CAF/ 2/24/98 ORDINANCE NO. 4915 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP WITH RESPECT TO THE ZONING CERTAIN PROPERTY FROM R-X TO B-3 (COMMUNITY SHOPPING ZONING) DISTRICT (1621 AND 1641 WEST ALGONQUIN ROAD) WHEREAS, David R. Wolf and Terry and Call Hart (hereinafter referred to as Petitioners), has filed applications to rezone properties generally located at 1621 and 1641 West Algonquin Road (hereinafter referred to as Subject Property), legally described as follows: ZBA-25-97:1621 W. Algonquin Road That part of the West ~ of the Northwest 1/4 of Section 23, Township 41 North, Range 11 East of the 3rd Principal Meddian lying South of the canter line of Algonquin Road bounded by a line described as follows: Beginning at a point on said center line of Algonquin Road, 432.0 feet Southeasterly, as measured along said canter line of its intersection with the West line of the Northwest 1/4 of said Section 23; thenca continuing Southeasterly along said canter line 100.0 feet; thenca Southwesterly along a line drawn at right angles to said canter line, 234.58 feet to a point on the center line of an easement for drainage ditch; thence Northwesterly along said center line, 102.31 feet to a point on a line drawn at right angles to the center line of Algonquin Road through the place of beginning, thence Northeasterly along said line, 212.99 feet to the place of beginning, excapting therefrom that part thereof heretofore dedicated for public road, in Cook County, Illinois. ZBA-29-97:1641 W. Algonquin Road That part of the West ~ of the Northwest 1/4 of Section 23, Township 41 North, Range 11, East of the 3rd Principal Meridian, bounded and described as follows: Beginning at a point on a line 50.00 feet South of and parallel with the center line of Algonquin Road as now located, distant 231.22 feet Southeasterly of the East line of the Northwest 1/4 of said Section 23, (as measured on said Right-of-Way line of Algonquin Road); thence S. 27-16'-15" E. on said Right-of-Way line for a distanca of 175.00 feet to a point; thence S. 27-16'-15" W. on a line perpendicular to said Right- of-Way line for a distanca of 162.99 feet to a point; thenca N. 50-32'-48" W. for a distanca of 47.13 feet to a point; thenca S. 90-00'-00" W. for a distanca of 200.00 feet to a point on the East line of Busse Road as established by Plat of dedication recorded July 24 1967 as Document # 16967007; thenca N. 00-00'-00" E. on the last described line for a distanca of 67.50 feet to a point; thenca S 90-00'-00" W. on the North line of said dedication, for a distanca of 25.00 feet to a point on the East line of Busse Road as established by Township dedication dated November 3, 1902; thence N. 00-00°-00"E. on the last described line for a distanca of 32.81 feet to a point; thenca N. 90-00'-00" E. on a line perpendicular to the last described course for a distance of 131.66 feet to a point; thenca N. 27-16'-15" E. For a distanca of 106.66 to the point of beginning, all in Cook County, Illinois; and. WHEREAS, Petitioners have requested the Subject Property be rezoned from R-X (Residential) District to B-3 (Community Shopping Zoning) District; and WHEREAS, a public hearing was held on the request for rezoning, being the subject of ZBA Case No. 26-97 and ZBA 29-97 before the Zoning Board of Appeals of the Village of Mount Prospect on the 29th day of January, 1998 pursuant to due and proper notica thereof having been published in the Mount Prospect Journal and Topics on the 15th day of January, 1998; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation relative BA 26-97 and 29-97 Page 2 of 2 to ZBA 26-97 and ZBA 29-97 to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the requests being the subject of ZBA 26-97 and ZBA 29-97 and have determined that the best interests of the Village of Mount Prospect would be served by granting said requests. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The official zoning map of the Village of Mount Prospect, Illinois, as amended, is hereby further amended by reclassifying the property being the subject of this Ordinance from R-X to B-3 (Community Shopping Zoning) District. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
