ORDINANCE NO. 2819
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMl\;10NLY KNOWN AS 500-502 HILL STREET
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduc
a public hearing on the 10th day of August, 1978, at the hour of 8: 00 p.m., at the
Public Safety Boardroom, and did hear Case No. 48-V -78 t pursuant to proper legal
notice; and
WHEREAS t the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a variation to allow the petitioner to construct a single family resi-
dence to within twenty feet (20') of the property line adjacent to Hill Street on the
lot legally described her.einbelow; and
WHEREAS t the Zoning Board of Appeals of the Village of Mount Prospect did reCOIn
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 48-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on August 16, 1978, and did review the recommendations of the
Zoning Board of Appeals in Case No. 48-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under said
Case No. 48-V -78; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE t BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTE S
OF THE VILLAGE OF MOUNT PROSPECT t COOK COUNTY>> ILLINOIS:
SECTION ONE: That the Zoning Ordinance of the Village of Mount Prospect be
varied with respect to the front yard requirement for land located in the H.-l
(Single Family Residence) District; so that the single family residence to be
located adjacent to and north of the north line of the public right--of-way known
as Hill Street and adjacent to and west of the west line of the public right-of-way
known as Eastman Court may be set back only twenty feet (20') rather than the
required thirty feet (30') from the said north line of Hill Street and that area
which is legally described as:
Lot 1 and Lot 18 of the Hill Street Subdivision of the East 400.0 feet of that
part of the North 1/2 of the Southeast 1/4 of the Northeast 1/4 of Section
34, Township 42 North t Range 11 East of the Third Principal l\1:eridian,
lying East of Rand Road, Cook County, Illinois.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variation noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of
:Mount Prospect is hereby authorized to issue a building permit for construction in
accordance with the variation hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be null and

'Void and of no force and effect whatsoever unless an application for a building
permit pursuant to such variation is made and construction commenced within one
(1) year of the date this said Ordinance becomes effective.

effect whatsoever until after its passage, approval, and publication, and such
time as an accurate plat resubdividing the said parcel descripe9. In ~AQIJQN
ONE hereinabove is recol;dedwith'the Recorder of Deeds of Cook County, Illinois:
a copy of which plat of resubdivision shall be attached hereto and hereby made a
part hereof.
