AN ORDINANCE GRANTING A FRONT YARD VARIATION
FOR PROPERTY LOCATED AT THE NORTHWEST
CORNER OF MEMORY L..4.NE AND EASTWOOD AVENUE

~HEREAS. the Zoning Board of Appeals of the Village of l\!ount Prospect did conduet
11 public hearing on the 27th day of ..Tuly. 1978. at the hour of S: 00 p.m., at the
t>ublic Safety Boardroom, aI!d did hear Case No. 46-V -78. pursuant to proper Il::'g~al
l1otice; and
WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did h'?2J:'
.his request for a front yard variation to allow the petitioner to con.struct a sing'le
amily :residence to within fifteen feet (15') of the property line adjucent to IvIemm'y

WHEREAS. tne Zoning Board of Appeals of the Village of Mount .Prospect did recorn...
mend to the Building Committee of the Board of Trustees of the Village of Mot!.Ji.t
Prospect the approval of this request under Case No. 4G.-V.-78; and
WHEREAS. the Building Committee of the Board of Trustees of the Village of MOin~t
Drospect did meet on August 16, 1978. and did review the recommendations of ~:he

. ^lHEREAS. the Building Committee of the Board of Trustees of the Village of :M01..mt
Drospect have recommended that the Bo~rd of Trustees of the Village of Mount

NOW, THER.EFORE. BE IT ORDAINED BY THE PRESIDENT AND aO,t\RDOJ? 'I'nUS~f'EES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY. ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 46.-V -78
being legally described as follows:
Lot 11 in Block 2 in Prospect Manor. being a subdivision of part of the
South 3/4 of the West 1/2 of the West 1/2 of Section 34, Township 42
North, Range 11 Ea.st of the Third Principal Meridian" in Cook Count's,
Illinois j
. s currently zoned under the Zoning Ordinance of the Village of Mount Prospect.
as R-l (Single Family Residence) District. which zoning classification shall r"'m~]hi
'n-2ffect subject to the variation granted herein:
That the yard abutting the frontmost lot line of the subject pr('lperty
adjacent to Memory Lane be reduced to fifteen feet (15') t as shown
upon the survey attached hereto and hereby made a part hereof as
Exhibit I.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the vnriation noted in SECTION ONE heretofore
mentioned.

ECTION THREE: That the Director of Building and Zoning of the Village of Mount
rospect is hereby authorized to issue a building permit feir construction in accord-
nce with the variation hereinbefore mentioned.
ECTION FOUR: That the variation granted by this Ordinance shall be null and
oid and of no force and effect whatsoever unless an application for a building permit
ursuant to such variation is made and construction commenced within one (1) year
f the date this said Ordinance becomes effective.
ECTION FIVE: That this Ordinance shall be in full force and effect from and
fter its passage, approval, and publication in the manner provided by law.
