AN ORDINANCE CHANGING THE FILING FEES FOR
HE.liRINGS BEFORE THE Z01~lf,TG B01~R'D' OF"":P~PPE.liI)'S.
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
conduct a Special Public Hearing under Case No. 4-Z-78, on January 5, 1978,
and a Public Hearing 011 April 27, 1978, on a request to amend the schedules
of filing fees contained in Sections 14.602, 14.702, 14.803, and 14.902 of the
Municipal Code of the Village of Mount Prospect (the Zoning Ordinance) for
hearings held by the Zoning Board of Appeals of the Village of Mount Prospect
on requests for variations, special uses. zoning amendments, and appeals: and
WHEREAS, notices of the aforesaid Special Public Hearing and Public Hearing
were made and published hi the manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees of the Village of Mount
Prospect that the request to amend the schedules of filing fees in the Zoning
Ordinance, requested under Case No. 4-Z-78) be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will
be attained by the adoption of the following Ordinance regarding fees for the
Zoning Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE 'VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That paragraph 2 of subsection C of Section 14.602 of the
Municipal Code of the Village of Mount Prospect of 1957, as amended, be and
the same is hereby further amended in its entirety by changing the filing fees
for hearings held by the Zoning Board of Appeals on requests for variations;
so that hereafter the said paragraph 2 shall be a.nd read as follows:
"2. Payment of filing fees:
a. For variance requests concerned with lot size, yard size,
parking and/or land use:
1) All fences -- Fifty Dollars ($50).
2) Signs -- Two Hundred Dollars ($200).
b. For all other variance requests:
1) Where the area of the tract of land concerned consists of
17,000 square feet or less -- Fifty Dollars ($50).

2) Where the arsa of the tract of land concerned consists of more
than 17,000 square feet -- Two Hundred Dollars ($200).
c. Special hear'ings will be held at a time mutu~lly agreed upon by the
petitioner and tl!.0 Zoning Board of Appeals provided f~rther that
the petitioner pay a special hearing fee in an amount equal to TV70
Hundred Donars ($200) over and above the foregoin.g scheduled
fees.
d. In the event a petition for a variation is heard in conjunction with
a petition for an amendment. no filing fee will be
charged for the variation petition. "
SECTION TWO: That paragraph 2 of subsection C of Section 14.702 of the
Municipal Code of the Village or Mount Prospect of 1957, as amended, be and
the same is hereby further amended in its entirety by changing the filing fees
for hearings held by the Zoning Board of Appeals on requests for special use;
so that hereafter the said paragraph 2 shall be and read as follows:
"2. Payments of filing fees; the amount of which shall be determined on
the basis of the area of the land with which the special use is concerned
pursuant to the following schedule:
a. Regular hearings:
1) Less than one acre -- One Hundred Twenty Five Dollars ($125).
2) One acre but less than five acres in area -- Two Hundred
Fifty Dollars ($250).
3) Five acres but less than ten acres in area -- Nine Hundred
Dollars ($900).
4) Ten acres but less than fifteen acres in area -- One Thousand
Two Hundred Dollars ($1,200).
5) Fifteen acres or more ill area -- One Thousand Five Hundred
Dollars ($1,500).
b. Special hearings will be held at a time mutually agreed upon by the
petitioner and the Zoning Board of Appeals provided further that
the petitioner pay a special hearing fee in an amount equal to Two
Hundred Dollars ($200) over anda.bove the foregoing scheduled
fees.
c. In the event a petition for a special use is heard in conjunction with
a petition for an amendment, no filing fee will be charged
for the special use petition. "
SECTION THREE: That paragraph 2 of subsection C of Section 14.803 of the
Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the
same is hereby further amended in its entirety by changing the filing fees for
hearings held by the Zoning Board of Appeals on requests for text and mt,lp e.men -
ments; so that hereafter the said paragraph 2 shall be and read as follows:

"2. Payment of filing fees, pursuant to the following schedule:
a. Regular hearings:
1) Text amendmel1:t -- Five Hundred Dollars ($500).
2) Map amendment, determined on the basis of the area of the
land which is the subject of the map amendment:
a) Less than one acre in area -- One Hundred Twenty
Five Dollars ($125).
b) One acre but less than five acres in area. -- Seven
Hundred Dollars ($700).
c) Five acres but less than ten acres in area -- ~ine
Hundred Dollars ($900).
d) Ten acres but less than fifteen acres in area -- One
Thousand Two Hundred Dollars ($1,200).
e) Fifteen acres or more in area -- One Thousand Five
Hundred Dollars ($1,500).

SECTION FOUR: That paragraph 2 of subsection C of Section 14.902 of the
Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the
same is hereby further amended in its entirety by changingthe filing fees for
hearings held by the Zoning Board of Appeals on requests for notice of appeals;
"2. Payment of filing fees:
a. Two Hundred Fifty Dollars ($250) for regular hearing.

b. Four Hundred Fifty Dollars ($450) for special hearing. II
SECTION FIVE: That this Ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner provided by law.
