ORDINANCE NO.
2919
AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR
PROPERTY AT 2947 BRIARWOOD DRIVE WEST
~\'HEREAS, FRED J. RIEBLE and KL.'\PJ\ .4.. RIEBLE (i;Tho shall
be referred to as "Petitioners") are the owners of a parcel
of property located at 2947 Briarwood Drive West in the
Village of Mount Prospect, County of Cook, State of Illinois
(hereinafter referred to as the "Subject Property!'); and
WHEREAS, the Subject Property is legally described as
follows:
Lot 43 in Lake Briarwood Unit 2, a Sub-
division of part of the West 1/2 of the
East 1/2 of Section 22, Township 41 North,
Range 11, East of the Third Principal
Meridian, in Cook County, Illinois;
and
WHEREAS, the Subject Property is located in the R-l
Single Family Residence District under the provisions of the
Zoning Ordinance of the Village of Mount Prospect (hereinafLer
referred to as the "Zoning Ordinance"); and
WHEREAS, Petitioners have heretofore filed an appli~ati r
seeking"the following variations from the provisions of the
Zoning Ordinance:
1.
A 3.96 foot variation from Section l4.ll02A of
Article XI of the Zoning Ordinance which requires any building
or structure to be set back at least thirty (30) feet, to permi
a front yard of 26.08 feet;
2.
A 4.822 foot variation from Section l4.ll02B of the
Zoning Ordinance which requires a minimum side yard along each
side of any lot to have a width of not less than ten percent
(10%) of the lot or 10 feet, whichever is lesser to permit a
side yard of 4.728 feet on the east side of the Subject Propert_;
3.
A 3.55 variation from Section l4.ll02B which
requires a minimum side yard along each side of any lot to have

a width of not less than ten percent
(10%) of the lot or 10 feet,
whichever is lesser, to permit a side yard of 6 feet on the
west side of the Subject Property;
4.
A variation from the provisions of Section 14.1102
of the Zoning Ordinance to allow the 4 foot eaves of the single
family residence located on the Subject Property to overhang eac
side and front yard of the Subject Property; and
WHEREAS, Peti~ioners have also requested that the
variations sought also be applied to an addition to be construct d
on the Subject Property; and
~VHEREAS, a public hearing was held on the Peti tioners '
requests, which requests are known as ZBA-25-V-79, before the
Zoning Board of Appeals of the Village of Xount Prospect on May
24, 1979, pursuant to proper public notice published in the
Mount Prospect Herald on May 4, 1979; and
WHEREAS, the Zoning Board of Appeals has recommended to
the Building Committee of the Board of Trustees of the Village
of Mount Prospect that Petitioners' requests in ZBA-25-V-79 be
granted; and
ì~EREAS, the President and Board of Trustees have
considered the Petitioners' requests and reviewed the recow~enda-
tion of the Village of Mount Prospect Zoning Board of Appeals
in ZBA-25-V-79; and
WHEREAS, the President and Board of Trustees of the
illage of Mount Prospect have determined that with respect to
he Petitioners' requests for variations, that Petitioners have
atisfied the standards for the grant of a variation set forth
'n Section 14.605 of Article VI of the Zoning Ordinance and find
hat it would be in the best interest of the Village of Mount
rospect to grant Petitioners the vôriations requested and extend
hose variations to allow the construction of an addition to the

premises of the Subject Property.
NOW, THEREFORE, BE IT ORDAINED by the President and Boar
of Trustees of the Village of Mount Prospect, Cook County,
,ILl;inois as follows:
SECTION ONE:
The recitals set forth hereinabove are
incorporated herein as though fully set forth.
SECTION TWO:
The President and Board of Trustees of the
Village of Mount Prospect hereby grant the following variations
for the Subject Property:
1.
A 3.96 foot variation from Section l4.ll02A of
Article XI of the Zoning,Ordinance which requires any building 0

SECTION THREE:
The variations granted herein shall also

premises of the Subject Property

SECTION FOUR:
This Ordinance shall be recorded with the
Cook County Recorder of Deeds or Registrar of Titles, whichever
is applicable, and the variations granted herein shall be
deemed to run with the Subject Property.
SECTION FIVE:
Except for the variations granted herein,
all other ,applicable Village of Mount Prospec~ ordinances shall
remain in full force and effect as to the Subject Property.
SECTION SIX:
This Ordinance shall be in full force and'
effect from and after its passage, approval, and publication in
the manner provided by law.
