Chairman Donnelly called the meeting to order at 7:04 pm. Commissioner Filippone made a motion
seconded by Commissioner Szymczak to approve the minutes from the Planning and Zoning Commission
meeting on April 25, 2019. The minutes were approved 4-0. Commissioner Beattie introduced case,
PZ -10-19 403 S. Douglas Avenue, this case is Planning and Zoning Commission Final.
Mr. Harmon gave a brief description of the Subject Property stating that the Petitioner is seeking a
variation to exceed allowable lot coverage to construct a shed in the rear of the home.
Mr. Harmon explained that the Petitioner has an existing non -conforming shed located in the southeast
corner of the Subject Property that is deteriorating. The Petitioner proposes to remove the existing non-
conforming shed, and replace it with a new shed that would be located in the northeast corner of the
Subject Property outside of the utility easement.
Mr. Harmon stated, per the Petitioner, the shed is an eye sore and safety hazard and was unaware the
property was over on lot coverage when the home was purchased.
Mr. Harmon further explained that Village Staff believes the Petitioner's variation request does not meet
the standards and is therefore not supportive of the request. There are several other side load garages

near the Subject Property, all of which have to comply with the forty-five percent (45%) lot coverage
requirement. He further stated, staff recommends that the Planning and Zoning Commission make a
motion to adopt staff's findings as the findings of the Planning and Zoning Commission and recommend
denial of the following motion:
1. A variation to allow lot coverage of 50.33% for the Subject Property, also known as 403 S. Douglas
Avenue, as shown on plans created by Tuff Shed, dated April 11, 2019.
He stated that the Planning and Zoning Commission's decision is final for this case.
There was general discussion between the commission and Staff regarding the details of replacing up to
50% of the shed by right. Mr. Shallcross clarified that the Petitioner could replace up to 50% of the physical
structure and shill be in compliance with the code.
Commissioner Beattie swore in Patricia Ramirez and Leora Williams 403 S. Douglas Avenue,
Ms. Ramirez gave a brief history of the property and shed. She stated that they are willing to keep the
shed in the current place if they are able to replace the whole shed. She also stated that she had a
contractor out to look at replacing parts of the shed to comply with the 50% legal non -conforming rule;
however, in order to fix the issues the amount of work would be substantial and may not be fixable.
She also stated there is a small amount of standing water behind the shed when it rains heavily because
her neighbors sub pump drains to the back of the property.
Commissioner Beattie asked how the new shed would be installed.
Ms. Ramirez stated that the shed would sit on a frame with four inches of gravel underneath.
There was general explanation of the voting process to the Petitioner.
Hearing no further questions for the petitioner and from the public, Commissioner Beattie brought the
discussion back to the board.
Commissioner Filippone made a motion seconded by Commissioner Mizwicki to approve the following
motion:
1. A variation to allow lot coverage of 50.33% for the Subject Property, also known as 403 S. Douglas
Avenue, as shown on plans created by Tuff Shed, dated April 11, 2019.
UPON ROLL CALL AYES: Beattie, Mizwicki, Szymczak
NAYS: Filippone
The vote was approved 3-1 and the Planning and Zoning Commission's decision is final for this case.

Hearing no further cases to be discussed, Commissioner Filippone made a motion seconded by
Commissioner Syzmczak and the meeting was adjourned at 7:38 pm.
