RESOLUTION NO. 37-81
A RESOLUTION TO ACCEPT THE DONATION
OF LOT 308 IN KENSINGTON CENTER PHASE
THREE A FROM RAUENHORST CORPORATION
TO THE VILLAGE OF MOUNT PROSPECT,
ILLINOIS
WHEREAS, pursuant to the terms of a certain Annexation Agree-
ment by and between Rauenhorst Corporation and the Village of Mount
Prospect, Illinois certain real estate was to be donated by Rauenhorst
Corporation to the Village of Mount Prospect, Illinois; and
\rHEREAS, in compliance with said Annexation Agreement Rauenhorst
Corporation has submitted to this Village a Special Warranty Deed
conveying Lot 308 in Kensington Center Phase Three A, as more
specifically described in said Deed (a copy of which is attached
hereto as Exhibit A and made a part hereof by reference); and
WHEREAS, Rauenhorst Corporation has further submitted with said
Special Warranty Deed a Title Insurance Commitment regarding said
real estate issued by the Title Insurance Company of Minnpsota; a
Declaration of Industrial Standards and Protective Covenants -;. relating
to said real ~state; a Tax Proration Agreement covering 1981 taxes
levied against said real estate; a Plat of Survey of said real estate
an ALTA Statement regarding the status of said real estate; an
Acknowledgment of Acceptance of said Real Estate by this Village
(copies of which documents are attached hereto as Exhibi~B through G
and made a part hereof by reference); and
WHEREAS, the Special Warranty Deed and supporting documents are
acceptable to the Village in compliance of Rauenhorst Corporation's
obligation in said Annexation Agreement to donate certain real estate
to this Village.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: This Board does hereby approve and accept the
donation of Lot 308 in Kensington Center Phase Three A by Rauenhorst
Corporation as full compliance of the Corporation's obligation under
the said Annexation Agreement.
SECTION TWO: The Mayor and the village Clerk of this Village
are hereby authorized and directed to execute the attached Acknowledge
ment of Acceptance of'Real Estate and the Tax Proration Agreement on
behalf of this Village and the Village Clerk is further authorized
and directed to see that said Special Warranty Deed is filed of record
and otherwise registered and that a Title Insurance Policy is issued
in thè name of the Village of Mount Prospect.
SECTION THREE: This Resolution shall be in full force and effect
upon its passage and approval in accordance with law.
