A motion was then made by Trustee Viger, seconded by

Airey, to authorize expenditure of an additional $100.00 to
take care of the removal of the tree at Thayer and School
Streets. The President put the question, the Clerk called th
roll, with the following response: Ayes: All; Nays: None.
Thereupon the President declared the motion carried.
A motion was made by Trustee Willer, seconded by Wier,
that the fees for the Building Permit issued for 405 Dale, in
Northwes Meadows be made available to cover the work done in
filling the excavation. The President put the question, the
Clerk called the roll, with the following response: Ayes: All

Airey, to authorize expenditure of a sum not to exceed $4,000,
for the purchase of a three-quarter ton stake truck for the
Street Department and a panel truck for the Water Department !

BUILDING, MOUNT PROSPECT, ILLINOIS,
ON TUESDAY MAY 24, 1955
The meeting was called to order by President Lams at
9:15 P. M. and the Clerk was then directed to call the roll.
On roll call the follow! ng Trustees answered ttpresen t":
Airey, Wier, Willer and Wilson, Trustees Schlaver and Viger
were absent on roll call.
The Wm. Blair & Company offer dated May 17, 1955, to
buy the 1370,000 Water Revenue Bonds was then presented by the
Village Clerk after the bid had been on file in the Village
Clerkts office for one week for public inspection.
Resolution No.8-55 entitled: ftRESOLUTION AUTHORIZING
THE PRESIDENT AND VILLAGE CLERK TO SIGN $370,000 WATER REVENUE
BONDS DIRECTING DELIVERY TO THE PURCHASER OF S~ID BONDS, AND
DESIGNATING THE PAYING AGENTtt was then read. A motion was then
made by Trustee Willer, seconded by Wilson, that this Resolutio
be adopted. The Presiden t put the question, the Clerk called ___
the rOl+, with the rollowing response: Ayes: all; Nays: None.
Thereupon the President declared the motion carried and said
Resolution passed and approved.
A motion was made by Trustee Willer, seconded by l"-'iIson,
that the Village Attorney be authorized to appear on behalf
of the Village at the Zoning Hearings to be held Friday May 27,
in the Municipal BUilding. The President put the ~uestionA the

Trustee l..Jiller then in troduced Ordinance No. 439, entitled:
"AN ORDINANCE iU1ENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORD-
INANCE AS AMENDED". A motion was then made by Trustee Willer,
seconded by Wier, that the Ordinance be passed. The President
put the question, the Clerk called the roll, with the following
response: Ayes: All; Nays: None. Thereupon the President declared
the motion carried, and said Ordinance passed and approved.
Trustee willer then introduced Ordinance No. 440 entitled:
ttAN ORDINANCE AMENDING 1'HE VILLAGE OF MOUNT PROSPECT ZONIN G ORD-
INANCE AS &~ENDEDtt. A motion was then made by Trustee Willer,
seconded by Wier, that this Ordinance be passed. The President
put the question, the Clerk called the roll, with the following
results: Ayes: All; Nays: None. Thereupon the President declared
the motion carried and said Ordinance passed and approved.
A motion was then made by Trustee Willer, seconded by Wilson
to auttorize the Village Attorney to prepare an~ ordinance to alter 1
the b-c.ilding code to include: (1) All building plans mus t bear the
seal of a licensed architect or structural engineer, and a certifi-
cation by him to the effect that the plans conform to the code re-
quirements. (2) Plans must include a plot plan prepared by the
architect or structural engineer showing the position of the build-
ing on the property. The President put the question, the Clerk
called the roll, with the following response: Ayes: All; Nays: None;
Thereupon the President declared the motion carried.
Trustee Viger arrived and took his place at 10:07 P. M..
A motion was made by Trustee Willer, seconded by Wier, to
authorize the Village Attorney to prepare an\agreement between
builders and the Village for necessary deposits to be made to insure
repair of broken sidewalks, street cleaning and similar damage to
public property that might occur during construction, and also a
deposit from each builder guaranteeing the pouring of a foundation
within a reasonable time after the hole is dug. The President put
the question, the Clerk called the roll, with the following response:
Ayes: all; Nays: None. Thereupon the President declared the motion
carried.
A motion was made by Trustee Wilson, seconded by Viger, to
approve the plans and specifications for School Street improvementsas
presented by the Village Engineers under date of May 12, 1955. The
President put the question, the Clerk called the roll, with the
following response: Ayes: All; Nays: None. Thereupon ~~e President
declared the motion carried.
A motion was then made by Trustee Wil'son, seconded by Wier,
that the Sanitary District of Chicago Permit No. 1955-85 be accepted
and that the President and Village Clerk be authorized to sign thia
permit on behalf of the Village. The President put the question,
the Clerk called the roll, with the following response: Ayes: All;
Nays: None. Thereupon the President declared the motion carried.
A motion was made by Trustee Wilso n, seconded by Wier, to
approve the plans and specifications submitted by Consoer, Townsend
& Associates under da.te of Harch 10, covering construction of sewers,
water mains, and pavement improvements in Owen Street from Central
to Thayer, and William Street from Central to Henry. The President
put the question, the Clerk called the roll, with the following
response: Ayes: All: Nays: None. Thereupon the President declared
the motion carried.

the V11l~e Attorney beau-chor.ized ito"draw up an agreement between
Town & Country Construction Co., and "the Village of r-rount Prospect,
providing that the Village of Mount Prospect shall issue not more
than four building permits on Elmhurst Road in Country Club
Terrace Subdivision to Town & Country Construction Co. upon payment
to cthe Village of the usual fees and costs for building permits
plus the sum of $6,000.00 per lot into an escrow fund created to
guarantee the Village that Town and Country Construction Co. shall
furnish to the Village of Mount Prospect satisfactory performance
bonds to complete all improvements as approved by the Village of

Mount Prospect Engineers within 60 days from date. In the
event that Town & Country Construction CO$ is unable to furnish
said performance bond within 60 days, 'all money paid into said
escrow fund is to be retained by said Village as liquids.ted
damages. Upon receipt of satisfactory perrormance bond within
the 60 days from date in conformance with said escrow agreement
said $6000.00 per lot to be refunded to Town & Country Construc
tion Co., and that the President and Village Clerk be authorize
to sign such an agreement upon its preparation by the Village
Attorney. The President put the question, the Clerk called the
roll, with the following response: Ayes: Trustees Airey, Viger,
Wier, and Willer. Nay: Trustee Wilson. Absent: Trustee Schlave
Thereupon the President declared ~he motion carried.
A motion was then made by Trustee Wilson, seconded by
Willer, to accept the special escrow agreement submitted by
Mount Prospect State Bank and pertaining to special assessments
to be levied for the paving of the side streets covered by
special assessment Ordinance No. 54 and that the President and
Village Clerk be authorized to sign the agreement on behalr or
the Village. The President put the question, the Clerk called
the roll, with the following response: ayes: All; Nays: None.
Thereupon the President declared the motion carried.

Re: Supplements to Long Range Plan
and One Year Construction Program
Gentlemen:
In accordance with your request we are enclosing rive (5) copie
of a resolution, together with forms BLR M-522, which provides
for additions to the Long Range Plan for the years 1952 to 1957
and to the One Year Construction Program for 1955.
The Long Range Plan is amended to include the installation of .
traffic control signals at the intersection of Northwest Highwa:
and Central Road: Village participation in the cost of providi:
grade crossing Protection of C & N W R R and and interconnectio:
with traffic signals at Northwest Highway and Central Road; and
construction of concrete sidewalks on Elmhurst Road from Manawa
Trail to Council Trail. The One Year Construction Program is
amended to include the installation of traffic control signals
and the construction of concrete sidewalks.
If the resolution meets with your approval and is adopted,
kindly submit four (4) certified copies to Mr. J. P. Tuthill,
District Engineer, Illinois Division of Hi ghways, 160 N. LaSal.
Street, Chicago, Il1inois for approval.

Gentlemen:
We wish to advise you that we have been retained by Mr. Theodore C.
Moehling for the prepanation of plans and specifications and super-
vision of construction for Sanitary sewers, storm sewers, water mains,
and paving improvements in the second addition to Council Trail Estates.
We have completed our field survey and are presently preparing plans
for these improvements which we hope to submit to the Board for
approval in the near future.
