RESOLUTION NO. 42-99
A RESOLUTION AUTHORIZING THE VILLAGE OF MOUNT PROSPECT TO
ENTER INTO AN AUTOMATIC FIRE MUTUAL AID AGREEMENT
WITH THE VILLAGE OF ARLINGTON HEIGHTS, ILLINOIS
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect has
deemed that the best interests of the Village may be served by entering into
intergovernmental agreements; and
WHEREAS, 65 ILCS 5/11-6-1 empowers municipalities and fire protection districts
to enter into mutual aid agreements; and
WHEREAS, the Village of Mount Prospect and the Village of Arlington Heights are
members of a Mutual Aid Box Alarm System, pursuant to an agreement since
1973, renewed in 1989; and
WHEREAS, each community desires to supplement said agreement to provide
automatic fire mutual aid to specific areas within both communities, as outlined in
the attached agreement; and
WHEREAS, said agreement is a direct benefit to the Village of Mount Prospect
and its residents by improving upon the Village's fire service capabilities.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: That the Board of Trustees do hereby authorize the Village of
Mount Prospect to participate in an Automatic Fire Mutual Aid Agreement with the
Village of Arlington Heights.
SECTION TWO: That the Mayor and the Fire Chief are hereby authorized to sign
the agreement between the Village of Mount Prospect and the Village of Arlington
Heights, being the subject of this Resolution, a copy of said agreement being
attached hereto and hereby made a part hereof as Exhibit '%".

SECTION THREE: That this Resolution shall be in full force and effect from and
after its passage and approval in the manner provided by law.

AUTOMATIC FIRE MUTUAL AID AGREEMENT
BETWEEN THE VILLAGE OF ARLINGTON HEIGHTS, ILLINOIS AND
THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
In accordance with 65 ILCS 5/11-6-I, which empowers Municipalities and Fire Protection
Districts to enter into "Mutual Aid Agreements," and in accordance with the MABAS
Agreement entered into by the Village of Arlington Heights and the Village of Mount Prospect
in 1973, renewed in 1989, the Village of Arlington Heights and the Village of Mount Prospect
agree to provide Automatic Mutual Aid to each other on structural fire alarms as follows:
GENERAL CONDITIONS
1. Equipment responding on an automatic mutual aid response to the other community shall
have a minimum of three (3) fire departznent personnel on fire apparatus.
2. Only one (1) unit from the fire department providing aid shall be required to respond at
any one time. In the event that the unit due is unavailable (i.e., out of service, committed
to another call), no back-up unit from another station shall be required to respond.
3. At all times, the municipality within which the emergency exists will be in charge and
responsible for the operations at the emergency scene. If an automatic aid unit is the first
on the scene, the company officer shall exercise his/her discretion as to the appropriate
action to be taken. Upon arrival of a company officer from the community having
jurisdiction, command of the emergency scene shall be transferred in a smooth and
efficient manner to the fire department in whose municipality the emergency exists.
4. Each municipality agrees to provide and participate in quarterly training between the two
fire departments.
5. Each municipality agrees that the general provisions of the MABAS Mutual Aid
Agreement apply to this agreement, except as modified by this agreement.
6. Each jurisdiction agrees to waive all claims against the other party for compensation for
any loss, damage, personal injury or death occurring as a result of performance in
conjunction with this agreement. General liability insurance, personal injury insurance,
and property/vehicle insurance shall be the responsibility of each individual
jurisdiction/department.

RESPONSE AREAS
1. The Village of Arlington Heights Fire Department agrees to provide the Village of Mount
Prospect Fire Department, subject to the provisions of Paragraph Two (2) of the General
Agreement:
A. One (1) engine company to the following areas:
To the area bordered by the most westerly border of Mount Prospect between
Central Road and Algonquin Road up to Busse Road as the most easterly border
on Code 3 responses.
To the area bordered by Busse Road on the west between Central Road and
Algonquin Road up to Elmhurst Road (Route 83) as the most easterly border on
Code 4 confirmed fires.
To the complex known as 3-Com at the southeast comer of Central Road and
Arthur Avenue.
2. The Village of Mount Prospect agrees to provide the Village of Arlington Heights Fire
Deparmaent, subject to the provisions of Paragraph Two (2) of the General Agreement:
A. One (1) engine company to the following areas:
The entire area of District 3 bordered by Central Road on the north, Arlington
Heights Road on the west, the Northwest Tollway on the south and the Mount
Prospect border on the east.
Minor modifications of the above response areas, as well as the vehicles assigned, may be made
without further modification to this agreement. However, said modifications must be mutually
agreed upon, in writing, by the two respective fire departments.

TERMINATION OF AGREEMENT
Either the Village of Arlington Heights or the Village of Mount Prospect may terminate this
agreement by notifying the Fire Chief of the other fire department, in writing, sixty (60) days
prior to the requested date of termination.
TERM OF AGREEMENT
This agreement shall be effective as of the 7~ day of~ , 1999 and shah
continue in full force until terminated, in writing, by either party.
