ORDINANCE NO. 4963
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP WITH
RESPECT TO THE ZONING OF CERTAIN PROPERTY FROM
R-X TO R-2 (SINGLE FAMILY RESIDENCE) DISTRICT
(3032-34 W. ALGONQUIN ROAD)
WHEREAS, William Rotolo is the owner of property commonly known as 3032-34 W. Algonquin
Road (hereinafter referred to as Subject Property) and legally described as:
Parcel 1: The East 66.7 feet of the West 229.10 feet of Lot 2 (except the North
703.70 feet) in Edward Busse's Division of Part of the Southeast ¼ of Section 15
and the Northeast ¼ of Section 22 all in Township 41 North, Range 11 East of the
Third Principal Meridian, in Cook County, Illinois. Parcel 4: The West 162.40 feet
(except the North 703.70 feet) of Lot 2 in Edward Busse's Division of Part of the
Southeast ¼ of the Section 15 and the Northeast ¼ of Section 22 all in Township
41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois.
WHEREAS, William Rotolo, (hereinafter referred to as Petitioner) has flied an application to rezone
the Subject Property from R-X (Single Famity Residence District) to R-2 (Single Family Residence
District Planned Unit Development); and
WHEREAS, a public hearing was held on the request for rezoning, being the subject of ZBA Case
No. 27-97 before the Zoning Board of Appeals of the Village of Mount Prospect on the 13th day of
August, 1998 pursuant to due and proper notice thereof having been published in the Mount
Prospect Journal and Topics on the 15~h day of January, 1998; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation relative
to ZBA 27-97 to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered
the request being the subject of ZBA 27-97 and have determined that the best interests of the
Village of Mount Prospect would be served by granting said request.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact
by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The official zoning map of the Village of Mount Prospect, Illinois, as amended,
is hereby further amended by reclassifying the property being the subject of this Ordinance from
R-X (Single Family Residence) to R-2 (Single Family Residence Planned Unit Development)
District.

SECTION THREE: That this amendment being the subject of this Ordinance is subject to the
following conditions:
1. A cash contribution of $1,575 shall be made for the installation of parkway trees in addition
to a developer contribution of $29,700 ($1,350 per unit).
2. The petitioner shall submit a letter from Community Consolidated School District 59
approving the terms of the easement agreement. Furthermore, the petitioner shall donate
$22,000 ($1,000 per unit) to School District 59 and install landscaping as proposed.
3. The petitioner shall appear before the Plan Commission to request approval of a plat of
subdivision to consolidate the two existing lots into one lot prior to the issuance of building
permits.
4. The following plans and correspondence shall be adopted as part of the governing
ordinance:
· Preliminary Engineering Plan prepared by Groundwork, Ltd. dated August 3, 1998;
· Site and Zoning information prepared by Groundwork, Ltd. dated August 3, 1998
(revised August 20, 1998);
· Landscape Plan prepared by ILT Vignocchi dated December 15, 1997
(revised August 4, 1998);
· Elevations and Roof Plan prepared by the Balsamo/OIsen Group, Inc. dated
March 10, 1998;
· Preliminary Site Plan prepared by Groundwork, Ltd. dated September 30, 1998;
· John Jay School Landscape Improvements per facsimile by Insignia Homes dated
July 28, 1998.
5. The petitioner shall modify the Homeowners Association documents to prohibit the use of
garages for storage.
6. The petitioner shall provide a letter of credit sufficient to cover the expense of installing the
landbanked parking spaces as depicted on the approved site plan.
SECTION FOUR: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.
