MINUTES OF A REGULAR MEETING OF
THE PRESIDENT A1~ BOARD OF TRUSTEES
HELD IN THE MUNICIPAL BUILDING,.
MT. PROSPECT, ILLINOIS ON TUESDAY,
MARCH 18, 1958.
The meeting was called to order at 8:38 P.M. by President Lams
and the Clerk was then directed to cal1 the roll.
On roll call, the following Trustees answered "Present: Broad,
Norris, Schlaver, and Willer. Absent: Trustees Airey and Casterline.
Ali Trustees having previously received copies of the minutes of
a meeting held March 11, 1958, a motion was made by Trustee Norris and
seconded by Trustee Broad that the minutes be approved as submitted.
The President put the question and the Clerk called the roll, with the
following response: Ayes: Trustees Broad, Norris, Schlaver and Willer.
Nays: None; whereupon the President declared the motion carried and
said minutes approved as submitted.
Trustee Casterline arrived and took his seat at 8:40 P.M.

Dear Sir:
I am enclosing petition of the Cosmopolitan National Bank for
an .Amendment and Variation to Zoning Ordinance of Mount Prospect,
Illinois.
It is my under standing that this petition is to be sent to you
with the request that a meeting be set for public hearing before the
Zoning Board of Appeals at the earliest date consistent with that
body's schedule.
I am also enclosing check for $125.00, which I am advised is
the filing fee and includes cost of publication of notice.

Your Petitioner, COSMOPOLITAN NATIONAL BANK OF' CHICAGO, as Trustee,
by its attorneys, Rose & O'Keefe, states:
1. The Petitioner, as Trustee, is the holder of the legal title
of the foLLowing described real eata te:
Lots 1 through 24 inclusive in Block 5 of Prospect Park
Country Club subdivision, being a subdivision of the south-
east one-quarter of Section 11 and the south 15 acres of the

east one-half of the northeast quarter of said Section 11,
all in Township 41 North, Range 11 East of the Third
Principal Meridian.
2. This property is a parcel on the west side of Elmhurst Road
between Shabonee Trail and Lincoln Street with a frontage of 600 feet
on Elmhurst Road and a depth of 150 feet. The property has been platted
of record into 24 lots each 25 feet in width.
3. This property is presently classified in the R-2 District under
the zoning ordinance of the Village of Mount Prospect, in which district
Petitioner is permitted to erect duplex homes on lots 80 feet in width
or single family homes on lots 25 feet in width. (This latter condition
arises because of the zoning ordinance expressly exempts from the lot
size requirements for single family homes those lots platted of record
prior to the adoption date of the 1944 ordinance.)

4. Petitioner wishes to erect on said premises four multiple-familJi
residential buildings of a design known as garden apartments, the exterior
appearance of which will be as shown in the photograph attached hereto
and made a part hereof as exhi bi t tlA It. PeU tioner desires to provide in
these buildings an aggregate of 52 rental units.of which 40 would have twc
bedrooms and 12 would have one bedroom. The buildings, exclusive of walks
and stairs, would occupy 21 per cent of the total land area of the parcel
and would be 1,730 square feet of lot area per residential unit.

5. In order for Petitioner to improve this property as described,
it will be necessary to obtain changes in the zoning ordinance by way of
variation and amendment in two respects:
(a) To permit the use of the property for buildings
containing more than two dwelling units; and
(b) to permit the square feet of lot area per dwelling
units to be not less than 1,730 square feet.
6. There are practical difficulties in the application of the
present provisions of the zoning ordinance of Mount Prospect, Illinois
to this property and the changes requested by Petitioner will be in the
best interests of the community.
WHEREFORE, Your Petitioner prays that it be granted the following
relief under Sections 19 and 20, as amended, of the Mount Prospect,
Illinois zoning ordinance:
That the aforesaid property be reclassified from the R-2
District to the R-3 District and that a variation be granted
to Petitioner, its assigns or transferees, permitting not
less than 1,730 square feet of lot area per dwelling unit,
and that the Building Commissioner of the Village of Mount Prospect be
directed to issue such permits as may be required in conformity with the
relief granted Petitioner.
Your PETITIONER FURTHER REQUESTS that this matter be referred to
the Board of Zoning Appeals of the Village of Mount Prospect, Illinois
in order that the necessary public hearing may be noticed and held thereon
at which hearing ~etitioner will submit evidence, including plans, of the
exact nature of the proposed improvements on the aforesaid property.

its annual Doughnut Day in Mount Prospect.
This year our tag day will be held on Fri.day, June 13th.
'fhe funds raised in our tagging effort help to finance the Army's
general welfare work in the greater Metropolitan area. They are
also used to meet emergency and disaster needs in individual
villages and towns.
Listed on the enclosed sheet are the variuus types of services
rendered by the Army during the past year.

The $1,000 contribution from the Pure Oil Company will be
combined with funds we now have on hand and will enable us to
purchase an acre of ground to enlarge our present site to 2-1/2
acres. As we now have almost 100 children em;olled, you can see that
this additional area has been badly needed and will be deeply
appreciated by all.

Trustee Willer read 2 letters, but suggested that because of
their length, the full text of both letters be omitted from the
minutes.
1. A letter address to ~tr. Ra~~ond L. Willer, Chairman,
Judiciary Committee from Mr. J. V. Springrose, 911 S.
Ioka dated March 14, 1958. In this letter Mr. Springrose
expressed the opinion that during a meeting of the Board
of Appeals on February 28, 1958, there was improper and
incomplete testimony at the hearing ,of Case 58-2.
2. A letter addressed to Mr. Raymond L. Willer, Chairman
Judiciary Committee, from tIT. Robert J. Downing, Village
Attorney dated fl~rch 17, 1958. In this letter, Mr.
Downing expressed the opinion that action taken by
the Board of Appeals to administer the oath, was in
substantial compliance with the ordinance and State
Statute.

Gentlemen:
As to Case 58-3: Case 58-3 concerns itself with a lot located on
Northwest Highway between George Street and Albert Street. The petitione
William Kunkel, 743 Lee Street, Des Plaines, requested a rezoning of said
lot from R-l, single family residence, to B-3, Business. The Board of
Appeals found that the lot in question was adjoined on both sides with
lots zoned Business. It also fOlmd that Northwest Highway at the point
in question is a heavily trafficed street. Based upon these findings, th
Board recommends by a vote of seven to zero that a rezoning petition be
granted.

It was moved by Trustee Willer and seconded by Trustee Casterline
that the Village board concur with the recommendations of the Board of
Appeals pertaining to Case 58-3 and that the Village Attorney be directed
to prepare the necessary ordinance to bring about the zoning change.

Trustee Willer continued by reading that portion of the letter
from the Board of Appeals pertaining to Case 58-4 as follows:

As to Case 58-4: Case 58-4 concerns itself with six lots located between
Wille Street and Pine Street and bounded on the south by Northwest
Highway. The petitioner, Roy Wille, requested that three of the lots,
which are p. resently ~ified 1=1, be rezoned to B-1 and that three lots

presently classlfled , be rezoned to I-I. The Board of Appeals found
that the three lots zoned I-I are presently used for the retailing of
certain lumber items, coal, gravel and stone, that it is the petitioner's
intention to discontinue the sale of said items and to upgrade the
property in question so as to insure that it will be developed for
business use in confonnity with the general plan of development proposed
by the Kincaid report for the central business district, that this portio!
of the petition was definitely favorable to the Village in that it
voluntarily sought to advance the plans of the Village's planning. As to
the three lots presently zoned B-Businees, petitioner requested a down-
grading to I-I, that said downgrading would be for the sole purpose
of storing certain minor lumber items so as not to be in violation of the
ordinance classifying the property for business use only. Since the use
proposed for these lots does not essentially vary their present use and
since the petitioner had voluntarily sought to upgrade the aforementioned
three lots to B-1, it was felt that the advantage of classification could
nnt under any circumstances be harmful to the best interests of the
Village. Therefore, the Board of Appeals by a seven to zero vote
recommends the granting of said petition for rezoning in accordance with
the petitioner's request.
It was moved by Trustee Willer and seconded by Trustee Schlaver
that the Village Board con~ur with the recommendation of the Board of
Appeals pertaining to Case 58-4 and that the Village Attorney be
directed to prepare the necessary ordinance to bring about the zoning
change. The President put the question and the Clerk called the roll,
with the following response: Ayes: Trustees Broad, Casterline, Norris,
Schlaver and Willer. Nays: None. Absent Trustee Airey; whereupon the
President declared the motion carried.
Trustee Willer continued by reading that portion of the letter
from the Board of Appeals pertaining to Case 58-5 and 58-6 as follows:
As to Case 58-5: Case 58-5 concerns itself with property consisting
of approximately seven acres lying south of Rand Road and bounded on
the south by Highland Avenue. The Board of Appeals, at the request
of the petition together with the request of certain residents,
continued this matter for one month.

As to Case 58-6: Case 58-6 consists of three acres of property lying
on the southwest corner of Rand Road and Louis Street and bounded by
Thayer Avenue on the south. The petitioner, Arthur Reese of 901 East
Rand Road, requested the rezoning of a part of the property to R-l,
the balance to B-3, Business. The property in ~uestion is presently
in the County of Cook and zoned F-Farming by the County. The petition
for rezoning was coupled with a petition for annexation. 'I'he Board
of Appeals found that the classifications re~uested by the petitioner,
if permitted, especially as to the B-3 request, would constitute strip
zoning of the most undesirable type. rrherefore, the Board of Appeals
by a vote of seven to zero recommended that said petition be denied.

At the request of Trustee Willer, Case 58-6 was referred back to
the Judiciary Committee by President Lams.
Trustee Willer referred to a petition to zone certain property
and a petition to annex submitted by the Western National Bank of
Cicero under Trust No. 1441 and referred to by Mr. David S. McCoy
in a letter of transmittal as Brickman Manor Subdivision, Rand and
Foundry Roads. This matter was referred to the Judiciary Committee.
Trustee Airey arrived and took his seat at 9:08 P.M.
It was moved by Trustee Casterline and seconded by Trustee
Willer that the Village Manager be authorized to direct the install-
ation of street lights at the foJlowing locations:

Trustee Casterline and President Lams commented favorably on
Judge Gould's handling of approximately 50 cases heard before the
Folice lAagistrate on March 15, 1958 and involving failure to display
a Village automobile license sticker.
It was moved by TTIlstee Airey and seconded by Trustee Broad that
the Village of Mount Prospect Treasurer's report for the period ending
February 28, 1958 be approved as corrected and placed on file. The
President put the question and the Clerk called the roll, with the
following response: Ayes: Trustees Airey, Broad, Casterline, Norris,
Schlaver and Willer. Nays: None; whereupon the President declared the
motion carried.

that the List of Bills for a period through and including March 17, 1958
be approved for payment. The President put the question and the Clerk

Trustee Schlaver referred to several problems of the Water Depart-
ment and commented on a hydrant located at S. Albert and Northwest
Highway; stating that it failed to operate during a recent fire, that
this particular type of hydrant is manufacturer's discontinued and parts
are no longer available and suggested that hydrants of this type be
replaced with a newe~ type hydrant.

ROAD. It was moved by Trustee Norris and seconded by
Trustee Broad that Resolution 5-58 be adopted. The Presiden1
put the question and the Clerk called the roll, with the
following response: Ayes~ Trustees Airey, Broad, Casterline,
Norris, Schlaver and Willer. Nays: None; whereupon the
President declared the motion carried and Resolution 5-58
formally adopted.
Trustee Norris commented on the affects.of the recentl~
installed fl2HOUR LIMIT PARKING'l on Prospect Avenue from Main
Street to Central Road and he was supported in his views by
Trustee Schlaver. Police Chief Whittenberg advanced the
opinion that the 2 Hour Limit Parking signs should be retain~
in that area. It was moved by Trustee Norris and seconded b~
Trustee Broad that the Village Manager be directed to have
"2 Hour Limit Parking" signs placed on both sides of EvergreE
Avenue from Elmhurst west to I-Oka. ~he President put the
question and the Clerk called the roll, wi th the following

Schlaver and Willer. Nays: None; whereupon the President

A suggestion made by Trustee Willer to consider an
ordinance prohibiting commuter parking in residential areas
was referred to the Judiciary Committee by President Lams.
Trustee Broad read a proposed ordinance for the first

MISCELLANEOUS REQUIREMENTS FOR PRIVlll' E GARAGES. It was movec
by Trustee Broad and seconded by Trustee Norris that Ord-
inance No. 600 be passed. The President put the question and
the Clerk called the roll, with the following response:
Trustee Airey, Broad, Casterline, Norris, Schlaver and
Willer. Nays: None; whereupon the President declared the
motion carried and Ordinance No. 600 passed and approved.
It was moved by Trustee Broad that the Village Manager
be directed to write to the owners of property consisting
of Wille Street between Sha Bonee andoCouncil Trail and to
ask for the voluntary improvement of said property. After
comments by Trustee Willer and President Lams and at the
suggestion of President Lams, Trustee Broad withdrew his
motion.
It was moved by Trustee Willer and seconded by Trustee
Airey that the Board approve the Petition for Annexation
submitted by John and Mae Moehling and consisting of 2 lots
located at the southwest corner of Lonnquist and Byron Court;
and that the Village Attorney be directed to prepare the
necessary ordinance to bring about the annexa ti on. 111e

the following response: Ayes: Trustees Airey, Broad, Casterli
Norris, Schlaver Bnd Willer. Nays: None; whereupon the
Presiden t declared the motion carried.
It was moved by Trustee Willer and seconded by 'I'rustee
Broad that the proposed zoning ordinance for the Village of
Mount Prospect as prepared by Evert Kincaid & Associates be
referred to the Board of Appeals and the Plan Commission for
study and recommendation. The President put the question and

Trustee Willer referred to differences between names
commonly used end names used .for map designations of Ma.c
Arthur Drive or Ma.c Arthur Boulevard and Elmhurs t :Avenu~::'or
ElmhurBt Road. He suggested that action be taken by civic
groups to bring about an agreement on such controversial
names for the above two thoroughfares.

Village Manager Appleby informed the Board of a problem
confronting Mr. Erwin M. Hurt pertaining to property located
on the west side of Main Street and between Central Road and
Henry Street.
It was moved by Trustee Willer and seconded by Trustee
Norris that the Board concur in the recommendation and plann-
ing of the State Highway Department with respect to side-
walks on the west side of Main Street from Henry Street to
Central Road. The President put the question and the Clerk
calledtbe roll, with the following response: Ayes: Trustees
Airey, Broad, Casterline, Norris, Schlaver and Willer. Nays:
None; whereupon the President declared the motion carried.
Village Manager Appleby informed the Board that he had
received the information that the 90 day U. S. Treasury
notes purchased by the Village with Special Assessment Funds
will earn I.S3%interest.
Mr. William Mott commented on progress of proceedings
pertaining to the Des Plaines, Arlington Heights, Mount
Prospect and Palatine Water Commdssion.
Mr. Mokate commented on lack of sidewalks and a full
width street on Elmhurst Avenue between Northwest Highway
and Henry Street. He also commented on the proposed
entrances to the Hurt property on Central Road, immediately
west of Main Street. Mr. Mokate protested the lack of cross-
ing guards at the intersection of Main and Central Road for
the days of December 3, 4 and S. He suggested an underpass
or overpass at this intersection. Police Ohief Whittenberg
expressed the dire need for more crossing guards. Trustee
Casterline suggested that the job be publicized as a public
service.
Mr. O'Connor requested that reference to "Do not apply
during freezing weather" be omitted from future Village auto-
mobile license stickers. He also made other comments relative
to Village license stickers.
There being no further business to come before the Board,
it was moved by Trustee Broad and seconded by Trustee Airey
that the meeting be adjourned. The President put the
question and the vote was taken by acclamation; whereupon the
President declared the motion carried and the meeting regularly
adjourned at 10:41 P.M.
