AN ORDINANCE ANNEXING A PORTION OF DEDICATED
RIGHT-OF-WAY (DOUGLAS AVENUE)
WHEREAS, annexation along boundary lines of two adjoining municipalities, pursuant to 65 ILCS
5/7-1-25 of the Illinois Compiled Statutes; and
WHEREAS, a portion of dedicated unimproved right-of-way known as Douglas Avenue is located
within the corporate boundaries of the Village of Arlington Heights (hereinafter referred to as
Subject Property) and legally described as follows:
The West 33.0 of the West % of the Southwest 1/4 of the Southeast 1/4 of the
Northwest 1/4 of Section 10, Township 41 North, Range 11, East of the Third
Principal Meridian (except the South 33.0 feet and the North 33.0 feet thereof) in
Cook County, illinois;
and
WHEREAS, in order to develop the Craig's Subdivision, Phase II, located on the east side of
Douglas Avenue and located within the corporate boundaries of the Village of Mount Prospect it
is desirable to have that portion of dedicated right-of-way improved as part of the development
of property known as Craig's Subdivision, Phase I1; and
WHEREAS, in order to improve that portion of Douglas Avenue located adjacent to Craig's
Subdivision, it is necessary for the Village of Arlington Heights to disconnect that portion of
unimproved right-of-way being the subject of this Ordinance; and
WHEREAS, the Village of Arlington Heights considered the exclusion of the Subject Property and
did adopt Ordinance No. 98-031 excluding said property from the corporate boundaries of
Arlington Heights; and
WHEREAS, the corporate authorities of the Village of Mount Prospect did consider the
annexation of a portion of dedicated right-of-way known as Douglas Avenue at their regular
meeting held June 2, 1998; and
WHEREAS, the Village of Arlington Heights has excluded the Subject Property and the corporate
authorities of the Village of Mount Prospect have determined that the best interest of the Village
of Mount Prospect would be served by annexing the Subject Property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth herein are true and accurate.
SECTION TVVO: That the corporate authorities of the Village of Mount Prospect do hereby annex

the Subject Property, being an unimproved right-of-way legally described as follows:
The West 33.0 of the West % of the Southwest 1/4 of the Southeast 1/4 of the
Northwest 1/4 of Section 10, Township 41 North, Range 11, East of the Third
Principal Meridian (except the South 33.0 feet and the North 33.0 feet thereof) in
Cook County, Illinois;
SECTION THREE: That the Village Clerk of the Village of Mount Prospect shall record a
certified copy of this Ordinance, along with the executed copy of the Plat of Disconnection from
the Village of Ariington Heights and a certified copy and executed copy of the Plat of Annexation
to the Village of Mount Prospect with the Recorder of Deeds of Cook County, Illinois.
SECTION FOUR: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.

AN ORDINANCE CONSENTING TO THE
EXCLUSION AND ANNEXATION OF CERTAIN
PROPERTY LOCATED ON DOUGLAS AVENUE
BETWEEN WHITE OAK AND LINCOLN STREETS.
FROM THE VILLAGE OF ARLINGTON HEIGHTS
TO THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the corporate authorities of the Village of Arlington Heights have
received a request to exclude an area of unoccupied territory lying along the boundary line between
the Villages of Arlington Heights and Mount Prospect, an accurate map of which territory is attached
hereto as Exhibit "A", and made a part hereof; and
WHEREAS, the petitioner, Donald Craig, requests that pursuant to 65 ILCS 5/7-1-25,
said land be excluded from the Village of Arlington Heights and annexed to the Village of Mount
Prospect, Illinois,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF ARLINGTON HEIGHTS:
SECTION ONE: That pursuant to the provisions of 65 ILCS 5/7-1-25, the consent
of the corporate authorities of the Village of Arlington Heights is hereby given to the exclusion fix)m
the Village of Arlington Heights and annexation to the Village of Mount Prospect, Illinois of the
property legally described as follows:

SECTION TWO: That the exclusion fi.om the Village of Arlington Heights and
annexation to the Village of Mount Prospect consented in SECTION ONE of this ordinance is
ubject to condition that the petitioner shall provide the Village of Arlington Heights with an
easement for existing and future utilities in the area, to which the petitioner has agreed.
SECTION THREE: That the Village Clerk is hereby authorized and directed to
forward a certified copy of this ordinance to the corporate authorities of the Village of Mount
Prospect.
SECTION FOUR: That this ordinance shall be in full force and effect fi:om and after
its passage and approval in the manner provided by law; and the exclusion of the above described
property shall take effect upon the passage of an ordinance of annexation by the Village of Mount
Prospect, Illinois, and timely recording of such ordinance in the Cook County Recorder's Office, as
provided by law.
