ORDINANCE NO. 2906
AN ORDINANCE GRANTING RE-ZONING AND SPECIFIED
VARIATIONS FOR PROPERTY LOCATED AT 117 EAST PROSPECT AVENUE
WHEREAS, Arthur H. and Evelyn Boesche (herein-
after referred to as "Petitioners") are .the ow-ners of a parcel
of proper.ty commonly known as 117 East Prospect Avenue, Mount
Prospect, in the Village of Mount Prospect, County of Cook,
State of Illinois (hereinafter referred to as the "Subject
Property"); and
WHEREAS, Petitioners filed an application requesting
that the Subject Property be rezoned from I-I Light Industrial
District under the Village of Mount Prospect Zoning Ordinance
to be B-3 Business-Retail and Service District under the Village
of Mount Prospect Zoning Ordinance; and
\VHEREAS, Petitioners also requested variations from
the provisions of the B-3 Business-Retail and Service District
regulations to permit parking in required front, rear and side
yards, to eliminate the required truck loaking spaces, to per-
mit the relocation of an existing frame detached garage on the
Subject Property to the location shown on the site. plan attached
hereto as Exhibit A and incorporated herein by this reference
and to decrease the size of required parking spaces from
10' x 20' to 9~ x 201¡ and
WHEREAS, a public hearing was held on Petitioners'
request for zoning, which request is known asZBA-15-Z-79,
and. on Petitioners' requests for the variations specified here-
inabove, which requests are known as ZBA-16-V-79, on
March 22, 1979 pursuant to proper public notice published on
March 6
in ,Mount Prospect Hérald~ 1979; and
WHEREAS, the Zoning Board of Appeals has recommended
to the Board of Trustees of the Village of r1ount Prospect that
Peti tioners' various requests be granted- except for Petitioners'
request to reduce the size of off-street parking spaces from
lO' X 20' to 9' X

WHEREAS, thePrèsident of the Board of Trustees
have considered the Petitioners' requests and reviewed the
recommendations of the Village of Mount Prospect Zoning.
Board of Appeals in ZBA-15-Z-79 and ZBA-16-V-79 and have
determined that the subject property should be rezoned
and have found that Petitioners have satisfied the standards
for variations set.forth in Section 14.605 of Article VI of
the Zoning Ordinance of the Village of Mount Prospect and
,that it would be in the best interest of the Village of
Mount Prospect that Petitioners', request for variations be
granted.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT
AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS, as follows:
Section One:
Map 8-S of the Zoning Ordinance
of the Village of Mount Prospect, be and the same is hereby,
amended by reclassifying from the 1-1 Light Industrial District
to the B-3 Business Retail and Service District the Subject
Property which is legally described as:

That part of the Northwest 1/4 of Section 12,
Township 41 North, Range 11 East of the Third
Principal Meridian, described as follows:
Commencing at the Southeast corner of the
. Northwest 1/4 of said Section 12, running
thence Westerly along the South line of said
Nórthwèst 1/4, 754.84 feet; thence North.
parallel with the Eäst line of said Northwest
1/4, a distance of 638.78 feet to the point
of beginning of the tract of land being
described herein; thence continuing North
along said parallel line a distance of
318.45 feet to the Southerly line of the
right of way of the Wisconsin Division of
the Chicago and Northwestern Railway; thence
Southeasterly àlong said Southp..r1y line..of
right of way, a'distance of 175.25 feet;
thence South parallel with the East line of
said Northwest 1/4 a~istance of 232.89 feet;
thence Westerly parallel with the South line
of said Northwest 1/4, 150.0 feet to the
point of beginning (excepting therefrom the
Westerly 33 feet and also excepting the
Northeasterly 66 feet thereof)

together with
Lot 1 in J.A. WEBER'S ADDITION TO MOUNT
'PROSPECT, being a Subdivision of part
of the East 1/2 of the North West 1/4 of
Section 12, Township 41 North, Range 11
East of the Third Principal Meridian, in
Cook County, Illinois.
Section Two:
Map 8-S contained in Section One
of Ordinance 2410, passed and approved on March 20, 1973,
shall be deemed amended so as to conform with the reclassi-
fication of the Subject Property herein contained in Section
One above.
Section Three:
Variations from the provisions
of Article XX, Section 14.2002 A, Band C of the Village of
Mount Prospect Zoning Ordinance be, and the same ~re hereby,
granted to allow Petitioners to maintain off-street parking
spaces on the Subject Property in front, side and rear yards
required, respectively, by said Sections 14.2002 A,B and C
of said Zoning Ordinance, which shall be used as a 'commercial
(for~fee) parking lot.
Section Four:
A variation from the provisions of
Article XX, Section 14.2005 B of the Village of Mount Prospect
Zoning Ordinance be, and the same is hereby, granted so that
Peti tioners shall not be, required to maintain any off-street
loading spaces on the Subject Property as are now required by
said Section 14.2005B of said Zoning Ordinance.
Section Five:
A variation from the provisions
of Article XXVI, Section l4~2602 B29 of the Village of 'Mount
Prospect Zoning Ordinance be, and the same is hereby~ granted
to reduce the dimensions of required off-street parking
spaces from 10' x 20', as required by said Section 14.2602 B29,
to 9' x 20'.

Section Six:
A variation from the provisions of
Article XX, Section 14.2002 B of the Village of Mount Prospect
Zoning Ordinance, which Section sets forth side yard require-
ments .in the B-3 Business Retail and Service District be,
and the same is hereby, granted to allow the Petitioners to
relocate the existing frame detached garage on the Subject
Property to the location shown on the plat plan which is
attached hereto as Exhibit A.
Section Seven:
The variations granted herein shall
not run with the land and are granted exclusively to Petitioners
for as long as Petitioners shall own the Subject Property and
operate a commercial (for fee) off-street parking lot on the
Subject Property.
Section Eight:
Except for the variations granted
herein, all other applicable Village of Mount Prospect ordinances
shall remain in full force and effect as to the Subject
Property.
Section Nine:
This Ordinance shall be in full
force and effect from and after its passage, apporoval and
publication in the manner provided by law.
