Information
The petitioner, David Kimof MedTec Healthcare & Private Duty, LLC, is seeking conditional use to allowadult
daycare center at 411 Business Center Drive (the "Subject r ry"). The Subject Property is an existingvacant
spacewithin a multi-tenantoffice building and is located on the southeasti usiness Center Drive in Kensington
Business Center. The Petitioner is proposingto operate an adult daycarefacility out of the vacant space. The daycare
wouldr y through Friday between the hours . Transportation service is provided
for the seniors. The program will service up to 85 senior participants and have13 staff b rs present each day.
Earlier this year, the petitioner went through the public hearing processto open a similar daycarefacility located
618 E. Golf . This is in addition to two other facilities that they operate in Chicagon heeling. Due to the
strongtheir daycare services at 618 E. Golf , the petitioner is proposingto open a similar facility at
the Subject Property. Daily operation would involve activities such as light physical exercise, r s, events
discussion, its and crafts lessons.
Village s reviewed the conditional use request and is supportive the proposed adultdaycare center, subject
to the fire and safety concerns being addressedr cc cy is granted.
Staff not received iv feedback the requested conditional use.
At the Public Hearing heldn September 12, 2019., the Planning and ZoningCommission recommended rvi the
Petitioner's request for a conditional use by a vote of 6-0.

AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT
FOR PROPERTY LOCATED AT 411 BUSINESS CENTER DRIVE,
MOUNT PROSPECT, ILLINOIS
WHEREAS, David Kim of MedTec Healthcare & Private Duty, LLC ("Petitioner") has filed a petition for a
Conditional Use permit for the property located at 411 Business Center Drive("Property") and legally
described as follows:
LOT 10 IN KENSINGTON CENTER PHASE ONE, A SUBDIVISION IN THE EAST 1/2 OF SECTION 34
AND THE WEST 1/2 OF SECTION 35, TOWNSHIP 42 NORTH, RANGE 11 EAST OF THE THIRD
PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT RECORDED OCTOBER 2, 1979 AS DOCUMENT
25173362, EXCEPTING THEREFORM THAT PART DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHWEST CORNER OF THE NORTHWEST 1/4 OF SECTION 35,THENCE
SOUTH 89 DEGREES 39 MINUTES 56 SECONDS EAST, ALONG THE SOUTH LINE OF SAID
NORTHWEST 1/4, 79.12 FEET TO THE SOUTHEASTERLY RIGHT OF WAY LINE OF BUSINESS
CENTER DRIVE FOR THE POINT OF BEGINNING; THENCE NORTH 60 DEGREES 12 MINUTES 54
SECONDS EAST ALONG SAID SOUTHEASTERLY RIGHT OF WAY LINE, 36.77 FEET TO A POINT OF
CURVATURE; THENCE NORTHEASTERLY ALONG SAID SOUTHEASTERLY RIGHT OF WAY LINE,
BEING AN ARC OF A CIRCLE CONVEX SOUTHEASTERLY AND HAVING A RADIUS OF 544.97 FEET
(THE CHORD OF WHICH ARC BEARS NORTH 57 DEGREES 03 MINUTES 11 SECONDS EAST AND

FEET TO THE POINT OF BEGINNING IN COOK COUNTY, ILLINOIS.
Property Index Number: 03-35-102-007-0000; and
WHEREAS,the Petitioner seeks a Conditional Use permit to operate an adult daycare center for the property
located at 411 Business Center Drive; and
WHEREAS, a Public Hearing was held on the request for a Conditional Use permit being the subject of PZ-
17-19 before the Planning and Zoning Commission of the Village of Mount Prospect on the 12th day of
September, 2019, pursuant to proper legal notice having been published in the Daily Herald Newspaper on
the 28th day of August, 2019; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the
President and Board of Trustees in support of the request being the subject of PZ-17-19; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have given consideration to
the request herein and have determined that the same meets the standards of the Village and that the
granting of the proposed Conditional Use permit would be in the best interest of the Village.
NOW,THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth are incorporated as findings of fact by the Mayor and Board of
Trustees of the Village of Mount Prospect.
SECTION TWO: The Mayor and Board of Trustees of the Village of Mount Prospect do hereby grant a
Conditional Use permit for an adult daycare center for the property located at 411 Business Center Drive
subject to the following conditions:

1. "Provide architectural plans which include:
a. A building code analysis reflecting existing and proposed conditions;
b. All egress, uses, types of construction, occupant load, and any necessary changes due to the
change in use group per the International Building Code (IBC);
2. An inspection from the Illinois Department of Aging shall be performed prior to granting occupancy; and
3. Compliance with all Development, Fire, Building, and other Village codes and regulations."
SECTION THREE: The Village Clerk is hereby authorized and directed to record a certified copy of this
Ordinance with the Recorder of Deeds of Cook County.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and
publication in the manner provided by law.

Commissioner Beattie called the meeting to order at 7:05 pm. Commissioner Filippone made a motion
seconded by Commissioner Beattie to approve the minutes from the Planning and Zoning Commission
meeting on July 11, 2019. The minutes were approved 5-0 with Commissioner Otteman abstaining.
Chairman Donnelly introduced case PZ-17-19 as 411 Business Center Drive.
Mr. Harmon gave a brief description of the Subject Property and the proposed adult day care. He stated
the hours of operation and the intention of the Petitioner to provide transportation to and from the
facility. Up to 85 participants could be within the facility at any one time with 13 staff present. Mr.Harmon
described the floor plan which will consist of open space, offices, a nurse's room, and various recreation
rooms.
Mr. Harmon explained the parking analysis,and determined that the existing parking lot is sufficient given
the parking regulations in the village Code. He also stated a building code analysis would have to be done
to ensure proper fire prevention.
Mr. Harmon stated that Staff believes the Petitioner's conditional use request complies with the
conditional use standards and is supportive of that request.

He explained that Staff finds the adult daycare center meets the conditional use standards subject to
complying with the conditions listed below and that granting such requests would be in the best interest
of the Village. Based on these findings,Staff recommends that the Planning and Zoning Commission make
a motion to adopt staff's findings as the findings of the Planning and Zoning Commission and recommend
goval of the following motion:
"To approve a conditional use for an adult daycare center at 411 Business Center Drive, subject to the
following conditions:
1. Submittal of architectural plans, including:
a. A building code analysis reflecting existing and proposed conditions;
b. All egress, uses,types of construction,occupant load,and any necessary changes due
to the change in use group per the International Building Code (IBC);
2. An inspection from the Illinois Department of Aging shall be performed prior to granting
occupancy; and
3. Compliance with all Development, Fire, Building,and other Village codes and regulations."
The Village Board's decision is final for this case.,
Commissioner Beattie asked if any other requirements were needed besides the conditions in the staff
report.
Mr. Harmon stated that from a pillage perspective, only a business license would be needed. Unrelated
to the Village,the Petitioner would also need an inspection from the Illinois Department of Aging.
Commissioner Fitzgerald asked why a conditional use is required,
Mr. Harmon stated that the Village Code requires all day care centers to go through the Conditional Use
process.
Mr. Kim was sworn in by Commissioner Beattie, and Commissioner Filippone asked the Petitioner if they
had come to the Commission for a previous adult daycare request. Mr. Kim stated that yes,and that it will
be a second location.
Mr. Kim described bath day care centers and indicated there is generally a high demand for adult day
cares in the area.
Mr. Kim also stated that the only cars generated from this use are from employees.
Hearing no public comment from the audience,Commissioner Beattie brought back the discussion to staff
and the Commission.
There was some general discussion about the use and location. Following that Commissioner Fitzgerald
made a motion seconded by Commissioner Mizwicki to approve the following motion:

The proposed adult daycare center would occupy an existing office space, and will operate Monday—Friday
from 8:30am —2:30pm. The proposed service is designed for older adults who wish to remain in the
community and in their own homes, but look for additional care and socialization. Planned programming
includes current events discussion, light physical exercise such as choreographed dancing lessons, musical
entertainment and learning, board games, and arts and crafts lessons. The daycare use is proposed to
operate Monday through Friday between the hours of 8:30arn and 2:30 m. Transportation service is
provided for the seniors. The program will service up to 85 senior participants on a daily basis and have 13
staff members present each day.
Fire Safety
The proposed daycare use will most likely require several building improvements related to fire safety. Staff
is requiring architectural plans showing a building code analysis which reflect all egress, uses, types of
construction, occupant load, and any necessary changes due to the change in use groups per the
International Building Code (IBC). In addition, an inspection from the Illinois Department of Aging will be
required.

10 licensed capacity slots and 1 space for each employee, and will bring the overall parking requirements for

COMPREHENSIVE PLAN DESIGNATION
The Village Comprehensive Plan designates the Subject Property as business and light industrial. The
proposed use is consistent with the Comprehensive Plan as it furthers services available to seniors and is
compatible with surrounding uses.
COMPATIBILITY WITH VILLAGE CODE
The standards for conditional uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and
include seven specific findings that must be made in order to approve a conditional use. The following list is
a summary of these findings:
The conditional use will not have a detrimental impact on the public health, safety, morals, comfort
or general welfare;

The conditional use will not be injurious to the use, enjoyment, or value of other properties in the
vicinity or impede the orderly development of those properties;
There is adequate provision for utilities, drainage, and design of access and egress to minimize
congestion on Village streets; and
The request is in compliance of the conditional use with the provisions of the Comprehensive Plan,
Zoning Code, and other Village Ordinances.
Per the Petitioner, the adult daycare will not be a detriment to or endanger the welfare of the public. The
daycare center will provide quality care and a safe place for seniors in the community to go during the day,
and it will utilize an existing space.The Petitioner states that the center will not generate traffic as most
seniors will be bused in every day. The Petitioner further states that the daycare will operate in harmony
with adjacent properties and benefit elder) in the Village of Mount Prospect and surrounding communities.

Village Staff believes that the Petitioner's conditional use request complies with the conditional use
standards and is supportive of the request. Other departments reviewed the Petitioner's proposal and did
not object to the use, subject to the fire safety concerns being addressed before occupancy is granted. The
proposed use will not be a detriment or endanger the welfare of the general public. The proposed use
complies with the Comprehensive Plan and furthers services available to seniors in the community.

MedTec Healthcare & Private Duty d/b/a Super Senior Center operates adult day service programs that provide
non-medical health and social community-based care options for the elderly and their families residing in Mount
Prospect and surrounding communities.
Adult day service is designed for older adults who wish to remain in the community and in the comfort and
familiarity of their own or family homes, but benefit from care and socialization during the day. Adult day service
also provides respite for family care givers, particularly those who work during the day-time, and socialization for
isolated adults. Many of our participants attend the adult day center with others they know from the community,
and the environment offers them a safe place to engage with their community.The majority of our senior
participants speak English as a second-language, and for them,there are limited options for daytime care where
they can engage with individuals who speak their native language and have consideration for their cultural
backgrounds.
MedTec provides a vital service to help seniors maintain or enhance their level of independence, prolonging their
ability to live independently in residential settings. As the baby-boomer generation continues to age,the number
of seniors within the community will rapidly increase, making MedTec's and other adulty day care providers an
important pillar of home and community-based senior care.
Program participants benefit from active programming at our centers including for example:
- Current events discussion and education seminars
- Light physical exercise such as choreographed group and line dancing lessons
- Musical entertainment and learning such as ukulele classes, choir practice, and karaoke sessions
- Social activities including board games and birthday celebrations
- Art&Craft sessions and lessons
Our program director and aides are also actively involved in the community and support the senior participants in
the program by being a resource and caregiver for the seniors.
Our adult day care programs are open Monday—Friday, and our hours of operation are from 8:30am—2:30pm.
MedTec provides and coordinates participant transportation pick up and drop off service in small vans, which
reduces the amount of client vehicle traffic and the number of parking spaces required.
Further, a dietician approved menu of breakfast, lunch, and snacks are provided by outside catering services and
served to the participants.
Our proposed location at 411 Business Center Drive, Suite 104 in Mount Prospect would serve an average of up
to 85 senior participants on a daily basis.Additionally,there will be up to 13 staff present on a daily basis, which
we expect to consist of 1 center director; 1 programming director; 1 registered nurse; up to 9 teachers/adult day
care staff; and 1 operations staff.

Response to Mount Prospect Conditional Use Standards

No conditional use shall be recommended for approval by the planning and zoning commission unless it finds:
1. That the establishment, maintenance, or operation of the conditional use will not be detrimental to,or
endanger the public health, safety, morals,comfort,or general welfare;
The MedTec adult day care and senior center will not endanger public health, safety, morals, comfort or general
welfare. Rather, it will provide quality care and a safe place for seniors in the community to go during the day,
and it will utilize an existing building within the community.The Illinois Department on Aging will certify and audit
the center on an ongoing basis.
2. That the conditional use will not be injurious to the uses and enjoyment of other property in the
immediate vicinity for the purposes already permitted, nor substantially diminish and impair property
values within the neighborhood in which it is to be located;
The adult day care and senior center will operate within the existing building and is an appropriate use of the
building space.The center will not create extra noise, odor, smoke, or light. The low number of cars and small
vans related to the MedTec center will be parked in the existing parking lot, and the nature of the senior center is
such that there will not be a lot of traffic or cars coming and going from the parking lot (e.g., drop-offs and pick
ups provided by MeclTec's small vans are only once a day).The MedTec adult day care and senior center will
operate in harmony with the adjacent properties and other property within the immediate vicinity.
3. That the establishment of the conditional use will not impede the normal and orderly development and
improvement of the surrounding property for uses permitted in the district;
As the population continues to age in Mount Prospect and surrounding communities, adult day care and senior
centers are needed to provide adequate and cost-effective care to needy seniors.The majority of MedTec's
senior clients qualify for Medicaid and do not have alternatives to the care that MedTec and other similar
agencies provide. MedTec will not alter the essential character of the area in any way, and the MedTec adult day
care and senior center will be appropriate for the neighborhood and surrounding area, providing a valuable
community service to residents.
4. That adequate public utilities, access roads,drainage and/or necessary facilities have been or will be
provided;
The MedTec adult day care and senior center will be housed within the existing office building complex.There are
more than adequate public utilities, access roads, drainage and necessary facilities for the office building
complex, of which MedTec will only be using a portion of the space.
5. That adequate measures have been or will be taken to provide ingress and egress so designed as to
minimize traffic congestion in the public streets;

The MedTec adult day care and senior center will have a low number of cars and vans going to and from the
facility. MedTec utilizes small vans to transport the seniors to the center, thereby reducing the vehicular traffic,
and there will be a low number of MedTec staff members that will drive.The MedTec adult day care and senior
center will only use a small portion of the available existing parking spaces.
6. That the proposed conditional use is not contrary to the objectives of the current Comprehensive Plan for
the Village;
The MedTec adult day care and senior center will benefit the elderly in Mount Prospect and surrounding areas
and will be housed in an existing building.
7. That the conditional use shall, in all other respects, conform to the applicable regulations of the district in
which it is located, except as such regulations may, in each instance, be modified pursuant to the
recommendations of the Planning&Zoning Commission.
The MedTec adult day care and senior center is appropriate for the district and will become a valuable
community resource that will provide affordable care for the aging population. MedTec will operate within the
