ORDINANCE NO. _ 286~ _
AN ORDINANCE PROVIDING FOR THE
PLANNED UNIT DEVELOPMENT OF
PROPERTIES COMMONLY KNOWN AS
THE DAVEY TREE PROPERTY
WHEREAS, the Zoning"Board of Appeals of the Village of Mount Prospect did
heretofore conduct a public hearing under Case No. 69-Z-78, Case No., 70-V-78~
and Case No. 74- V -78, on the 26th dEW of December, 1978 and the 16th day of "
November, 1978, at the hour of 8: 00 p. m., pursuant to a request for a special
use in the nature of a Planned Unit Development; and
WHEREAS, a notice of the aforesaid public hearing was made in the manner pro-
vided by law and ptlblished in the October 9, 1978 and November 1, 1978
edition of a newspaper of general circulation within the Village of Mount Prospect;
and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
,Prospect has reviewed th~ .matter herein and has recommended the approval
thereof to the President and Board of Trustees of the Village of Mount Prospect;
and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the Building Committee'.s recommendation under Case
No. 69-Z-78, Case No. 70-V-78, and Case No. 74-V-78.regarding the subject
property;
NOW, THEREFORE, BE IT ORDAINEp BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That a special use permit be and is hereby granted to allow

(containing not more than 108 two bedroom dwelling units) upon the following
Idescribed property, hereinafter referred to as the "subject property":
I That part of the South East Quarter of the South East Quarter of
Section 15 and that part of the North East Quarter of North East 1/4 of
Section 22 all in Township 41 North, Range 11 East of the Third Principal
Meridian lying South of the Center line of Old Algonquin Road and North
of the South 5 acres of said North East Quarter of the North East Quarter and
East of a line 210 feet East of (measured at right angles to) and parallel with
the West line of said Quarter Quarter Section lines and West of a line 395. 14
feet East of (measured at right angles to) and parallel with the West line of
said Quarter Quarter Section lines, in Cook County. Illinois.
copy of which plat of subdivision of the subject tract is attached hereto and
ereby made a part hereof as Exhibit A; and which subdivision shall not be
esubdivided hereafter--in accordance with the special use permit granted herein.
ECTION TWO: That, pursu~nt to requeste1. variations for parking and
he use of required yards, the planned unit development hereinabove authorized
nd permitted shall be constructed pursuant to the land uses and standards

hown upon the Site Plan, atta.ched hereto and hereby made a part hereof as
xhibit B, except as may otherwise be provided herein, and as necessarily
odified to solve engineering layout and design problems at the time of the
onstruction of the said Planned Unit Development.
ECTION THREE: Richard Fanslow, as beneficiary with power of direction,
nd Harris Trust & Savings Bank, as owner of the subject property, shall
xecute and see to the recording of the "Restrictive Covenants" attached hereto
nd hereby made a part hereof as Exhibit C.
ECTION FOUR: That the Director of Building and Zoning of the Village of
ount Prospect is hereby authorized to issue (upon recording of the afore-
entioned Exhibits A and C and upon proper application for building permits)
uch permits as may be required for the construction of the said Planned Unit
evelopment--which construction shall be governed by the terms of Article
of the Mount Prospect Zoning Ordinance, this ordinance herein, and all
ther applicable ordinances of the Village of Mount Prospect .
-A. The owner shall cause the installation of fences and landscaping
as shown in the Landscaping Exhibit attached hereto and
hereby made a part hereof as Exhibit D.

B. Construction of public improvements on site and off. site shall proceed
pursuant to the Mount Prospect Zoning Ordinance, along with certain
fire lanes, shown upon Exhibit E attached hereto and hereby made a
part hereof.
C. Before the acceptance by the VillageS of ownership of anyon-site or off-
site water mains or sanitary sewer lines reflected in the said On-Site
Utility Plan (Exhibit F) attached hereto and hereby made a part hereof,
the owner of the subject property shall convey to the Village of Mount
Prospect sufficient non-exclusive easements (minimum 10 feet wide)
for the maintenance of such on-site or off-site water mains and sanitary
sewer lines and shall post with the Village bonds in a form approved by
the Village Attorney and in sufficient amount as to guarantee said con-
struction and installatim against defects in materials and/or workman-
ship for a period of two (2) years from the date of acceptance of said
water mains and sanitary sewer lines by the President and Board of
Trustees of the Village of Mount Prospect.
D. The storm water detention lake shown upon the Site Plan (Exhibit B)
shall be of a minimum .57 acre feet capacity. I
ECTION FIVE: That before occupancy certificates are-issued for the
evelopment, the Owner 'will cause a Plat of Open Space Easement to be
elivered to the Village of Mount Prospect.
A. These plats shall be recorded and shall contain such wording suf-
ficient to permanently guarantee the open space as shown on such
easement in accordance with the said planned unit development
and any amendments thereto.
B. That said Plats of Open Space Easement shall constitute a covenant
running with the land and shall be enforceable by the said Village
of Mount Prospect.
SECTION SIX: That this Ordinance together with all its exhibits and plans shall

be recorded in the Office of the Recorder of Deeds of Cook County, Illinois upon

completion of the Planned Unit Development herein; and the Restrictive Covenants
contained on Exhibit C hereto shall be recorded immediately upon the execution
thereof and the pass~ge and approval of ~his Ordinance.
SECTION SEVEN: That this Ordinance shall be in full force and effect from --and
after its passage, approval, and publication in the manner provided by law
and the recording the the Plat of Subdivision and Restrictive Covenants attached
hereto as Exhibits A and C, respectively.
