AN ORDINANCE AMENDING ORDINANCE NO. 2569,
GRANTING VARIATIONS FOR PROPERTY GEl\1ERALLY
LoeA TED ON THE NORTHEAST COltNER. OF KENS!NGTON
ROAD AND ELMHURST J;tOAD (ILLINOIS ROUTE 83)
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a
publichearing on August 24, 1978, at the hour of 8: 00 p . m . , in the Mount Prospect
Village Hall pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 51-V-78 pertaining to a request to erect a
savings and loan association on the south end of the property described herein-
after; and did recommend the amendment of the variation heretofore granted
under Ordinance No. 2569; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on September 13, 1978, and did consider the recommendations of
the Zoning Board of Appeals under Case No. 51-V-78; and
WHEREAS, the Building Committee have recommended that the President and Board
of Trustees of the Village of Mount Prospect concur in the recommendations of the
Zoning Board of Appeals to allow the variations as presented in Case No. 51-V-78;
and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect ha e
reviewed the matter herein and have determined that the same is in the best interes e
of the Village of Mount Prospect;
NOW. THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUS'rE S
OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SECTION ONE: That subsections (a). (b), and (c) of SECTION ONE of Ordinance
No. 2569, passed and approved July 1, 19'15, be amended in their entireties so as
to allow a change in use from an existing restaurant use to a savings and loan
(financial institution) use; so that hereafter the said subsections (a). (b). and (c)
of said SECTION ONE of Ordinance No. 2569 shall be and read as follows:
"
(a) That the O'\.,ners of the land described above shall have the right
to construct u savings and loan association building at the south-
western corner of the Randhurst Shopping Center properties, and
that such building shall be free-standing -- being in no way
connected or joined to the existing main shopping center building
thereon;
(b) That the building design and layout shall be' similar to those plans
attached hereto and hereby made a part hereof as Exhibit I; and
(c) That the operation of the savings and loan association shall be clas-
sified as providing a retail service and shall be licensed as such
upon payment of the proper fees provided for such business within
Chapter 11 of the Municipal Code of the Village of Mount Prospect. TI
SECTION TWO: That all other requirements of the Municipal Code of the Village
of Mount Prospect shall be applicable, except those variations as specified in
SECTION ONE heretofore mentioned.
, SECTION TI:IREE: That the Director of Building and Zoning of the Village of
ount Prospect is hereby directed to .issue a building permit in accordarlCe with the
ariations hereinbefore mentioned.
ECTION FOUR: That the variantions granted by this Ordinance shall be null
nd void and of no force and effect whatsoever unless an application for a building
ermit pursuant to such variations is made and constrl~dion commenced within
ne (1) year of the date said Ordinance becomes effective.
'ECTION FIVE: That this Ordinance shall be in full force and effect from and
iter its passage, approval, and publication in the manner provided by law,
