OHDINANCE NO. _28l1L
AN ORDINANCE GRANTING A SPECIAL USE
FOR PHOPERrry COl\Il\10NLY KNOWN AS
203 EAST RAND ROAD
WHEREAS, the Zoning Board of Appeals of the V~lage of IViount Prospect did hold
a I'llblic H€:al'ing on Case No. 55-SU-'78, on September 28, 1978 and DE:cember 21,
1978, at the hour of 8; 00 p. In. . in the Public Safety Building, pursuant to proper

WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 55-8U-78 pertaining to a request for a
certain special use pursuant to the Mount Prospect Zoning OrCiinance to permit
a certain use upon the property hereinafter described; and
WHEREAS, the Zoning Board of Appeals has recommended that the President
and Board of Trustees- of the Village of Mount Prospect allow the special use as
presented in Case No. 55-8U-78; and
WHEREAS. the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the
best interests of the Village of Mount Prospect;
NOW. THEREFORE ~ BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILL.A.GE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE:' That the special use authorized and granted in SECTION TWO
hereinbelow is conditionec'i upon and shall be valid and effective only so long

During the term of this special use, no otner buildings or accessory
buildings shall be established and/or constructed on the subject
property.

nre hereby authorized upon the subject property described in SECTION THREE
hereinbelow:

(a) A Wendy's Restaurant; and
(b) A G. D. Searle Optical Store.
SECTION THREE: That the special use authorized to be established in SECTION
TWO hereinabove shall be valid and effective upon the following property .
(hereinabove and hereinafter referred to as "subject property") leg'ally de-
scribed as:
The South 202.50 feet of the North SS6 .10 feet of that part of the North
West Quarter of the North East Quarter of Section 34, Township 42 North,
Range Ii, East of the Third Principal Meridian, lying-South West of the
Center of Rand ROlid (except the West 575.61 feet thereof) in Cook
County, Illinois.

which property has been zoned B-2 (Business-Office District). and which
zoning classification shall remain in full force and effect. subject to the
special use granted under the terms and conditions of this Ordinance.
SECTION FOUR: That the text of this Ordinance shall be recorded in the Office
of the Recorder of Deeds or registered with the Registrar of Titles (as the
case may be) of Cook County, Illinois.
SECTION FIVE: That this Ordinance shall be null and void and of no force and
effect whatsoever until after its passage, approval, and publication. and at
~tiGh time as an accurate plat resubdividing the said parcel described in SECTION
THREE hereinabove is registered with the Registrar of Titles of Cook County,
Illinois; a copy of which plat of resubdivision shall be attached hereto and hereby
made a part hereof.
