RESOLUTION NO.
14-83
A RESOLUTION OPPOSING THE REQUEST FOR VARIATIONS TO MODIFY AN
EXISTING ADVERTISING SIGN AND TO PERMIT A SECOND SIGN ON
PROPERTY IN THE IMMEDIATE VICINITY OF THE VILLAGE
WHEREAS, there is presently pending before the Cook County Zoning
Board of Appeals an application for variations from the Cook
County Zoning Ordinance for land located North of the Northwest
Tollway, West of Busse Road in Elk Grove Township; and
WHEREAS, said proposal has been docketed and will be heard as
Docket No. 4063 before the Zoning Board of Appeals of Cook
County, Illinois; and
WHEREAS, the Cook County State Attorney's Office has filed action
against the property owner and designated as Case No. 80Ml64856
seeking action against the property owner with respect to a
violation which involves the dumping and storage of gravel and
stone in violation of County zoning requirements; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount
Prospect have filed written objection with respect to the
continued illegal storage of excavated rock upon the subject
site; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount
Prospect are of the opinion that opposition to the proposed sign
variations is in the best interest of the Village of Mount
Prospect and the citizens of Cook County; and
WHEREAS, the corporate limits of the Village of Mount Prospect
lie adjacent to and therefore within one and one-half miles of
the land affected; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount
Prospect desire to exercise their authority and to file formal
objection in opposition to the proposed variations as authorized
by the Statutes of the State of Illinois and the ordinance of the
County of Cook, made and provided;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The Mayor and Board of Trustees of the Village
of Mount Prospect, having reviewed the proposed variations to
permit an enlarged doublefaced advertising sign on the subject
premises and to permit an additional doublefaced advertising sign
within five (5) feet of the Northwest Tollway right-of-way, finds
as follows:

That the visual impact of the advertising signs
presents a negative environment for residential units
within one thousand feet of a proposed sign location on
the subject property due to the sign size, height and
location;
B.
That until a solution has been made with respect to the
violation cited by the Cook County State Attorney's
Office, in particular by the removal of the gravel and
stone stored on the subject site, no further action
should be taken on the sign variations; and
C.
That Article XII, Section l2.84.2e requiring a setback
of 500 feet for advertising signs from any freeway,
expressway, or tollroad is in direct violation of the
Cook County zoning Ordinance.
SECTION TWO: That the Village of Mount Prospect, Cook County,
Illinois does hereby oppose the variations to the Cook County
Zoning Ordinance, as proposed under the Cook County Zoning Board
of Appeals Docket No. 4063.
SECTION THREE: That upon the passage and approval of this
resolution, the village Clerk of the Village of Mount Prospect be
and is hereby authorized and directed to file certified copies of
this resolution with the County Clerk of Cook County, with the
Secretary of the Zoning Board of Appeals of Cook County, with the
members of the zoning Board of Appeals of Cook County, and with
the President and Board of Commissioners of Cook County.
SECTION FOUR: That this Resolution shall be in full force and
effect from and after its passage and approval-in the manne~
provided by law.
