made.

Casterline that a $1,000.00, 2 year maintenance bond be
furnished the Village of Mount Prospect and that the Village
Manager so advise Consoer, Townsend & Associates. The
President put the question and the Clerk called the roll,
with the following response: Ayes: All; Nays: None; whereupon
the President declared the motion carried.

be delegated to act as fiscal officer to handle the
Illinois Municipal Retirement Fund for the Village of
Mount Prospect. The President put the que stion and the

It was moved by Trustee Airey and seconded by Trustee
Norris that a temporary advance of $l30.73 be made from the
General Corporate Fund to the Fire Equipment Bond & Interest
Fund to provide adequate funds to pay Fire Equipment Bond
and interest due January l, 1958. The President put the
question and the Clerk called the roll, with the following
response: Ayes: All; Nays: None; Whereupon the President
declared the mo tion carri ed.
Village Manager Appleby made several corrections in
the List of Bills incurred during the month of December,
1957. It was moved by Trustee Airey and seconded by Trustee
Casterline that the List of Bills incurred during the month
of December, 1957 be approved for payment. The Presiden t
put the question and the Clerk called the roll, wi th the
following response: Ayes: All; Nays: None; whereupon the
President declared the motion carried.

On January 15, 1958, our representatives were present
at the Village Hall to witness the transfer of cash and
cash items on hand from Mr. Herman Hinz, retiring Treasurer-
Collector, to Laura Conroy, who assumed that office on an
interim basis effective that date.

Our inquiries regarding the records pertaining to
cash balances with depositories disclosed that general
ledger postings had not been made, nor had bank accounts
been reconciled since:
July 31, 1957 in the case of Water Fund
April 30, 1957 in the case of other Village Funds
Some date in 1954 in the case of Special Assessment
Fund s .
It was therefore impracticable to attempt at that
time to establish the amount of cash with depositories
being transferred. It is our understanding that arrange-
ments will be made to have these records brought up to
date, after which we will verify the amounts on deposit
at January l5, 1958~
We also inspected two Village bonds, face amount
totaling $2,000.00 which, we were informed, were owned
by the Village's Water Fund.
In cooperation with the Village Manager, we compiled
a rough inventory of the records filed in the office vault.
These records pertained principally to general Village and
Special Assessment transactions of prior years, and are not
described 'herein because of the numerous items involved
and because in many cases conculsi ve iden tifi ca tion 0 f the
records could not be established. We did. not lOC8.te bond
registers pertaining to warrant #49 and subsequent warrants,
general journal entries subsequent to 1952, and certain
other records whj.ch we presume are in existance; however,
a more caf'eful search through the general office files and
other storage areas (if any) may disclose the whereabouts'
of these records.

'Ihe practice of "holdingll various cash items (see
details listed above re money and other items counted by us)
is contrary to sound fi seal practices, is sllbject to
criticism from an internal control viev~oint, and should
be discontinued. All Village funds should be doposited
promptly, irrespective of the nature of the transaction
giving rise to their receipt.

Trustee Airey read proposed Resolution l-58 A RESOL-
UTION TENDERING A VOTE OF CONFIDENCE TO HAROLD G. APPLEBY,
VILLAGE MANAGER. It was moved by Trustee Airey and seconded
by Trustee Willer that Resolution 1-58 be adopted. The
President put the question and the Clerk called the roll,
with the following response: Ayes: Trustees Airey, Broad,

Resolution l-58 adopted.
It was moved by Trustee Airey and seconded by Trustee
Norris that the Treasurer's Report of Special Assessment
funds for the Village of Mount Prospect ending December 3l,
1957 be placed on record. The President put the question
and the Clerk called the roll, with the following response:
Ayes: All; Nays: None, wb~reupon the President declared the
mo tion carried.
It was moved by Trustee Willer and seconded by Trustee
Norris that the President and Clerk be authorized to sign
the plat of the 1st Addition to Country Club Terrace as
recommended by the Plan Commission. The President put the
question and the Clerk called the roll, with the following
response: Ayes: All; Nays: None, whereupon the President
declared the motion carried.

Village Manager Appleby read and recommended the
adoption of proposed Resolution 2 - 58. A RESOLUTION PROVIDINC
FOR 'l'HE RENTAL OF A SAFETY DEPOSIT BOX FOR THE USE OF 'lEE
VILLAGE OF MOUNT PROSPECT. It was moved by Trustee Willer
and seconded by Trustee Norris that the Resolution 2-58 be
adopted. The President put the question and the Clerk callec
the roll, with the following response: Ayes: Trustee Airey,
Broad, Casterline, Norris, Schlaver and Willer. Nays: None;
whereupon the President 'declared the motion carried and
Resolution 2-58 adopted.

Trustee Broad that Bond No. 13703 issued by the Standard
Accident Insurance CODlpany in the amount of ~50,OOO.OO for
Mrs. Laura Conroy be approved subject to the approval of
the Village Attorney. 'l'he Presiden t put the question and thE
Clerk called the roll, with the following response: Ayes:
All; Nays: None, where upon the President declared the motion
carried.
It was moved by Trustee Willer and seconded by Trustee
Broad that the Village President and Village Clerk be
authorized to sign the Bill 0 f Sale #l335 in which the
Village 'of Mount Prospect f'or the consideration 0 f $1.00
agrees to sell to. the Commonwealth Edison Company, a lamp
post located at the Southwest corner of Main Street and
Busse Avenue. The President put the question and the Clerk
called the roll, with the following response: Ayes: All;
Nays: None, whereupon the President declared the motion
carried.

Gentlemen:
The vacation of Wa-Pella Avenue, abutting the west line of
Sunset Park, was discussed at the regular meeting of the
Board of Commissioners, January 13, 1958.
Due to the fact that formal request was not presented there
was no official action taken. However, the Board unanimousl~
concurred in f'e.vor.'of the vacation.

Gentlemen:
As stated in my letter to your village dated August
26, 1957, in the matter of the Feehanville's right to
certain contribution arising by reason of the detachment
proceedings as had in the County Court mr Cook County,
Illinois, case #57 Co. 897.
In that proceeding there is appended to the order
of detachment, the withdrawal or the petition's prayer
of ascertainment of the village's proportionate share, and
in lieu thereof asks that the share of the village in the
cost of reconstruction, widening, repair and maintenance
work on the outlet and the main ditch within the corporate
limits of the drainage district under control of the
Feehanville Drainage District which shall be born by the
village by the medium of a petition.
Before filing such petitio~ arid asking the court
in that same proceeding to fix or determine the share to
be borne by your village, the cownissioner suggested that I
as attorney for the drainage district, contact you on the
matter, so that li tigation may be avoided, in the interests
of the two municipalities involved.

Trustee Norris reported that Mr. Frank Lynn has been
instrumental in obtaining the consent of property owners
along Central Road to the proposed widening of Ventral
Road.
Village Manager Appleby stated that Mr. Russell Smith
of the Grade School Board has expressed the willingness to
cooperate with the Village of Mount Prospect to secure a
4 lane highway on Central Road.
It was moved by Trustee Airey and seconded by
'I'rustee Casterline that the Village Manager be authori'zed
to have the Village Engineers prepare the necessary pre-
liminary cost estimates to determine special assessment
districts in connection with the proposed sidewalk special
assessment program, the cost of such estimates not to
exceed $200.00, and in the event that a special assessment
project against which this cost would be chargeable is not
put through, that the Village guarantee payment of said
amount from corporate funds. The President put the question
and the Clerk called the roll, wi th the following response:

Mr. Fred Buhrke commented that he fel tit rather odd
the way the Village Treasurer was let go. He further
stated that citizens who he had talked with were stunned
a~ the action. Trustee Airey answered by saying that citizens
were sometimes unaware of the facts.
Mr. James 6onroy stated that he had also heard comments
from citizens in which they expressed dissatisfaction with
the Board's action with respect to Mr. Hinz. Trustee Airey
answered comments both from Mr. Conroy and lll[r. Buhrke.

Prospect was unique among villages in that it has not needed
to resort to the issuance of tax anticipation warrants, as
do 90% of the other villages and towns in the State of
Illinois.
Mr. Mokate requested additional information about the
blue print for action for 1958.
There being no further business to come before the
Board, a motion was made by Trustee Broad and seconded by
Trustee Casterline that the meeting be adjourned. The
President put the question and the vote was taken by
acclamation, whereupon the President declared the motion
carried and the meeting regularly adjourned at lO:38 P.M.

declared the motion carried.
Trustee Schlaver made the following motion which was
seconded by Trustee Norris:
"I move that the proposal of Badger Meter Manufacturing
Company dated December 27, 1957 for supplying water meters
to the Village of Mount Prospect for the year January l4, 195
to January l4, 1959 be accepted and that the Village Manager
be authorized to sign the acceptance thereof on behalf of
the Village.1t The President put the question and the Clerk
called the roll, wit~ the following response: Ayes: All;
Nays: None, whereupon the President declared the motion
carried.
It was moved by Trustee Broad and seconded by Trustee
Willer that the Village Attorney be directed to prepare an
ordinance to amend the Mount Prospect Building Code, changing
the fire rating on construction from 40 minutes to 60 minutes
