ORDINANCE NO. 2865
AN ORDINANCE GRANTING CERTAIN VARIATIONS
FOR. PROPERTY GENERALLY LOCATED AT THE
SOUTHWEST CORNER OF THE INTERS:I,\CTION

, WHEREAS, the Zoning Board of Appeals of the Village of IVlount Prospect did
meet on the 21st day of December. 1978; at the hour oi 8: 00 p.m. , at the l\Iount
Prospect Public Safety Building, and did hear Case No. 90-V -78, pursuant to
proper l~gal notice; and
I VIHEREA,S, the Zoning Board of Appeals of the Village of Mount Prospect dId
hear this request for certain variations from the Mount Prospect Zoning Ordinance;
and
I WHEREAS, the Zoning Board of Appeals of the Village of l\Iount Prospect did recom-
, mend to the Building Committee of the Board of Trustees of the Village of Mount I
Prospect the approval of this request under Case No, 90-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect has reviewed the matter herein and had recommended the approval
thereof to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
inter'ests of the Village of Mount Prospect;
, NOW. THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SEC'tION ONE.: That the property being the subject matter of Case No. 90-V -78
being legally described as follows:
Lot 2 in DiMucci's Resubdivision of Lots 3 through 7, both inclusive,
in Juhnke1s Subdivision of part of the Northeast 1/4 of Section 14,
Township 41 North. Range 11 East of the Third Principal Meridian,
Cook County, Illinois.
is currently zoned under the Zoning Ordinance of the Village of !'.!ount Prospect
as B'-1 (Business-Shopping Center) District, which zoning' classification shall
remain in effect subject to the variations granted herein;
(a) That the land described above shtll1 contain sufficient paved off-
street parking so as to provide a 9' x 20' parking space for each
300 square feet of gross floor area of the building and one 9' x 20'
par-king :3pace for each 100 square foot of public seating area in
establishments dispensing food or beverages for consumption on
the premises; and
(b) That, until February 1, 1980, the land described hereinabove
may continue to have more than one building located thereon
as well as less than four (4) stores in the shopping center;
provided l however, that:

(a) The owner or developer deposit with the Village Treasurer a cash
bond equal in amount to 100% of the Village Engineer's estimate of
the cost of the installation of thE=! required 5 foot wide public side-
walks within the public right-of-way adjacent to Elmhurst Roads'--
which deposit shall be made to guarantee the aforedescribed
installation and which deposit shall be made at the time a building
permit is being issued for construction upon the land described
above; and
(b) The owner install all 8 inch water main interconnecting the on-site
water main to the Village's water main on the property known as the
"Countryside Court Shopping Center" located immediately adjacent
to and south of the property described hereinabove--which installa-
tion shall be accomplished in a manner inspected and approved by
the Village Engineer; and
(c) That, at the time of occupancy of the completed shopping center t the
Village be granted the ownership of all on-site water mains
(exclusive of service lines) by proper Bin of Sale accompanied by
appropriate minimum 10 foot wide easements located at least
5 feet either side of the center of such water mains.
~~CTION TWO: That all requirements of the :Mourtt Prospect Building and
Zoning Codes shall be applicable except for the variations noted in SECTION
ONE heretofore described.
SECTION 'tHREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby directed to issue a building permit in accordance
with the variations and limitations hereinbefore mentioned.
SECTION FOUR: That the variations gr~mted by this Ordinance shall be null
and void aiid of no force and effect whatsoever unless an application for a
building permit pursuant to such variations are made and construction com-
menced within one year of the date said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law,
