SUBJECT: LEASED PARKING SPOTS
At your direction, I reviewed an incident involving the leased parking spaces on Willie
Street. During my review, I discovered the signs over at the Willie Street lot indicate
that vehicles would be towed, but we apparently do not have the authority under village
ordinance to tow cars in violation of a leased parking space.
I recommend the following:
. Village Code 18.1326. Towing and Storage of Improperly Parked Vehicles
be amended to include the authority to tow for violation 18.1327 Leased Parking
Zones
I have attached a copy of the village code referencing the specific violation. I have
instructed my officers and CSOs in the ability to issue a ticket for this violation and to
assist complainants with an alternative parking spot if needed.

AN ORDINANCE AMENDING
CHAPTER 18
OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: That Paragraph A of Section 18.1326, entitled "Towing and Storage of
Improperly Parked Vehicles" of Chapter 18 of the Mount Prospect Village Code, shall be deleted
in its entirety and a new Paragraph A inserted to be and read as follows:
A. In addition the provisions of Section 18.1302 of this Chapter, any vehicle parked in
violation of Sections 18.1303, 18.1315, 18.1320, 18.1321, 18.1324, and 18.1327 shall
be subject to being towed by the village or any of its officers, agents, employees,
servants, contractors and subcontractors, to a location designated by the village at the
expense of the owner of the vehicle towed.
SECTION 2: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.

In addition to the provisions of section
18.1302 of this article, any vehicle
parked in violation of sections
18.1303, 18.1315, 18.1320, 18.1321
and 18.1324 of this article shall be
subject to being towed by the village
or any of its officers, agents, employ-
ees, servants, contractors and sub-
contractors, to a location designated
by the village at the expense of the
owner of the vehicle towed.
B. The village shall mail written notice to
the person listed in the records of the
Illinois secretary of state or in the
vehicle license records of the village
as the registered owner of the vehicle
towed advising the said owner of the
location of said vehicle within twenty
four (24) hours after the vehicle towed
is deposited at its designated location.
The village may also notify said owner
by telephone.
C. Such notice shall also advise the
owner of the reason for action taken
by the village in towing the illegally
parked vehicle, and shall provide the
owner an opportunity to request a
hearing before the village manager
regarding the basis for such towing
action. Such request must be made in
writing within two (2) days following
receipt of the notice, and the village
manager shall take immediate steps
to hold a hearing and review the ac-
tion taken in towing the vehicle. The
determination of the village manager
that the vehicle in question is, in fact,
parked in violation of any of the sec-
tions specified above shall be final.

Fees shall be as set forth in appendix
A, division II of this code.
E. The village shall not be liable for any
damage to any vehicle which occurs
as a result of the work to and the
towing and storage of any vehicle
under the provisions of this section.
F. It shall be unlawful for any person to
remove any vehicle from a storage
area unless and until the fees for the
preparatory work, towage and storage
of said vehicle have been paid. The
penalty for violating the provisions of
this section shall be as provided in
section 18.1905 of this chapter. (Ord.

~ 18.1327: LEASED PARKING ZONES:
A. Zones Established: There are hereby
established certain parking zones to
be known as "leased parking zones"
which zones shall be within the dis-
tricts described in section 18.2019,
schedule XIX of this chapter.
B. Lease Agreement: It shall be unlawful
for any person to park a motor vehicle
in a leased parking zone unless an
annual lease agreement with the vil-
lage has been executed. Such lease
agreement shall set forth the terms
and conditions to be observed by the
lessee.
C. Rental Amount:
1. Any proprietor or owner of a busi-
ness licensed to do business in the
village shall pay an annual rental fee,
as set forth in appendix A, division II

of this code, for each parking space in
a leased parking zone.
2. Any resident of the village who is
not a proprietor of a business licensed
to do business in the village shall pay
an annual rental fee, as set forth in
appendix A,division II of this code, for
each parking space in a leased park-
ing zone.
3. The annual rental amount shall be
paid simultaneously with the accep-
tance and delivery of the executed
lease agreement.
D. Disposition Of Money: All monies so
collected for parking in a leased park-
ing zone shall be deposited with the
village treasurer, who shall credit such
collections to the parking system fund
and shall submit a monthly report to
the village board showing all revenues
derived from leased parking zones.

18.1328: PARKING WITHIN ILLINOIS
DEPARTMENT OF TRANSPOR-
TATION (lOOT) RIGHTS OF WAY: It shall
be unlawful for any person to park a motor
vehicle in any parking zone on any portion
of Northwest Highway (U.S. Route 14) un-
less said vehicle is parked in a position
parallel with the adjacent curb on said right

The Village's current residential solid waste contract with ARC Disposal and
Recycling Company (Republic Services) will expire December 31, 2005. Solid
waste services to both single and multifamily properties have been provided by
ARC Disposal and Recycling Company under the terms and conditions of the
contract since its inception in May 1, 2000.
Governed by the Village's approach to effective and efficient management of the
residential waste stream the contract provides for a modified volume-based
collection system. Although this system has proven very effective, industry
standards, economic constraints and customer satisfaction suggest that
additional options, which may enhance the 2006 municipal solid waste contract
be explored during the evaluation process.

Discussion
Cost benefit analysis and resident satisfaction studies have significantly
influenced local government's approach to solid waste management. While
competitive bidding for solid waste services was the standard approach ten years
ago, many local governments are realizing the economic benefit of negotiating
for services and extended contracts with the existing hauler if resident
satisfaction is at an acceptable level. Recent Information provided by the Solid
Waste Agency of Northern Cook County (SWANCC) indicates member
communities often choose to negotiate with the existing hauler rather than utilize
the bidding process. Customer satisfaction with ARC has historically been very
good.
Recommendation
It is staff's recommendation that consideration be given to all options that will
maximize the Village's ability to secure an effective and efficient solid waste
program and contract. At this time staff is seeking authorization to begin this
process by entering contract negotiations with ARC Disposal and Recycling
Company. Should authorization be given, the Village shall maintain the option
to open the contract for bid, if it proves to be in the Village's best interest.
