I. CALL TO ORDER - ROLL CALL I[, ACCEPTANCE OF MINUTES OF DECEMBER 23, 1997 ]11, CITIZENS TO BE HEARD IV. _R. EQUEST TO CHANGE SOLICITATION HOURS At the October 7, 1997 Board meeting, under Citizens to be Heard, a citizen came forward and presented a petition requesting that the current ViLlage Ordinance regulating the hours for solicitation be amended to shorten the time allowed for solicitation from the current 9:00 p.m. time frame to sundown. At that time, the consensus of the Vilfage Board was to consider the request and staff was directed to survey surrounding municipalities in an effort to identify if a "norm" existed. Staff has completed its review and forwards background information and a recommendation to consider amending the present Solicitation Ordinance so as to take into account seasonal daylight changes with an eye on restricting solicitation, to the extent possibte, to times when natural daylight is present. Attached is an information package including a cover memorandum from Police Chief Ronaid Pavlock outlining his research and recommendations, The citizen who initiated the request has been notified of Tuesday evening's meeting and appropriate staff will be present to answer questions and facilitate discussion. V. TOBACCO SALES REGULATIONS During the recent discussion on future Committee of the Whole topics, Trustee Richard Lohrstorfer requested consideration be given to establishing a special license covering the sale and/or distribution of tobacco products. This special license would allow for specific enforcement of "sales to minors" violations whereby a tobacco vendor's license could be suspended or revoked without necessarily putting the entire retail operation out of business, The Village Board unanimously concurred with considering this type of license. Village Clerk Carol Fields informed me that, in fact, we have had a requirement for a Tobacco Vendor's License in the Village Code since 1957! We do issue special Licenses for all cigarette vending machines and retail establishments which sell tobacco products separate and apart from the requirement of a general Business License, I must confess that I am somewhat embarrassed That I was not aware of this fact at the time of Trustee Lohrstoffer's request. NOTE: ANY INDIVIDUAL WHO WOULD LIKE TO ATTEND THIS MEETING BUT BECAUSE OF A DISABILITY NEEDS SOME ACCOMMODATION TO PARTICIPATE, SHOULD CONTACT THE VILLAGE MANAGER'S OFFICE AT '100 SOUTH EMERSON, MOUNT PROSPECT, ILLINOIS 60056, 847/392-6000, EXTENSION 5327, TDD #847/392-6064. Notwithstanding, there is a need to review and update our general regulations regarding the sale of tobacco products so as to bring same into conformance with State and Federal regulations which were adopted in 1997. As such, a draft Ordinance updating Article XXXVII (Sale of Tobacco Products) of Chapter 11 of the Village Code is forwarded for your review and consideration. Appropriate staff wilt be available to answer questions and facilitate discussion. The Village Board may wish to consider forwarding this draft Ordinance to the newly created Youth Commission for their review and comment. The Youth Commission may also have some suggestions, or could undertake the creation of a public education program aimed at informing young people of the existence of the Ordinance and the potential penalties for violating same. Property Acquisition 5 ILCS 120/2 (c) (5) ~ "The purchase or lease of real property for the use of the public body, including meetings held for the purpose of discussing whether a particular parcel should be acquired." 2. Litigation 5 ILOS 1202/2 (c) (11) - "Litigation, when an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent, in which case the basis for the finding shall be recorded and entered into the minutes of the closed meeting."
