A G R E E MEN T

This Agreement made and entered into this
!
l s:T day of
~~~~, 1980 by and between the Village of Mount Prospect
(hereinafter referred to as the "Village") and Robert Birks
d/b/a Birks Transportation Company (hereinafter referred to
as "Birks").
WIT N E SSE T H :
----------
WHEREAS, the Village is concerned about the availability
of transportation in the Village for senior citizens of the
Village¡ and
WHEREAS, the President and Board of Trustees of the
Village wish to assist senior citizens by establishing taxicab
fares for senior citizens for taxicab rides within the Village
and providing a Village subsidy to senior citizens for such

taxicab rides.
NOW, THEREFORE, for and in consideration of the mutual
covenants herein made, the parties do hereby enter into the
following Agreement:
SECTION ONE:
Fare Established.
Birks agrees to transport senior citizens who comply
with the procedures set forth hereinafter in Section Three anywhere
within the corporate limits of the Village of Mount Prospect
for a fare of two dollars and ten cents ($2.10), except
as provided in Section Five of this Agreement.
Subsidy Established.
SECTION TWO:
Provided Birks complies with the procedure set forth
hereinafter in Section Three, the Village agrees to pay Birks
for each taxicab ride Birks and drivers of taxicabs for which
Birks is licensed by the Village, provide to senior citizens
who comply with the procedures set forth hereinafter in Section
Three, the sum of one dollar and thirty five cents of the fare

established by Section One hereinabove.
SECTION THREE:
Procedure.
A.
A senior citizen who is eligible shall be issued
an identification card by the Village.
Anytime a senior citizen
wishes to obtain the senior citizen fare eitablished in Section
One of this Agreement, such senior citizen shall:
1.
present to the taxicab driver at the inception
of the taxicab ride, the senior citizen's identification
card issued by the Village¡ and
2.
sign his or her name an~ record the senior
citizen's identification card number on a form
(hereinafter referred to as the "Passenger Tickets")
to be provided by the taxicab driver to the senior
citizen¡ and
3.
pay the taxicab driver seventy-five cents
($.75) for the taxicab ride, except as provided in
Section Five hereinafter.
B.
Birks shall:
1.
submit Passenger Tickets to the Village
within seven days after the close of each calendar
month¡ and
2."
provide the Village with Passenger Tickets
for each senior citizen taxicab ride for mlich Birks
is requesting the subsidy established by Section Two
hereinabove, which Passenger Tickets shall show the
signature of the senior citizen, the identification
card number of the senior citizen, the date of the
taxicab ride and the addresses or locations where
such taxicab ride began and ended.

The Village shall:
1.
review such Passenger Tickets and determine

whether they comply with the provisions of this Section;
and
2.
pay Birks the subsidy established by Section
Two hereinabove for each senior citizen taxicab ride
provided the Passenger Tickets Birks submits to the
Village are properly completed
SECTION FOUR:
Service to Senior Citizens.
Birks and any taxicab driver employed by Birks or who
operates a taxicab owned or leased by Birks shall respond to
requests for service from senior citizens and shall provide
service to senior citizens in accordance with the provisions
of Article XI of Chapter 11 of the Municipal Code of the
Village of Mount Prospect.
SECTION FIVE:
Multiple Senior Citizen Pas-sengers.
The Village and Birks agree that the fare established by
Sections One hereinabove and the subsidy established by Section
Two hereinabove shall be applied to each senior citizen passenger
of a taxicab, provided, however, that if multiple senior citizens
occupy the same taxicab to the same destination, then each
additional senior citizen passenger shall only be required to pay
ten cents ($.10) of the seventy-five cents ($.75) provided for in
Section Three hereinabove.
Multiple senior citizen passengers
who occupy the same taxicab but who have different destinations
shall each pay seventy-five ($.75) as provided in Section Three
hereinabove.
Indemnity.
Birks agrees to indemnify and
SECTION SIX:
save and hold harmless the Village and its officers, agents,
employees, insurers, successors and assigns from any and all
claims, demands, cause or causes of action, injuries (including
death), or damages of any kind, character or description
whatsoever arising out of any action or inaction in connection
with this Agreement, whether such action or inaction be of Birks
or any of his employees or agents or any person operating a
taxicab for which Birks has been granted a license by the Village.

SECTION SEVEN:
Term.

This Agreement shall be in full force and effect from
September 1, 1980 to and including August 31, 1981.
Thereafter
this Agreement shall remain in full force and effect unless
terminated by either party by mailing written notice to the
other thirty (30) days prior to such termination.
SECTION EIGHT:
Notice.
The names and addresses of the persons to whom any notices
required by this Section shall be mailed are:
