The Planning & Zoning Commission transmits their recommendation to approve Case PZ-06-05, a request to
operate a contractors' storage yard in an industrial zoning district. The Planning & Zoning Commission heard the
request at their February 24, 2005 meeting.
The Subject Property is located on the north side of Terminal Drive, which is a private road located within the
tank farm area. The Subject Property is currently used as a cartage facility (Roadrunner Express) and is not
visible trom any Village owned streets. The Petitioner is seeking approval for the proposed storage yard and
proposes to make minor changes to the site at this time. The Petitioner's application states that large vehicles will
be parked on-site and they will store landscape materials ín large concrete bins, similar to the type used at the
Village's Public Works Department.
Judy Connolly, Senior Planner, reviewed the case. She said that conditions in the Staff Report had changed with
respect to the fence being installed without a permit. Village records document that a permit was issued to the
adjacent property owner (Citgo), but it appears that the fence was installed incorrectly and may encroach onto the
Subject Property.
The Planning & Zoning Commission briefly discussed the Petitioner's project. Several members stated that the
request was straightforward and that the proposed use would not adversely impact the adjacent properties once the
existing code violations were corrected. The Petitioner's attorney spoke on behalf of his client and stated that
they agreed to the revised conditions of approval and would comply with all Village Codes.
The Planning & Zoning Commission voted 6-0 to recommend that the Village Board approve the Conditional
Use request for the proposed contractors' storage yard subject to the following conditions for Case No. PZ-06-05:
1. The Petitioner or current property owner shall remove the gravel that has been installed along the western
portion ofthe property no later than 60 days of the Petitioner taking possession of the property.
2. The Petitioner or current property owner shall provide an updated plat of survey that documents the
location of the existing fence along the south property line, near the west side of the site.
3. All future improvements to the property shall meet Village Code requirements.

Chairperson Arlene Juracek called the meeting to order at 7:40 p.m. Richard Rogers moved tò approve the
minutes of the January 27, 2005 meeting and Joe Donnelly seconded the motion; the motion was approved 6-0.
Under Old Business, Ms. Juracek asked for a motion to continue PZ-50-04 to the March 24, 2005 meeting.
Richard Rogers made such motion, seconded by Joe Donnelly, and it was approved 6-0. After consideration of
three other cases, Ms. Juracek introduced Case No. PZ-06-05, a request for Conditional Use approval for a
contractors' storage yard and other relieffrom the Village Code as may be required for the proposal. She said that
this case would be Village Board Final.
Judy Connolly, Senior Planner, summarized the request. She said that the Petitioner is seeking Conditional Use
approval to allow a "Contractors', architects' and engineers' equipment and material storage yard" as listed in the
Zoning Ordinance. The Subject Property is located on the north side of Terminal Drive, which is a private road
located within the tank farm area. The Subject Property is currently used as a cartage facility by Roadrunner
Express, and is not visible trom any Village owned streets. The Subject Property is zoned II, Limited Industrial,
and is bordered by the II district to the north, east and west, and by a trailer park to the south, which is located
outside of Mount Prospect corporate limits. The Petitioner proposes to make minor changes to the site at this time
and will use the existing structures in conjunction with the landscape/contractor business. The office building will
continue to be used as an office and the storage building will be used to store vehicle parts, tools, etc. The
Petitioner's application states that large vehicles will be parked on-site and they will store landscape materials in
large concrete bins, similar to the type used at the Village's Public Works Department.

The Subject Property obtained Conditional Use approval in 1999 to operate a cartage facility. The Subject
Property does not meet current zoning bulk regulations because one of the structures does not meet the Village's
setback regulations. The building is located along the east lot line and is adjacent to one of the tank farm
facilities. The property was developed under County regulations and then annexed into Mount Prospect.
Therefore, the nonconforming structure is allowed to remain. However, future improvements will be required to
comply with Village regulations. The table in the Staff Report documents the existing conditions.
The standards for Conditional Uses are listed in the Zoning Ordinance. Ms. Connolly summarized the standards
and noted that other departments reviewed the .Petitioner's proposal and did not object to the use. However,
several Village Code violations concerning this site have not been addressed. These outstanding code violations
include: stone was placed to create a truck parking area between the west edge of pavement and the west property
line. In placing this stone, the grading has been significantly altered in this area. The Village did not issue a
permit for this work and it must be a condition of approval that the stone be removed. Ms. Connolly said that it
was her understanding that the Petitioner contacted the Engineering Dept since the Staff Report was done and it
was agreed by both parties that the work would be completed within 60 days of the Petitioner taking possession of
the land. She said that the latest date of possession would be April 20, 2005.
The Staff Report states a new fence has been installed along the south property line, near the west side of the site.
A gate has been installed in the fence west of the Roadrunner property. This gate does not align with the existing
60' wide (average width) easement along the west side of the Roadrunner property; the fence now encloses the
easement. After further research, it was determined that the Village issued a permit to the adjacent property
owner, Citgo, and it appears they did not final out the permit. Also, it appears that the fence may be installed
incorrectly. The Petitioner agreed to revisit this issue subject to obtaining a new plat of survey and Staff will
work with the adjacent property owner to resolve the issue.
Ms. Connolly said that Roadrunner obtained a permit to repair a portion of their existing pavement in 200 l.
However, as is confirmed on the survey included in Albright's submittal, the pavement improvements extended to
a 10,400 sq. ft. gravel area north of the parking lot. The permit did not include the paving of the gravel area, so
the installation of this pavement was not approved or inspected. Furthermore, the Development Code would have
required storm water detention, but was not installed. Because of the small area involved, the Village's
Engineering Division does not believe it to be practical to require stormwater detention to be provided for the
paving of the gravel area at this time. However, it should be a condition of approval that any future paving
improvements will have to include stormwater detention for the paving of the gravel area, plus any detention
required for the future improvements.
Subject to correcting the code violations, the request would have minimal impact on the adjacent properties and
would meet the standards for a Conditional Use. Based on these findings, Staff recommends that the Planning &
Zoning Commission recommend the Village Board approve a Conditional Use for a contractor's storage yard for
the property at 2400 Terminal Drive, Case No. PZ-06-05, subject to the following revised conditions:
1. The Petitioner or current property owner shall remove the gravel that has been installed along the western
portion of the property no later than 60 days of the Petitioner taking possession of the property.
2. The Petitioner or current property owner shall provide an updated plat of survey that documents the location
of the existing fence along the south property line, near the west side of the site;
3. All future improvements to the property shall meet Village Code requirements.
The Planning & Zoning Commission discussed the project. Chair Arlene Juracek noted that the request was
straightforward and said she thought that the proposed use would not adversely impact the adjacent properties
once the existing code violations were corrected.

Drake Murdis of the law firm of Dowe, Dowe & Murdis and attorney for the petitioner, was sworn in. He stated
that the petitioner, Albright, agreed to the revised conditions of approval and was willing to comply with all
Village Codes. He said that Mr. Spitzer and Mr. Albrecht are under contract to purchase the property and will get
possession of the property at the end of April fÌ'om Roadrunner.
Richard Rogers made a motion to recommend approval of a Conditional Use permit to allow for a contractors'
storage yard at 2400 Terminal Drive, PZ-06-05, subject to the following conditions:

BACKGROUND
A public hearing has been scheduled for the February 24, 2005 Planning & Zoning Còmmission meeting to
review the application by Albright All Weather, Inc (the "Petitioner") regarding the property located at 2400
Terminal Drive (the "Subject Property"). The Petitioner is seeking Conditional Use approval to allow a
"Contractors', architects', and engineers' equipment and material storage yards". The P&Z hearing was properly
noticed in the February 9, 2005 edition of the Journal Topics Newspaper. In addition, Staff has provided written
notice to property owners within 250-feet and posted a Public Hearing sign on the Subject Prop~rty.
PROPERTY DESCRIPTION
The Subject Property is located on the north side of Terminal Drive, which is a private road located within the
tank farm area. The Subject Property is currently used as a cartage facility (Roadrunner Express) and is not
visible from any Village owned streets. The Subject Property is zoned II Limited Industrial and is bordered by
the 11 district to the north, east, and west and by a trailer park to the south, which is located outside of Mount
Prospect corporate limits.
SUMMARY OF PROPOSAL
The Petitioner proposes to make minor changes to the site at this time and will use the existing structures in
conjunction with the landscape/contractor business. The office building will continue to be used as an office and
the storage building will be used to store vehicle parts, tools, etc. The Petitioner's application states that large
vehicles will be parked on-site and they will store landscape materials in large concrete bins, similar to the type
used at the Village's Public Works Department.

CONDITIONAL USE STANDARDS
The standards for Condítional Uses are lísted ín Sectíon 14.203.F.8 of the Village Zoning Ordinance and ínclude
seven specific findings that must be made in order to approve a Conditional Use. The following hst is a
summary of these findings:

The Condítíonal Use wíll not have a detrimental impact on the public health, safety, morals, comfort or
general welfare;
The Condítional Use wíll not be injuríous to the use, enjoyment, or value of o_~her properties ín the
vicinity or impede the orderly development ofthose properties;
Adequate provisíon of utihtíes, draínage, and desígn of access and egress to minimize congestíon on
V illage streets; and
Compliance of the Conditional Use with the provisions of the Comprehensive Plan, Zoning Code, and
other Víllage Ordínances.

Other departments reviewed the Petítíoner's proposal and díd not object to the use. However, several old Víllage

RECOMMENDA TION
The proposed contractor's storage yard meets the Conditíonal Use standards contained in Section 14.203.F.8 of
the Zoning Ordínance. Based on these findíngs, Staff recommends that the Planníng & Zoníng Commission
recommend the Víllage Board approve a Conditional Use for a contractor's storage yard for the property at 2400
Terminal Drive, Case No. PZ-06-05, subject to the following conditíons:
1. The Petítioner or current property owner shall remove the gravel that has been ínstalled along the western
portion of the property.
2. The Petitíoner or current property owner shall obtain a permit for the ínstallation of the fence along the
south property line, near the west side of the site, or remove the fence;
3. All future ímprovements to the property shall meet Village Code requirements.
The Víllage Board's decísíon is final for thís case.

We have completed our review of the proposed request for a Conditional Use to operate a storage yard
at 2400 Terminal Drive. While we have no objections to the requested Conditional Use, several old
code violations concerning this site have not yet been addressed. These outstanding code violations
are summarized below:
1. Stone has been placed to create a truck parking area between the old west edge of pavement
and the west property line. In placing this stone, the grading has been significantly altered in
this area. No permit was obtained for this work. It must be a condition of approval that either a
permit be obtained for the placement of this stone, or the stone be removed.

This firm's primary focus is a full service commerciallindustrial snow plowing
and removal. Snow plowing, salting, and any other snow clearing necessities are
provided to clients, Sidewalks, public and private are cleared to customer specifications,
During the off season from plowing, this company provides excavating,
demolition, and delivery of landscape material (dirt, stone, sand etc.)
Proposed usage of the site; to be used as a contractor's equipment, vehicles, and
material storage facility,
Equipment stored on site; 3 semi-tractor trailers, 3 four wheel dump trucks, 1 six
wheel dump truck, 12 pick-up trucks, 2 end loaders, 2 back hoes, 2 bobcats,and 2
equipment trailers, The larger pieces of equipment to be parked on the blackt~p em the
east side of property, north of office building, The smaller vehicles will park on the west
edge of the blacktop.
On the north end of the blacktop, six concrete storage bins will be in place, These
will be used to store salt, black dirt, gravel, sand, and other bulk landscape material to be
delivered,
Parking stalls will be put in place in front of the office building,
The current structure of both of the buildings on site will not be altered and their
use will be as an office facility and storage in the second building, Items to be stored in
the building as an example will parts, lubricants for vehicles and equipment, tools and
small equipment.
Maintenance on site will be limited to routine vehicle maintenance and minor
repair of vehicles and equipment.
Landscaping, a detailed drawing of the landscape proposal will be submitted with
this petition, which would include parkway trees and new shrubbery.
As the site is utilized in it's current state, a plan to tailor the property to the needs
of this company will developed, At which time the development, renovations, and
improvements of the site are to be proposed it is understood that a subsequent petition
will be necessary to comply with all building and surface ordinances and codes.

ORDINANCE NO.
AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT
FOR PROPERTY COMMONLY KNOWN AS 2400 TERMINAL DRIVE
WHEREAS, Albright All Weather, Inc. (hereinafter referred to as "Petitioner) has filed a
petition for a Conditional Use permit with respect to property located at 2400 Terminal
Drive, (hereinafter referred to as "Subject Properly') and legally described as shown on
Exhibit "A," attached hereto and hereby made a part of; and
WHEREAS, the Petitioner seeks a Conditional Use permit to allow a contractors'
equipment storage yard at the existing cartage facility; and
WHEREAS, a Public Hearing was held on the request for a Conditional Use permit being
the subject of PZ-06-05 before the Planning and Zoning Commission of the Village of
Mount Prospect on the 24th day of February, 2005, pursuant to proper legal notice having
been published in the Mount Prospect Journal & Topics on the 9th day of February, 2005;
and
WHEREAS, the Planning and Zoning Commission has submitted its findings and
recommendations of approval, with specific conditions, to the President and Board of
Trustees in support of the request being the subject of PZ-06-05; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
given consideration to the request herein and have determined that the same meets the
standards of the Village and that the granting of the proposed Conditional Use permit
would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by
the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do
hereby grant a Conditional Use permit, as provided in Section 14.203.F.7 of the Mount
Prospect Village Code, to allow a contractors' equipment storage yard at the existing
cartage facility, as shown on the Landscape Plan and Plat of Survey, copies of which are
attached hereto and hereby made parts of as Exhibit liB" and Exhibit "C" respectively.

SECTION THREE: That prior to the issuance of a building permit relative to the
Conditional Use permit, the following conditions and/or written documentation shall be
fulfilled:
1.
The Petitioner or current property owner shall remove the gravel that has
been installed along the western portion of the property no later than 60 days
of the Petitioner taking possession of the property;
2.
The Petitioner or current property owner shall provide an updated plat of
survey that documents the location of the existing fence along the south
property line, near the west side of the site;
3.
All future improvements to the property shall meet Village Code
requirements.
SECTION FOUR: That the Village Clerk is hereby authorized and directed to record a
certified copy of this Ordinance with the Recorder of Deeds of Cook County.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.

SUBJECT:
Program Information
The Discount Taxicab Program has been in operation for over twenty years
successfully offering discounted taxicab rides to residents living within the corporate
limits of Mount Prospect who meet age and disability status. To obtain a card, a
resident must show proof of residency, show proof of being sixty-five years of age or
older, or meet the qualifications for disability status, A physician is required to
complete a form to determine disability status.
The program is based on the meter fare for all rides, Participants may travel to any
location within or outside the boundaries of Mount Prospect. The Village will pay
50% of the meter fare, up to $3.00 and the participant will pay the remainder. This
transportation service is not intended for regular use to and from work. The only trip
excluded from the program is to the airport, because taxi companies offer a flat rate.
When two or more cardholders ride together from the same location to the same
destination (share a cab), the fare is the discounted rate for the first person and the
cab company charges an additional $.10 for each additional passenger. The
additional riders pay the taxicab company for their ride.
Amendment Allowing Attendants
The proposed amendment would allow senior citizens or disabled participants who
need the assistance of an attendant, to ride together for the additional participant
rider rate. The definition of an attendant would be someone who provides
assistance to the participant thus allowing him/her to utilize the discount cab
program. In the past, participants needing the assistance of an attendant, would not
have been able to take advantage of the discount program because the attendant
would not meet the requirements of the program thus negating the discounted ride,
Allowing attendants to ride with the participant requires changing the ordinance.
Examples of new participants would include, but not be limited to, disabled children
or adults riding with a parent or attendant to therapy sessions, or senior citizens
riding with an attendant to the doctor's office.

While there have been very few actual requests for the discounted attendant rate,
additional publicity may garner more interest. If for example, ten new participants
use the cab once a week and take advantage of the maximum discount of $3.00 per
ride, the cost to the Village for a round trip ride would be $6.00. Multiplying the
'$6.00 by 52 weeks would be $312 per user, The ten additional participants using
the program weekly, would total $3,120, which would be a minimal increase. There
is no additional cost to the Village for the attendant's ride. The additional cost to the
Village would only be limited to new participants.
Budget
The current Discount Taxicab Program costs the Village $12,000 (budget) in 2005,
$11,800 (est.) in 2004, $12,331 in 2003 and $12,409 in 2002, If ten additional
participants, as cited in the above example, signed up for the program then the
attendant amendment could not be absorbed within the current budget for 2005.
However, the additional cost could be addressed through a budget amendment and
would consist of minimal additional cost. Based on the projected user level of
participants with an attendant, the additional cost will be evaluated and the budget
could be adjusted, if necessary, for 2006 once better information on the ridership is
available.
Additional Rider Rate
A discount taxicab program exists in Arlington Heights, Elk Grove Village and Niles.
The $3.00 reimbursement from the Village of Mount Prospect has been in place for
some time and is similar to the rate charged in the other communities. Arlington
Heights does not regulate an additional fare discount rate so any additional riders
would pay the standard commercial second rider rate. Elk Grove Village offers a
discount program only on Sundays due to the extensive use of the township bus.
Elk Grove Village's additional rider fare is $.10. Niles offers a 25% meter discount
program with a $1.00 additional rider rate. '
The three taxicab companies licensed to operate in Mount Prospect are American
Taxi, Community Cab and 303 Cab. Their charge for additional passengers based
on a regular fare are as follows: American Taxi charges $.50 for additional riders;
Community Cab charges $1.00 for additiona~ riders; 303 Cab charges $2,00 for
additional riders,
Mount Prospect currently regulates the rates for additional riders, which is $.10 per
each additional rider. The reasons Mount Prospect regulates additional riders is to
allow participants a further discount for sharing a cab. This rate was determined
years ago after surveying neighboring community's programs and finding that they
regulated additional riders at this same rate. This rate has been in effect for
decades, and is known by the participants,
Recommendations
I would request that the Village Board pass the amendment, which would provide the
same discount transportation program - $3.00 maximum discount on the ride and
$,10 for the additional rider - to those who need the assistance of an attenda nt as
well as to those sharing a cab. The participant who needs an attendant will be issued
a special "Attendant Card" that will allow an attendant to accompany the participant.
The goal of the program is to provide affordable C)v,!nt, trans,porta,tion for f', rail,

OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: Subparagraph A (2) of Section 11.1136 entitled "Senior
Citizen/Handicapped Subsidized Taxicabs Rate Program" of Chapter 11 entitled "Merchants,
Businesses, Occupations and Amusements" of the Mount Prospect Village Code shall be
amended by deleting subparagraph A (2) of Section 11.1136 in its entirety and adding a new
subparagraph A (2) which shall be and read as follows:

companion accompanies a senior citizen or handicapped person and that person
or persons (are) transported to the same destination, then each such additional
person may be required to pay only the amount set forth in Appendix A, Division

Attached to this memorandum is a resolution that adopts the 2005 Official Zoning Map for the
Village of Mount Prospect. State Statutes require that the Village Board approve the Map by
March 31 sl of each year to reflect changes that have occurred in the previous calendar year,
Staff has completed all the necessary modifications to the Map and requests that the Village
Board approve the attached resolution as submitted. Please forward this memorandum to the
Village Board for their review and consideration at their March 15th meeting. Staff will be
present at that meeting to further discuss this matter.

WHEREAS, as mandated by the Illinois Compiled Statutes 5/11-13-19, the Corporate
Authorities shall cause to be published no later than March 31 of each year, a map
showing the existing zoning uses, divisions, restrictions, regulations and classifications
for such municipality for the preceding year.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OFTHE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The Mayor and Board of Trustees of the Village of Mount Prospect do
