VVVL/ 8/1 O~98 ORDINANCE NO. 49sR AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 280-290 WESTGATE ROAD WHEREAS, Westgate Homeowners Association (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 280-290 North Westgate Road (hereinafter referred to as Subject Property), legally described as: Lot 17 in C.A. Goelz Prospect Gardens, being a Subdivision of the West 1/2 of the West 1/2 of the southeast 1/4 together with the East 2/3 of the North 3/4) of the northeast 1/4 of the southwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from Section 14.1304.B.1 to reduce the required front yard setback from thirty (30') feet to seven (7') feet; and WHEREAS, Petitioner seeks a variation from Section 14.1304.C to increase the maximum lot coverage from fifty (50%) percent to fifty-four (54%) percent to construct an additional 46 on-site parking spaces; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 13-98 before the Zoning Board of Appeals of the Village of Mount Prospect on the 9th day of July, 1998, pursuant to due and proper notice thereof published in the Mount Prospect Journal & Topics on the 24th day of June, 1998; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being the subject of ZBA 13-98 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. BA 13-98 Page 2 of 2 SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property variations from Section 14.1304.B.1 to reduce the required front yard setback from thirty (30') feet to seven (7') feet, and from Section 14.1304.C to increase the maximum lot coverage from fifty (50%) percent to fifty-four (54%) percent to allow for the construction of an additional forty-six (46) parking spaces. SECTION THREE: That all other rules and regulations of the Village shall apply to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect and after its passage, approval and publication in pamphlet form in the manner provided by law.
