ORDINANCE NO. 2824
AN ORDINANCE GRANTING A SPECIAL USE FOR
PROPERTY LOCATED AT 1326 WEST CENTRAL ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hol
Public Hearing on Case No. 36-SU-78, on May 25, 1978. at the hour 'Of 8: 00 p.m
in the Public Safety Building, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 36-SU-78 pertaining to a reqauest for ce1't<:l
special uses pursuant to the Mount Prospect Zoning Ordinance to permit (~el'ta'in
uses upon the property hereinafter described; and
WHEREAS, the Zoning Board of Appeals has recommended that the President anc
Board of Trustees of the Village of Mount Prospect allow the special use as presE
in Case No. 36-SU-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of MOD
Prospect did meet on June 14~ 1978, and did consider the recommendations of th
Zoning Board of Appeals under Case No. 36-SU -'i8; and
WHER.EAS, the Building Committee has recommepded that the President and BOal
of Trustees of the Village of Mount Prospect concur in the recommendations of tll
Zoning Board of Appeals to allow the special use as presented in Case No. 36-SU
and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
reviewed the matter herein and have determined that the same is in the best inte:
of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUS~
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the special use authorized and granted in SECTION TWO he
below is conditioned upon and shall be valid and effective only so long as:

During the term of this special use f no buildings, additions thereto. or
accessory buildings shall be constructed on the subject property; arid
B. The said special use granted in SECTION TWO hereinbelow shan :aot ru.n wit
the land, but shall be limited to that period of time wherein the subject pro-
perty is utilized by the Arlington Clu.b Beverage Company.
SECTION TWO: That, pursuant to the Mount Prospect Zoning Ordinance and in
I accord with the terms and conditions of this Ordinance. the following special USE
I is hereby authorized upon the subject property described in SECTION THREE
hereinbelow:
The operation of a retail sales business in conjunction vdth an
existing bottling works. whIch sales may include the selling of
beer, wine and soft drinks in the unrefrigerated original package
only in addition to the other normal and usual sale of items manu-
factured on the premises.

SECTION THREE: That the special use authorized to be established in SECTION
TWO hereinabove shall be valid and effective upon the following property (herein-
above and hereinafter referred to as "subject property") legally described as:
West 38.76 feet of the South 200 feet that part North of the South 50 feet of
Lot H, and the East 61.74 feet of the South 200 feet that part North of South 50
feet of Lot G ~ all in Kirchoff's Sub. , a sub. of the N .E. 1/4 of the N .E. 1/4
of Sec. 10-41-11, theE. 1/2 of the N.W. 1/40ftheN.E. 1/4 of Sec. 10-41-11,
the N.W. 1/4 of the N.W. 1/4 of Sec. 11-41-11~ the N. 10 chs. of the S.W.
114 of the N . W. 114 of Sec. 11-41-11, being a tract of land 10 chs. wide from
N. to S. and 20.17 chs. long from E. to W., containing 20.17 acs. The
following in Sec. 33-42-11, the S. 1/2 of the S.W. 1/4, that p'art of the W.
1/2 of the N . W. 1/4 that lies S. of the C. & N . W .R .R . ~ the N . W. 1/ 4 of the
S.W. 1/4, that part of the N.E. 1/4 of the S.W. 1/4 that lies S. of the C. &
N.W.R.R. andtheW~ 14-1/2acs. of that part of the W. 1/2 of the S.E. 1/4
thatliesS. ofC. &N.W.R.R. Rec. May 22~ 1917;
which property has been zoned 1-1 (Light Industrial District), and which zoning
classification shall remain in full force and effect, subject to the special use granted
under the terms and conditions of this Ordinance.
SECTION FOUR: That the text of this Ordinance sh~ll be recorded in the Office of
the Recorder of Deeds or registered with the Registrar of Titles (as the case may be
of Cook County, Illinois.
SECTION FIVE: That this Ordinance shall be null and void and of no force and effec
whatsoever until after its passage, approval, and publication, and at such time as
an accurate plat resubdividing the said parcel described in SECTION THREE herein-
above is recorded in the Office of the Recorder of Deeds or registered with the
Registrar of Titles (as the case may be) of Cook County, Illinois; a copy of which
plat of resubdivision shall be attached hereto and hereby made a part hereof.
