AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMMONLY KNOWN AS 716 NORTH PROSPECT MANOR
WHEREAS, David Kennebeck (hereinafter referred to as Petitioner) has filed an application for a
variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly
known as 716 North Prospect Manor (hereinafter referred to as Subject Property), legally described
as:
Lot 8 in the Resubdivision of Lots 6 to 10, both inclusive in Block 5, Lots 1 to 10, both
inclusive in Block 6, Lots 1 to 10, both inclusive in Block 7, Lots 1 to 10, both
inclusive in Block 8 and all of the vacated alleys (as per plat recorded December 20,
1954, as Document #16103192) lying South of and adjoining said lots in said blocks
all in Randview Highlands, being a Subdivision of the Northwest % of the Northwest
Quarter and the Northeast Quarter of the Northwest Quarter of Section 34, Township
42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; and
WHEREAS, Petitioner seeks a variation from Sections 14.306.B.1 and 14.306.B.2 to allow a size
increase of an existing garage from 600 square feet to 720 square feet (24' X 30% and to reduce the
required side setback from 5 feet (5') to three feet (3'); and
WHEREAS, a public headng was held on the variation requested being the subject of ZBA Case No.
ZBA 12-99 before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of
May, 1999, pursuant to due and proper notice thereof published in the Mount Prospect Journal &
Topics on the 12t~ day of May, 1999; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the
President and Board of Trustees in support of the request being the subject of ZBA 12-99; and
WHEREAS, the President and Board of Trustees of the Village have given consideration to the
request herein and have determined that the best interests of the Village of Mount Prospect would
be served by granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the
President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant
to the Subject Property a variation from Sections 14.14.306.B.1 and 14.306.B.2 to allow a size
increase of an existing garage from 600 square feet to 720 square feet (24' X 30'), and a reduction
in the required side setback from five feet (5') to three feet (3').

SECTION THREE: In accordance with the provisions of Section 14.203.C.12 of Chapter 14 of the
Village Code, the variations granted herein shall be null and void unless permits are issued and
construction begins within one (1) year from the date of passage of this Ordinance.
SECTION FOUR: This Ordinance shall be in full force and effect and after its passage, approval and
publication in pamphlet form in the manner provided by law.
