RESOLUTION NO. 55-99
A RESOLUTION AUTHORIZING A REPRESENTATIVE OF THE
VILLAGE OF MOUNT PROSPECT TO SIGN GRANT DOCUMENTS RELATIVE TO
A STORMWATER MANAGEMENT AND FLOOD CONTROL PROJECT.
WHEREAS, application provisions for grants from the Illinois First program for public works
improvements require that the Village of Mount Prospect authorize a representative to sign the
grant application forms and supporting documents for all eligible projects; and
WHEREAS, the Village of Mount Prospect designates the Village Manager as the authorized
representative of the Village of Mount Prospect to sign grant documents in conjunction with the
Stormwater Management and Flood Control Project.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect do
hereby designate the Village Manager of the Village of Mount Prospect to sign grant documents
from the Illinois First program in conjunction with the Stormwater Management and Flood
Control Project C173177.
SECTION TWO: That this Resolution shall be in full force and effect from and after its passage
and approval in the manner provided by law.

PART II PROJECT DESCRIPTION
The proposed project consists of a stormwater management and flood control project located in the
Wedgewood Subdivision of the Village of Mount Prospect. The work will include the construction of
storm sewers, culvert installations, ditch cleaning and improvements, earthwork and grading.

Illinois First Grant Conditions
1. Scope of Work
By acceptance of this grant offer, the recipient hereby agrees that the funds awarded under
this grant will be expended or legally obligated within two years from the date of award for
the purposes identified in Section 83 of Public Act 91-20 which reads as follows:
This appropriation is from the Fund for Illinois' Future to the Environmental Protection
Agency for grants to units of local government, educational facilities, and not-for-profit
organizations for infrastructure improvements, including but not limited to planning,
construction, reconstruction, renovation, equipment, utilities and vehicles.
Date of award is considered to be the date the Director of the Illinois Environmental
Protection Agency signs the grant agreement (see Part IV of the grant agreentent for this
date).
2. Project Approval
The award of grant assistance does not imply approval by this Agency for the proposed scope
of work. The recipient must apply for and receive appropriate Agency permits prior to
initiating construction.
3. Project Schedule
For the purposes of this agreement, the start date will be the date that the grant is awarded
to the recipient and the complete date will be two (2) years from this date.
4. Payment
Subject to the appropriation of funds by the General Assembly, a payment for the full amount
0fthe grant will be processed after the grant agreement is signed by the Director. All funds
including any interest earnings which remain unexpended at the completion of this grant
agreentent shall be returned to the State within 45 days.
5. Kequired Sign-Offs
By acceptance of this offer, the recipient provides assurance that grant funds will not be
expended for construction prior to the receipt of environmental sign-offs as required under
State statute from the Historic Preservation Agency, Department of Natural Kesources and
Department of Agriculture.
6. Project Certification
By acceptance of this offer, the recipient provides assurance that all grant funds plus any
interest earmngs will be expended for the purposes intended in Special Condition I above
in accordance with all applicable federal, state and local law and agrees to provide a written
certification to that effect upon completion of the project.
7. Access
a) The Agency and any persons designated by the Agency shall at all reasonable times
have access to the premises where any portion of the project for which the grant was
awarded is being performed. Subsequent to cessation of grant support Agency
personnel or any authorized representative shall at all reasonable times have access
to the project records and to the project site, to the full extent of the grantee's right
to access.
b) Any contract entered into by the grantee for work, and any subagreement thereunder,
shall provide for representatives of the Agency to have access to the work whenever
it is in preparation or progress and that the contractor or subcontractor will provide
proper facilities for such access and inspection. Such contract or subagreement must
also provide that the Agency or any authorized representative shall have access to any
books, documents, papers, and records of the contractor or subcontractor which are
pertinent to the project for the purpose of making audit, exam/nation, excerpts, and
transcriptions thereo£
8. Audit and Records
a) The recipient shall maintain books, records, documents, reports, and other
evidentiary material and accounting procedures and practices that conform to
generally accepted government accounting standards in accordance with the
American Institute of Certified Public Accountants Professional Standards.
I) The receipt and disposition by the grantee of all assistance received for the
project, including both State assistance and any matching share or cost
sharing; and
2) The costs charged to the project, including all direct and indirect costs of
whatever nature incurred for the performance of the project for which the
grant has been awarded. The foregoing constitute "records" for the purposes
of this condition.
b) The recipient's facilities, or such facilities as may be engaged in the performance of
the project for which the grant has been awarded, and the recipient's records shall be
subject at all reasonable times to inspection and audit by the Agency or any
authorized representative.
c) The recipient shall preserve and make his records available to the Agency or any
authorized representative:
1) Until expiration of 3 years from the date of project certification under
Special Condition 6 of this grant, and
2) For such longer period, if any, as is required by applicable statute or lawful
requirement.
d) Records which relate to litigation or the settlement of claims ar/sing out of the
performance of the project for which this grant was awarded, or costs and expenses
of the project as to which exception has been taken by the Agency or any of its duly
authorized representatives, shall be retained until such appeals, litigation, claims, or
exceptions have been disposed off
Termination
Any failure by the recipient or any contractor or subcontractor of the recipient found in
noncompliance with the terms of this grant or applicable federal, state and local law shall be
cause for termination of the grant and refund to the State of Illinois of the entire amount of
the grant funds offered.
