ORDINANCE NO. 2808
AN ORDINANCE GRANTING A FRONT YARD VARIATION FOR
PROPERTY COMMONLY KNOWN AS 1590 SOUTtI 13U$SE; ROAD
WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did
conduct a public hearing on the 7th day of June, 1978. at the hour of 8: 00 p.m. .
at the Public Safety Boardroom, and did hear Case No.' 39-V-78. pursuant to
proper legal notice; and
WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a front yard variation to allow the petitioner to erect a metal
canopy over gasoline dispensing islands to within ten feet six inches (10' 6f!)
of the property line adjacent to Busse Road on the lot legally described hereinbelow;
and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 39-V--78; and
WHEREAS. the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on July 12. 1978. and did review the recommendations of the
Zoning Board of Appeals in Case No. 39-V-78; and
WHEREAS. the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under said
Case No. 39-V-78; and
WHEREAS. the Pref:;ident and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY ,THE PRESIDENT AND BOARD OF TRUSTEE~
OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 39-V-78
being legally described as follows:
Lot tin Bulk Petroleum Corporation Subdivision in the East
1/2 of the Southeast 1/4 of Section 15, Township 41 North,
Range 11, East of the Third Principal Meridian, in Cook
County, Illinois;
is currently zoned under the Zoning Ordinance of the Village of Mount PrOSL)ect
as B-4 (Business - Retail and Servi~e) District. which zoning classification
shall remain in effect subject to the variation granted herein:
That the yard abutting the frontmost lot line of the subj ect property
adjacent to Busse Road be reduced to ten feet six inches (10' 6Tf),
as shown upon the site plan which is attached hereto and hereby
made a part hereof as Exhibit I.
SECTION TWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except the variation noted in SECTION ONE
heretofore mentioned.

ECTION THREE: That the Director of Building and Zoning of the Village of
:Yount Prospect is hereby authorized to issue a building permit for construction
. accordance with the variation hereinbefore mentioned.
ECTION FOUR: That the variation granted by this Ordinance shall be null and'
oid and of no force and effect whatsoever unless an application for a building
ermit pursuant to such variation is made and construction commenced within
ne (1) year of the date this said Ordinance becomes effective.
ECTION FIVE: That this Ordinance shall be in full force and effect from and
ter the'removal of all non-conforming uses (including non-conforming
dvertising signs and billboards) from the subject property, and the passage,
pproval, and publication of this Ordinance in the manner provided by law.
