Commissioner Beattie called the meeting to order at 7:04 pm. Commissioner Filippone made a motion
seconded by Commissioner Fitzgerald to approve the minutes from the Planning and Zoning Commission
meeting on November 8, 2018. The minutes were approved 4-0 with. Commissioner Beattie introduced
case, PZ-27-18 918 S. Elm Street.
Mr. Harmon gave a brief description of the Subject Property and the surrounding parcels. He stated the
requested proposal is for a variation to the front yard coverage. He further explained front yards in the R-
X Single Family Residence District may not be developed with total impervious surfaces exceeding thirty-
five percent(35%).The proposed exterior improvements increase yard coverage to 43.4%.The Petitioner
is also proposing to add a second floor and third garage stall to the existing home.
Mr. Harmon explained the zoning requirements for district R-X and stated that the primary structure was
built almost thirteen feet (13') into the required front yard setback.
He summarized the Variation Standards as the following:

• A hardship due to the physical surroundings, shape, or topographical conditions of a specific
property not generally applicable to other properties in the same zoning district and not created
by any person presently having an interest in the property;
• Lack of desire to increase financial gain; and
• Protection of the public welfare, other property,and neighborhood character.
Mr. Harmon stated per the Petitioner, the variation request is a result of the home being an existing-
nonconforming structure that encroaches more than twelve feet (12') into the required front yard
setback. The curved nature of the front property line also includes additional square footage of the
nonconforming home in the required setback.
Mr. Harmon stated Staff finds that the standards forvariation have been satisfied.Based on these findings,
staff recommends that the Planning and Zoning Commission make a motion to adopt staff's findings as
the findings of the Planning and Zoning Commission and gpprove the following motion:
1. A variation to allow front yard coverage to be 43.4% for 918 S. Elm Street for the purpose of
locating a circular driveway.
He stated the Planning and Zoning Commission's decision is final.
Commissioner Beattie clarified that the related improvements of the property will be in full compliance
with the zoning district's bulk regulations.
Mr. Harmon stated that he was correct.
Commissioner Filippone asked if the other circular driveways in the neighborhood were grandfathered in
or constructed after they were annexed into the Village.
Mr. Harmon stated they were grandfathered in and considered legal non-conforming.
Mrs.Arguilles swore in the Petitioners.John Bouzas(homeowner)918 S. Elm Street and Robert Kolososki
(architect)415 S. Middleton, Palatine.
Mr. Bouzas gave a briefly explained the need for the circular driveway and that they hope to care for his
elderly in laws in their home. He stated the front yard setbacks will stay the same they are just asking of
the front lot coverage variation to allow the circular driveway.
Hearing no further questions for the Petitioner, Commissioner Beattie brought the discussion back to the
board.
There was general positive discussion between the commissioners regarding the details of the request.
Commissioner Fitzgerald made a motion seconded by Commissioner Filippone to approve the following
motion:
1. A variation to allow front yard coverage to be 43.4% for 918 S. Elm Street for the purpose of
locating a circular driveway.

The motion was approved with a 4-0 vote.This case is Planning and Zoning Commission Final.

After hearing two additional cases, Commissioner Fitzgerald made a motion seconded by Commissioner
Fillippone and the meeting was adjourned at 10:38 pm.
